Trump’s lawyers submitted a 78-page trial brief to the Senate, arguing that it is unconstitutional to try a former president on articles of impeachment, that Trump’s speech at the January 6 rally urging his supporters to “fight” was rhetorical, and that the former president was well within his First Amendment rights to speak as he did. It blames the attack on the Capitol not on Trump’s incitement of violence over time — as the article of impeachment does — but on “a small group of criminals.”

The document seems designed to appeal to an audience of one: Trump himself. It repeatedly uses “Democrat” as a derogatory adjective, accusing “Democrat members” of Congress of “Trump Derangement Syndrome.” It calls the House impeachment managers intellectually dishonest and fact free. Curiously, in what is perhaps a nod either to his vanity or to the QAnon believers who think Trump is still president, it never acknowledges him as a former president, repeatedly referring to him simply as “the 45th President.”

This document tries to rewrite what we all saw with our own eyes. It will not convince anyone who has been paying attention to what happened on January 6, but that’s clearly not its purpose. Instead, it reinforces the narrative that Trump has been persecuted by his enemies, and that he was not responsible.

Back in 2001, I wrote a long law review article exploring an abstract question: Can Congress impeach and try ex-officials for their misconduct in office? The issue of what I labeled “late impeachment” was just a hypothetical back then. It was still only a hypothetical when I wrote a book on weird presidential constitutional issues in 2012 and included a chapter on impeaching ex-presidents. Then last month … well, you know.

When it became clear that Donald Trump’s impeachment trial would not begin until after his term ended, I knew my old work would come in handy for both the House managers and Trump’s lawyers. I had concluded in my article that, on balance, the evidence solidly favored late impeachability. But late impeachment is a complicated issue, with a lot of evidence and arguments on both sides—and my article tried to present all of it (it ended up being 124 pages long).

Sure enough, the House managers cited the article numerous times in their brief. So did Trump’s lawyers in their brief. Trump’s lawyers focused their attention on the parts of my article that favored their side, and not the parts—including my overall conclusions—that favored late impeachability. Fair enough—their job is to advocate for Trump, not for me. But as I looked more closely at just how they depicted my work, it was clear that there was a problem.

In several places, they cited me as though I had concluded something when in fact I had concluded the opposite. For instance, they said:

The only purpose of impeachment is to remove the President, Vice-President, and civil officers from office. When a President is no longer in office, the objective of an impeachment ceases. (Kalt at 66.)

So what did I say on Page 66? In that section, I looked at some different ways to interpret the constitutional text. One such way, which I called “Interpretation #3,” was consistent with what Trump’s lawyers were citing me for. But after summing up Interpretation #3, I denigrated it, saying that it had “deep flaws.” More to the point, one of its flaws was that removal “is not the sole end of impeachment.” In other words, I said the exact opposite of the proposition for which they cited me.

Legal citations use something called “signals.” . . . explanation of signals . . . For Trump’s lawyers to cite me without a signal for something that did not support their proposition—let alone support it directly—was a breach of professional standards.

When lawyers quote the wrong people and cite sources for the opposite of what those sources actually say, it is never a good sign. Judges hate that. It makes their jobs harder. How senators feel about it is less clear.

Can a bank robber be convicted if he drops the bag of loot as he runs from the bank? How is it Constitutional to punish someone when he did not gain what he sought? I think the jury of 100 senators won't convict the attempted robber because 50 of the jurors are related to the defendant.

The Senate ultimately voted 56-44 that the impeachment trial is constitutional.

An adviser to Trump's team offered a candid assessment of the messy opening day, asking pointedly, "What the hell is going on?"

The adviser said the former President could be in serious jeopardy if he finds himself charged in criminal court, given his inability to attract a high-powered legal team for the impeachment trial.

"Trump is f--ked if anyone ever charges him. No one wants to work with him," the adviser said.

Trump referred to Pence 13 times in his Riot Day speech on Jan 6th:

That takes courage’ … And Mike Pence is going to have to come through for us, and if he doesn’t, that will be a sad day for our country because you’re sworn to uphold our constitution … And Mike Pence, I hope you’re going to stand up for the good of our constitution and for the good of our country. And if you’re not, I’m going to be very disappointed in you. I will tell you right now. I’m not hearing good stories … They want to re-certify. But the only way that can happen is if Mike Pence agrees to send it back. Mike Pence has to agree to send it back. So I hope Mike has the courage to do what he has to do. And I hope he doesn’t listen to the Rinos [Republicans In Name Only] and the stupid people that he’s listening to …

Arriving at the Capitol that day, taking his place in the Senate chamber at 1pm, Pence issued a statement: “It is my considered judgment that my oath to support and defend the constitution constrains me from claiming unilateral authority to determine which electoral votes should be counted and which should not.”

Trump was just finishing speaking. The spearhead of the mob had already broken through the police perimeter on the west side of the Capitol. Just after 2pm, led by the Proud Boys and other paramilitary groups, the mob poured through smashed windows and doors and rushed into the corridors, chanting: “Hang Mike Pence!”

“Once we found out Pence turned on us and that they had stolen the election, like, officially, the crowd went crazy. I mean, it became a mob,” said one rioter, later arrested, in a video posted on YouTube. But many of those assaulting the Capitol had already received Trump’s tinfoil cue to focus on Pence. The FBI charging paper for one arrested rioter, an alleged QAnon militant, quoted a text message two weeks before the attack: “I’m there for the greatest celebration of all time after Pence leads the Senate flip!! OR IM THERE IF TRUMP TELLS US TO STORM THE FUKIN CAPITAL IMA DO THAT THEN! We don’t want any trouble but they are not going to steal this election that I guarantee bro!!”

Secret service agents hustled Pence out of the chamber. “Where’s Mike Pence?” chanted the mob, racing to locate him. They carried a noose, marked with his name. Pence was in an office only about 100ft away. A quick-thinking Capitol police officer steered the rampaging throng to chase him in the opposite direction. At 2.24pm, amid the mayhem, Trump tweeted: “Mike Pence didn’t have the courage to do what should have been done to protect our country and our constitution, giving states a chance to certify a corrected set of facts, not the fraudulent or inaccurate ones which they were asked to previously certify. It's all political theater by the DNC and RNC. I doubt that "impeaching" a private citizen - which Trump is now, btw - is even legal or Constitutional, no matter what the Senate voted. The one thing that establishment members of BOTH parties need is preventing another populist victory.

The military felt it was nightly news coverage that turned people against the war, so instead of looking into their hearts to find where they had failed and fixing the problem so that any further wars COULD be fully supported by civilians, there was a whole series of actions to disable the antiwar movement so that mass antiwar protests would never happen again (including "embedding" journos with USA troops).

Oy. Dems and establishment Repubs are taking a wrong lesson from Trump. Instead of looking in their hearts to see where they had failed so many Americans, they just want to regain power and jam their agenda down everyone else's throat. Or else.

I just want to add this, in a place where you might read it, SECOND.

I've posted this before - that Trump is one smart dood, in a way that none of your ridicule of him as a pumpkin-faced clown seems to grasp. Maybe not smart in a way that could, say, design a refinery. But in his own way he's brilliant in knowing where the line is between what's criminal and what's debatable enough to be not quite over.

In the lead-up to the rally/ protest, which then turned into a riot by some people (as is usually the case, like with BLM and ANTIFA), Giuliani made statements that I thought were over the line. So did Trump Jr. And probably others did as well, those were just the two people I stumbled across whose statements had me goggling. But Trump himself never did.

And while I have no clue about Trump Jr's mental abilities, I don't think Giuliani is a dummy. So how it is that the people in Trump's orbit seem to repeatedly step right up in front of the bullseye (when Trump himself never does), I have no idea. And how it is they seem to somehow escape without any shots being fired at them for anything in relation to Trump is a further mystery.

In any case, despite the rhetoric of the people around him, PRESIDENT Trump himself will not be found with an awkward word on tape or on twitter.


He exhorted the rally to be peaceful and patriotic. Others may have called for action, but not Trump. When he called Georgia Secretary of State Brad Raffensperger, unless I missed it, he never used the word "you" as in "you need to find me votes". He always used the word "I" or "we", as in "I need to find votes". So technically, he never pressured Raffensperger to 'do' anything. On the Ukraine call he was even more removed, 'asking' 'if you could' and not pressuring for an answer immediately during the call. Then, soon after, Castor added that this is commonplace: "The people get tired of an administration they don't want. And they know how to change it. And they just did." Castor's assertion about what the people "just did" is obvious to anyone who is willing to acknowledge reality. Except Trump has tried hard to create an alternative reality and has a reason to scream at his lawyer.

Trump has declared again and again that the people actually reelected him in a "landslide" and that fraud and theft cheated him out of his rightful victory. (He repeated this nonsense even in the video he tweeted out during the Capitol insurrection.) Today, Trump better fire his lawyer who can't agree with Trump about who won.

It's like the "incitement" charge and the "quid prop quo" charge and the "Russian collusion" charge" ... all of it hogwash, not supported by anything Trump said, or did.

Back when I was an employee, the boss could give me simple orders like "Stop The Steal." Without the help from the boss, I could make all the travel arrangements, get packed and show up where the boss wanted me to be on the day he told me. Then I handled the problem in my own way without further instruction from the boss. I knew I was following the will of my boss. The client knew I was following the will of my boss ("Stop The Steal") even if I wasn't in touch with boss at anytime once I arrived at my destination.

The rioters, much like me, were given simple instructions to "Stop The Steal" by Donald Trump, their boss. They were told where and when to "Stop The Steal" by Trump. The rioters were even told who to have a meeting with: V.P. Mike Pence.

But the rioters' boss, Donald Trump, was there that day. Trump even talked to Pence about "Stop The Steal" just before Trump talked to the rioters about "Stop The Steal" since Pence wasn't cooperating with solving Trump's election problem. And guess what? The rioters did "Stop The Steal". But because Pence got away, the next day Pence stole the election away from Trump by certifying Biden as the winner. If I had been in the riot, I would have "Stop The Steal" permanently, not like those dummy rioters who only delayed it for hours. Then I'd be on the plane back to Houston with my mission accomplished.

Fox News Is Destroying America

Lots of studies have demonstrated the power of Fox News. For example, here's one from June of 2020 showing that in places where Fox News is easier to get (by having a lower position on the cable dial), more people ignored advice about staying at home and wearing masks in the early stages of COVID-19. If there's anything I've come to loathe over two decades it's bad faith arguments. They're just endless these days, and they've gotten to the point where Republicans don't even bother to hide that they are wasting everyone's time.

But this is the world we live in. It's full of bad faith arguments like this, designed solely to produce a plausible explanation for the rubes and to waste everyone else's time. And it works. The rubes and Signym obediently parrot it back.

Some senators threatened board members with arrest.

In the end, the Senate voted against holding the Maricopa officials in contempt, with one GOP lawmaker, Sen. Paul Boyer, breaking with his caucus to block the effort.

President Joe Biden's win in populous Maricopa cemented his victory in Arizona, making him the first Democrat since Bill Clinton in 1996 to carry the state.

"Some of our voters are upset with us," Maricopa County Supervisor Bill Gates, one of four Republicans on the five-member board, told CNN. "They wanted to see us come out with a different decision when we certified the votes. But to me, there was no choice to make. I mean, the votes were cast. It was a fair election."

Maricopa County officials received death threats after certifying the results, Gates said.

This is a bizarre and particularly infuriating subset of the due process claim. Sens. Susan Collins (R-Maine) and Lisa Murkowski (R-Alaska) asked a simple question, “Exactly when did President Trump learn of the breach of the Capitol, and what specific actions did he take to bring the rioting to an end, and when did he take them?” The response? Chutzpah, thy name is van der Veen. “The House managers have given us absolutely no evidence, one way or the other, on that question,” he blustered. “With the rush to bring this impeachment, there has been absolutely no investigation into that. And that is the problem with this entire proceeding. The House managers did zero investigation, and the American people deserve a lot better than coming in here with no evidence, hearsay on top of hearsay on top of reports that are hearsay. Due process is required here, and that was denied.”

Are you kidding me? His client refused the managers’ request to testify. And Trump is van der Veen’s client. Ask him, maybe?

When van der Veen offered information about Trump’s knowledge that day, in response to another question, from Collins and Sen. Mitt Romney (R-Utah), it was false. “At no point was the president informed the vice president was in any danger,” he asserted. “Because the House rushed through this impeachment in seven days with no evidence, there is nothing at all in the record on this point because the House failed to do even a minimum amount of due diligence.” But as Sen. Bill Cassidy (R-La.) pointed out in another question, Sen. Tommy Tuberville (R-Ala.) has stated that he spoke with Trump at 2:15 p.m. on Jan. 6 and told the president that Vice President Mike Pence had just been evacuated from the Senate chamber. “I dispute the facts that are laid out in that question," van der Veen said, "and, unfortunately, we are not going to know the answer to the facts in this proceeding because the House did nothing to investigate what was going on.”

Then a riot broke out inside the Capitol Building where Congress would announce that Trump lost. Funny about Trump not admitting he lost and not stopping the riot with, for example, a shoot to kill order. Only one cop did what Trump should have ordered and killed a rioter. The other cops let themselves be pushed around and stomped on because the President didn't give the order.
