Unflattering videos of Rittenhouse

Prosecutors wanted to present two videos taken of Rittenhouse in the weeks leading up to the shooting, arguing that they provided "crucial insight" into the teenager's state of mind in summer 2020. Kenosha County Circuit Judge Bruce Schroeder disagreed in both instances.

In their motion on Wednesday, Prosecutors wrote that the new video, taken just 15 days before the Kenosha shootings, showed Rittenhouse "saw something, jumped to a conclusion based on exactly zero facts, and then threatened to kill someone based on his baseless assumption and wrongful interpretation."

Prosecutors added that Rittenhouse didn't know the people outside the CVS or what they were doing, was merely watching from a vehicle parked across the street, and was not interacting with anyone involved.

"The video proves that the defendant was ready and willing to use deadly force in a situation where it was completely unjustified," the motion said.

"The video also demonstrates that the defendant fervently sought to insert himself as an armed vigilante into situations that had nothing to do with him," prosecutors added.

So, if I sight on you then aim at something else, obviously if you shoot me 5 days later, it's not self defense because I'm not am imminent threat. How about 5 minutes? Or 5 seconds? At what point is it reasonably thought of as self defense instead of murder?

Also, what seems to be missing from a lot of these stories is the complete set of facts. Everyone seems to be picking and choosing the parts they want to include in their narrative, while leaving the rest of the facts out.

The Supreme Court Is About to Open the Door to a Lot More Kyle Rittenhouse Situations When Everything Is “Self-Defense” and everyone gets a gun.

All of this is terrific news if one thinks every public gathering, indeed every public space, is enhanced by the presence of more guns. As the majority of the Supreme Court seems to have confirmed in this month’s oral arguments for New York State Rifle & Pistol Association v. Bruen, such a world is A-OK by them.

Justice Samuel Alito, for example, demonstrated his boundless concern for, as he put it, “law-abiding citizens” in New York City who are forced to “commute home by subway, maybe by bus,” and are unable to carry guns to protect themselves in a shootout, which would presumably occur on a crowded train or platform.

Yes, this is the world the current court seems likely to create, and it will leave the details of who intended to kill and who was just defending himself and who merely killed someone out of fear his gun would be wrested from him to any number of future juries.

Each of the three trials dominating the news this month features armed citizens taking up weapons to travel to public spaces where they believed themselves to be under threat.

In the trial of the three killers of Ahmaud Arbery in Georgia and the Rittenhouse trial in Wisconsin, the defendants claim that they were justified in their use of violence when they killed unarmed people in self-defense.

In both prosecutions “the defendants claim they were entitled to start shooting because the victims were trying to take their guns.”

White supremacists currently facing a civil trial in Charlottesville, Virginia, for harming others at a Nazi-style rally in 2017 are offering similar defenses, claiming that they too armed themselves and attacked peaceful counterprotesters out of a fear for their own safety.

Kimberly Kessler Ferzan, a professor of law and philosophy at the University of Pennsylvania, arguing in the Texas Law Review that “the problem is that with a citizenry armed with guns, we have blurred every line.”

Indeed, once everyone in public spaces is armed and operating under a sprawling regime of “stand your ground” and citizen’s arrest statutes plus a mushrooming mistrust of law enforcement, how will courts ever sort out who instigated and who responded? As Ferzan put it in her law review article: “What is defense? What is reasonable? When may one stand one’s ground and when must one retreat? And, when is a citizen entitled to step in as an aggressor in the name of the state?”

If you can arm yourself because you have declared yourself a substitute for law enforcement and then you claim people were grabbing for your weapon so you killed them with it, when are you every not justified in killing?

I have seen people who are slow and unsure about making big decisions in their own lives go to a gun store and purchase a weapon. Republican Mark McCloskey, a candidate for the U.S. Senate in Missouri, was photographed Tuesday outside the Wisconsin courthouse where Kyle Rittenhouse was on trial for murder. McCloskey on Tuesday was photographed standing next to two men flashing an “OK” sign, which is associated with white supremacists. Rittenhouse was also photographed in January with two men as they made the “OK” sign with their hands. The judge in September ruled against allowing that to be discussed during Rittenhouse's trial.

McCloskey and his wife, Patricia, were both in Kenosha, Wisconsin, on Monday and Tuesday to show support for Rittenhouse. The McCloskeys gained national attention after they waved guns at racial injustice protesters who were marching in their gated St. Louis subdivision last summer.

Mark McCloskey compared himself to Rittenhouse in a statement Tuesday, saying they have both been prosecuted and were defending themselves from an “angry mob.” McCloskey said he hopes the jury finds Rittenhouse not guilty.

The McCloskeys pleaded guilty in June to misdemeanor charges after waving guns at protesters and were ordered to pay fines, but Mark McCloskey left the courthouse defiantly pledging to “do it again” if faced with the same circumstances. Both McCloskeys were pardoned by Republican Missouri Gov. Mike Parson.

The defense motion states the facts with sufficient clarity that I'm going to reprint them here verbatim:

On November 5. 2021, the fifth day of trial on this case, the prosecution turned over to the defense footage of a drone video which captured some of the incident from August 25, 2020. The problem is, the prosecution gave the defense a compressed version of the video. What that means is the video provided to the defense was not as clear as the video kept by the state. The file size of the defense video is 3.6 MB and the state's is 11.2 MB. Further, the dimensions on our video are 480 x 212, the state's, 1920 x 844. The video which was in the state's possession, wasn't provided to the defense until after the trial concluded. During the jury instructions conference, the defense played their version of the video for the court to review. The state indicated their version was much clearer and had their tech person come into court to have the court review their clearer video. The video is the same; the resolution of that video, however, was not. The state did not provide their quality video to the defense until Saturday, November 13, 2021, and only did so upon specific request by Attorney Wisco — two days before closing arguments and after the evidence had been closed.

Under Wisconsin law, when the defense makes a demand, the prosecution must provide to the defense "[a]ny physical evidence that the district attorney intends to offer in evidence at the trial" and "[a]ny exculpatory evidence." That's Wisconsin Stat. § 971.23(1)(g) & (h). I don't have the time to research the law, but my bet is that if Wisconsin's appellate court ever had before it the question of whether the prosecutor may get away with producing bastardized, degraded versions of the requested evidence, it would say emphatically not.

The motion for a mistrial with prejudice also raises the fact that, when Kyle Rittenhouse took the witness stand, the prosecutors improperly accused him of keeping silent after his arrest. That right, of course, is enshrined in the famous Miranda rights warning that all arrestees in America receive: "You have the right to remain silent ..." The corollary to that right is that this silence cannot be used against the defendant in a court of law, but that's exactly what the prosecution tried to do.

That is where the judge went livid.

I'm going to add that, according to the video of the trial, prosecution's excuse for even bringing that up is that Rittenhouse only made a statement after having seen all most of the evidence both for and against him. However, one could say the same of the witnesses on that stand, whose testimony was certainly fortified by review of video evidence.

And why would prosecutors go against the judge's EXPLICIT instructions not to bring up Rittenhouse's "right to remain silent" (as well as contravene the Constitution)?

There's a lot about this case that's puzzling.

BTW the judge has a standing order that he imposes on ALL cases heard in his court - that NOBODY gets called a 'victim' - at least before a guilty verdict is reached. He believes that calling someone a victim is prejudicial against the defense. So that wasn't a rule he imposed only for this case.

The prosecution impugning the defendant's silence was maybe 'theater'. Because, despite any instructions to the jury to ignore select statements, nobody can unhear them. Both sides do that, in order to plant ideas in the jurors, even if they get a ruling against them and a motion to strike. What the prosecution may not have expected is the judge's vehemence. Perhaps the judge had just heard that tactic too many times, and was having none of it from the prosecution, like calling people victims (though if there were similar statements made by the defense that didn't get that reaction, is unknown).

I've sat on 3 juries of increasing severity: grand theft and possessing a stolen vehicle; attempted murder; and murder. (The verdicts were guilty; not guilty; and guilty, in that order.)

BOTH prosecution AND defense often play a lot of games. For example, in the attempted murder trial, the defendant, who was a huge dood, was accused of trying to murder another guy by hitting him repeatedly with a baseball bat, such that the beaten guy spent a long time in the hospital recovering and was left with some disability. (The defendant had previously stolen the beaten guy's gun from a gym bag in a closet at a party they both mutually attended, which is why they got into a scuffle in the first place. The verdict in the stolen gun trial was guilty, which we found out afterwards.)

We reached our not-guilty verdict for a couple of reasons. First, we did recognize that there were provoking reasons for the beaten up guy to get in a scuffle with the defendant. Because in all likelihood, the defendant had stolen the gun and was taunting the beaten-up guy over it.

But 1) the beaten-up guy threw the first punch, and 2) as soon as the beaten-up guy stopped swinging at the defendant, the defendant stopped hitting him with a baseball bat. So even though it was a case of fists versus bat, it seemed to lean more toward self-defense and less toward attempted murder.

But AFTER we reached our verdict, the lawyers let down their hair and talked with us. And one of them (I forget which) basically said - you might think they'd bring in the beaten-up guy because with his permanent injuries he'd be a sympathetic character. But the reason why they didn't bring in the beaten-up guy was because while the defendant is tall and hefty he's a lard-ass, and the beaten up guy was even bigger and really buff. And they also did inform us that the lard-ass guy really did take the gun.

In general, lawyers will instruct witnesses to ONLY directly answer the question.

I can see how the tactic works for the defense. Your own lawyer is probably only going to ask you questions that elicit vanilla answers. And the prosecution is going to only ask you questions that can trip you up. If

Rittenhouse judge unloads wild rant about Black jurors after jury asks unrelated question

Judge Bruce Schroeder defended his actions and attacked the media at a hearing on Wednesday after the jury asked an unrelated question about the Kyle Rittenhouse trial.

Schroeder went off-topic at the hearing to address criticisms he has received in the media.

The judge defended his decision to not allow the people who were shot to be called "victims" because he said it was unfair to Rittenhouse.

"How would you like to be put on trial for a crime and the judge introduced the case to the jury by introducing you as the defendant and the person who's accusing you as the victim?" he asked. "Is it so difficult to use the term 'complaining witness' instead of prejudging what the jury is here to determine?"

He also explained why he allowed the defendant to control the lottery determining which jurors would decide the case.

"I am now reading about how bizarre and unusual it was to have the defendant pick the [juror] numbers out of the tumbler yesterday," Schroeder said. "I would admit that I don't know there's a large number of courts that do that. Maybe not any."

"I do it because of an incident that I had in a case I tried in Racine," he recalled. "I think it was a murder case but I'm not sure. And there was a Black defendant and there were 13 jurors. One of them was Black. And when the clerk -- the clerk, the government official drew the name out of the tumbler, it was a Black, the Black, the only Black."

Since that time, the judge said that he allows the defendants to select alternate jurors so they "feel better."

"We talk about optics nowadays," he said. "That was a bad optic, I thought. I think people feel better when they have control."

Before finishing his rant about the media, Schroeder threatened to remove future trials from live television.

"When I talked about problems with the media when this trial started, we were there in part," he complained, "because of grossly irresponsible handling of what comes out of this trial."

"I'm going to think long and hard again about live television for a trial next time," the judge added. "What's being done is really quite frightening" for a doddering old fool judge.

KIKI- IMHO it's not a simple case of "who started it". And not a simple case of "equivalent" force either.

To me it's more of a case of "credible threat" .. would an average person's self defense be triggered by a credible threat.

Some weaponless nobody yelling at you from 25 ft away would make me feel uneasy, but not enough to shoot. But 20 weaponless people chasing me would definitely make me want a gun. This reminds me of the Bernhard Goetz shooting: four young punks were threatening him. True, they only had screwdrivers, but there were four of them So he shot them. There was some talk of murder charge but in the end he was convicted of illegal possession of a firearm.

If Rittenhouse was waving his weapon (the subject of the grainy video, apparently) what were the circumstances?

I don't know. I haven't been following this, too busy to track down all of the video evidence, which is where I think the heart of the truth is.

Analysis: Here's why Kyle Rittenhouse is likely to be acquitted — and why the law on self-defense must change

Gross is director of the Public Defender Project at the Wisconsin Law School at UW–Madison.

In the Rittenhouse case, I expect that the jury will not be convinced of his guilt beyond a reasonable doubt in large part because of the way the law defines self-defense.

The issue to be decided in a criminal trial is extremely specific: Did the prosecution prove every element of the offense or offenses charged beyond a reasonable doubt. The jury is only permitted to render one of two verdicts: guilty or not guilty. By finding a defendant not guilty a jury is not saying that the defendant is innocent. Innocent isn’t an option. The jury is not deciding whether someone is morally blameworthy, they are deciding whether a legal standard has been met.

In the current state of the law, Rittenhouse is not barred from claiming the privilege of self-defense because he illegally possessed a firearm. He is also not barred from claiming the privilege of self-defense because he was violating a curfew order. While many people feel that carrying an AR-15 assault rifle in public is dangerous and invites confrontation, Wisconsin is one of many “open carry” states where parading down a public street with a military-style assault rifle is permitted.

If the jury acquits Rittenhouse, then they will be doing what the law requires them to do. That should prompt us to ask why the law dictates this result, and how the law might be changed to discourage people from resorting to deadly force -- and if they do, to hold them more accountable.

We could deny the right to act in self-defense to people who illegally possess a weapon and are in a place where they are not allowed to be. We could also restore the requirement that before someone has the right to use deadly force, they have a duty to retreat. Recently, state legislatures have been doing the opposite, eliminating the duty to retreat by passing “stand your ground” laws.

We could make self-defense an affirmative defense that must be proven by the defense by clear and convincing evidence, not disproven beyond a reasonable doubt by the prosecution. One of the challenges facing prosecutors in the Rittenhouse case is that once the issue of self-defense is raised, the law requires them to prove beyond a reasonable doubt that the defendant did not act in self-defense. It is fair and reasonable to require that the person who felt privileged to use self-defense bear the burden of persuading the jury that they acted in self-defense.

We could make self-defense a complete defense to a charge of homicide only when the threat to the person’s safety is obvious and immanent. The law now permits a person to use deadly force if they reasonably believed it was necessary even if that belief was mistaken. The law also does not require that a person wait until the last second to use deadly force. Police officers who shoot unarmed people of color often rely on this argument to justify their use of deadly force. They never see the barrel of a gun but claim that under all the surrounding circumstances they reasonably believed that someone was armed.

We could prohibit testimony that the defendant feared that the weapon they were carrying could be used against them. This is also a claim that police officers make when they have a physical altercation with someone who is unarmed. It was one of the claims that Kenosha Police Officer Rusten Sheskey made to investigators when attempting to justify his shooting of Jacob Blake. It would also address the fear that is instilled in people when others decide to openly carry assault weapons.

If the jury acquits Rittenhouse, it will not be a mistake. They will have properly applied the law to the facts of the case. If you think a verdict of “not guilty” was the wrong result, your quarrel is not with the jurors who decide the case but with the law as it is written. That law is not set in stone. It is dictate

Put differently: Once Rittenhouse fired his first shots, he and his attackers plausibly entered a context in which neither could be held legally liable for killing the other. Whether one emerged from this confrontation legally innocent or lawfully executed hinged on little more than one’s relative capacity for rapidly deploying lethal violence. Rittenhouse had a more powerful weapon and a quicker trigger finger than Huber or Grosskreutz. Thus, he may well walk free, in full health, while Huber lies in a grave and Grosskreutz gets by without the bulk of his right bicep.

This outbreak of “Wild West” rule isn’t as anomalous as one might hope. America’s culture of vigilantism, high rate of gun ownership, and increasingly permissive self-defense laws have conspired to turn “kill or be killed” scenarios into a regular occurrence.

The culture that turned the 17-year-old into a revered killer — a culture of mass firearm ownership and vigilantism — is antithetical to law and order as it is conventionally understood. It is a culture premised on the illegitimacy of the state’s monopoly on violence and the incapacity of formal institutions to uphold social order or public safety. It sees America as a society forever teetering on the brink of Hobbesian breakdown (“war of every man against every man,” a constant and violent condition of competition in which each individual has a natural right to everything, regardless of the interests of others) and firearms as the sole guarantor of individual security. And the more influential this culture becomes, the more its paranoid delusions come to resemble our collective reality.

“Legally kill or legally be killed” scenarios are just one of several pathological consequences of America’s lax gun regulations, and permissive police use of force and/or self-defense laws.

Somebody fired into the air. That set off the melee. But Rittenhouse was responding to ACTUAL THREAT, the others were operating on apparently mistaken assumptions. That makes Rittenhouse's the more accurate response, and therefore lawful. If the others could point to anACTUAL THREAT, they, too would be lawful.

I am very pleased with the jury's decision, but I expected it in less than a hour. The jury went off on an unnecessary tangent about reviewing the video. Such a waste of time. The primary thing that counts in the law of self-defense as it was written was whether the defendant "feels" threatened. The law doesn't use that exact formulation, but that is what it boils down to in an American courtroom.

The law requires the prosecution to prove the defendant did NOT "feel" threatened. Hard to prove that. If the defendant says he "feels" threatened, the defendant goes free. Sometimes the defendant does not take the oath because they can't convincingly fake for the jury the "feeling" of being threatened, so defense witnesses and experts testify to what the defendant was "feeling". Prosecution can't break down that barrier unless the murderer is instinctively hated by a jury or the prosecution had at least three telepathic psychics at the scene of the murder testify about what the murderer was actually feeling before, during, and after the murder.

In a Civil trial for damages, the murderer's "feelings" count for nothing. If Kyle Rittenhouse is sued for wrongful death, he might lose. That's what happened to O.J. Simpson, who was declared not guilty of murder, but was successfully sued for $33.5 million in damages. O.J. didn't pay much because he moved to another state and declared bankruptcy, but that is just how the legal system habitually malfunctions in America. Rittenhouse has a much weaker Civil case than O.J. because everybody saw Rittenhouse murder his victims but nobody saw O.J. pull the trigger. On the other hand, Rittenhouse has zero assets to be seized, other than the AR-15. Win or lose, Rittenhouse won't pay much. There were some details that I had forgotten, or learned.

Anyway, the most egregious 'self-defense' defense I can think of was when the hefty, gun-toting George Zimmerman got to stalk and threaten an unarmed black youth, then shoot him in 'self defense'.

And in the current Ahmaud Arbery trial, we're to believe that 3 armed white men felt so threatened by a single unarmed black man they had stalked and threatened, that they had a reason to shoot him in 'self-defense'.

Something is very wrong with the self-defense laws when one can get defenses like that.


In the Rittenhouse case, the judge was so befuddled by the law, he could offer no instructions, so the jury was on its own.


I have no issue with whatever decisions the juries render. But there clearly is something wrong with particular self-defense laws as written. It seems it should be possible to write laws with clarity (unlike the Rittenhouse case), that clearly distinguish between aggressor and defender (unlike the Zimmerman case, and possibly the Arbery case).

So, despite what repeated instances of police violence against protestors might suggest, the police cannot punish protestors for protesting police killings. But what if police stand by while private so-called militias attack and intimidate protestors, forcing them to flee and causing others to stay home? That happened time and again during last year’s Black Lives Matter protests, without repercussion for the police. The result is a system in which vigilantes armed with assault rifles and uniformed in combat gear can trample protestors’ rights with government endorsement.

The culprit is the First Amendment, which protects only against governmental abridgements of rights. The so-called “state action” requirement means that, for better or worse, the First Amendment does not prohibit private abridgments of speech or assembly rights.

Militias have gathered under the “thin blue line” flag (signifying solidarity with police), enjoyed friendly treatment from officers (including tips and encouragement), and assaulted counter-protesters while police watched (and did nothing). All this has blurred the lines between police and militia. Sometimes there are no lines. Recently hacked membership lists and emails from the Oath Keepers, a prominent far-right anti-government militia that played an extensive role in the Jan. 6 insurrection, showed that many active-duty officers in New York City, Los Angeles, Chicago, Pennsylvania, and New Jersey are part of the organization.

Florida, Iowa, and Oklahoma granted immunity to drivers who run over protestors in certain circumstances, worrying advocates that extremists might mow down protestors and political enemies.

Vigilante targeting of protestors exploded. Rallies and protests have been repeatedly cancelled under looming threats of violence. By one count, militias and similar far-right actors showed up at approximately 500 protests last year, where they were responsible for 64 assaults, 38 cars driven into demonstrators, nine firings of guns at protesters, and 387 other instances of intimidation. There is reason to worry things will only get worse in the wake of Friday’s verdict.

Come to think of it, a human with an AR-15 would have been able to wound an assailant, but a robot like Rittenhouse can't use a little finesse when solving a problem and goes with straight forward murder. I already knew that Texas Trumptards cannot improvise under even the slightest pressure (they inevitably get completely discombobulated) so there was no reason to think Rittenhouse could show restraint when he aims an AR-15.

You see another thread about Rittenhouse anywhere? I just went through 20 pages and I can't find it.

I got into an argument with Second or his split personality Reaverfan on one of them when I posted that Rosenbaum was a pedophile, and I had to use an archive site capture of the info on that because the Legacy Media had scrubbed it, and they were telling me that I was full of shit.

It seems that nobody is arguing today that Rosenbaum dated single women so he could diddle their kids, and I wanted to rub that in it's disgusting face.
