Former national security adviser Michael Flynn’s claims of prosecutorial misconduct are “unfounded,” the Justice Department argued Wednesday in a court filing that nevertheless persists in the government’s unusual attempt to abandon the criminal case he pleaded guilty to 2½ years ago.
“Flynn’s allegations are unfounded and provide no basis for impugning the prosecutors from the D.C. United States Attorney’s Office,” Justice Department attorneys said in the filing, suggesting that the government has other reasons for seeking to back away from its case against Flynn.
The denial of wrongdoing by DOJ prosecutors, contained in a lengthy footnote buried in the 49-page filing, came despite Flynn’s lawyers’ repeated attacks on prosecutor Brandon Van Grack, some of which they reiterated Wednesday in their own submission to the U.S. District Court in Washington. Flynn is fighting efforts by the judge in his case, Emmet Sullivan, to probe Attorney General William Barr’s abrupt decision to drop the case.
Van Grack, who served on special counsel Robert Mueller’s staff and acted as lead prosecutor on Flynn’s case, later assumed a senior position at Justice Department headquarters and continued heading up the prosecution of Flynn in the year since Mueller’s operation shut down.
Last month, Van Grack signaled his disagreement with Barr’s decision to drop the Flynn case by declining to sign the government’s motion and formally withdrawing from the case.

Berman also brought charges against a Turkish state-owned bank in a case in which Turkey’s autocratic president has personally sought Trump’s help.
Barr clearly thought that Berman was causing too much trouble for Trump — so he decided to fire Berman and install Securities and Exchange Commission Chair Jay Clayton, a Trump golfing buddy with no experience as a prosecutor, into the position. Barr tried to push Berman out late Friday night, no doubt thinking that a nation distracted by a pandemic and protests would barely notice.
But Berman refused to go quietly. He quickly saw Barr’s move for exactly what it was: a raw attempt to shut down ongoing Trump-related investigations.

I read a random headline a week or so ago that said that Barr said that investigations will be completed by the end of summer. No analyst or commentator that I know picked up on it, and I didn't read the article, but I DO hope that he means investigations into the FIB. Because the FIB CLEARLY conspired to "get Flynn" in addition to conspiring to "get Trump", and initiated baseless investigtions and engaged in malicious prosecution.
Politicization in the FIB, CIA, DOHS should not be tolerated.

Flynn pleaded guilty in December 2017 to lying to the FBI about his conversations with former Russian Ambassador to the US, Sergey Kislyak, during the presidential transition following the 2016 US election. He later withdrew his plea after securing new legal counsel, while evidence emerged which revealed the FBI had laid a 'perjury trap' - despite the fact that the agents who interviewed him in January, 2017 said they thought he was telling the truth. Agents persisted hunting Flynn despite the FBI's recommendation to close the case.
Once the FBI's malfeasance was uncovered, the Justice Department moved to dismiss the case after Attorney General William Barr tapped an outside prosecutor to examine the FBI's conduct. Judge Sullivan rejected the DOJ's request - instead calling on an outside lawyer to make arguments against the DOJ's move to drop the case.
Shortly before the DOJ move to dismiss, former Mueller prosecutor Brandon Van Grack suddenly withdrew from the case (and others). Flynn's new attorney, Sidney Powell, said that government documents revealed "further evidence of misconduct by Mr. Van Grack specifically."
Sullivan urged the federal appeals court to also reject Flynn's bid to bring an end to the case, which has now ruled against the judge.
So, will someone have the stones to take this to the full Appeals Court (not a three-judge panel) or even the Supreme Court?

He did not opine as to what the final outcome of that ruling might be.
Judges are like umpires: they don't decide who should win or lose a case, and they definitely don't bring in a new pitcher or hitter if they don't like the way the game is going ... which is exactly what Emmett Sullivan did.
The majority of judges appeared to be responding to Sullivan's gross overstepping of his authority, and the appeals panel's objecting judge appears to concerned about timing.
I'm not sure what the resolution would be, because if Sullivan decided to drag the case out and delay his ruling indefinitely, then what? Maybe the appeals panel should have directed Sullivan to issue a ruling by date certain; then they could have ensured that all of the lower court steps were completed before issuing their own ruling? The Flynn's lawyer would have appealed the ruling (if unfavorable) and THEN the appeals panel would have issued theirs? That seems to be the remedy that Wilkins would opt for: adding two more steps to the process.

Donald Trump’s most brazenly partisan judicial appointee has come through for the president once again.
On Wednesday, in a 2–1 decision, Judge Neomi Rao forced a district court to dismiss the prosecution of Michael Flynn. Rao’s opinion is an exercise in outcome-driven sophistry that barely pretends to be a judicial opinion. While gutting a vital check of executive misconduct, Rao whitewashed the Justice Department’s flagrantly political decision to drop charges against Flynn — hours before the House Judiciary Committee heard whistleblowers testify about political interference at the DOJ, including in Flynn’s case.
There is ample evidence that Barr and Shea got Flynn off the hook at Trump’s behest. This political meddling in a federal prosecution is wildly unethical and extremely disturbing. Luckily, there is a federal rule, 48(a), designed to prevent well-connected defendants from pulling strings in Washington to get their case dismissed.
Because he entered a guilty plea, Flynn has already been convicted. Judge Sullivan’s only remaining task is to hand out a sentence, which had been delayed at the request of special prosecutor Robert Mueller III so that the sentence could be adjusted either up or down based on how cooperative Flynn was with Mueller's investigation.
Judge Rao made three arguments to justify not sentencing Flynn, and none of them can be taken seriously.

She routinely acts like Trump’s personal protector rather than an impartial judge, fabricating avant-garde legal theories out of whole cloth that happen to favor the executive every time. Circuit, sitting en banc, can and should reverse her opinion, which presents a shockingly expansive theory of executive power that overrides the federal judiciary’s ability to identify and stamp out prosecutorial corruption. Under Rao’s rule, federal judges must look the other way when politicians interfere in prosecutions to help their friends—a gross perversion of justice that plainly occurred here. Instead, federal judges must adopt a “see no evil” approach, rubber-stamping prosecutors’ rationalizations even when they reek of corruption. She is perfect for what Trump needed on the Court of Appeals. Letting Flynn out of his plea deal could create a mound of secondary legal consequences that may jeopardize other cases and investigations into Russian interference in the 2016 elections that are deeply intertwined with the evidence Mueller’s team received from Flynn’s cooperation. Mr Trump has questioned the legitimacy of the election process in a series of tweets, the latest of which (in 2016) said on Monday: "Of course there is large scale voter fraud happening on and before election day. Why do Republican leaders deny what is going on? So naive!"
I have wondered why ANYONE would deny that vote fraud exists. So did many other Democrats when GWB "won" (was selected by the Supreme Court) in the first election, and when he "won" the second. The first one, as you recall, was the "hanging chad" fiasco in FL. There was all kinds of hinky stuff going on in FL, with Katherine Harris (Scy State) manipulating the voter roles before the election in favor of GWB, mail-in ballots counted irregularly, and vote audit tapes being illegally disposed in addition to the "hanging chad" controversy.
So about a year after the election, a consortium of six newspapers paid to have the votes of the entire state of FL re-counted, and what they found was that it didn't matter whether they re-counted the punch cards with one, two, or three corners punched, or whether they counted dimples or not. The thing that swung the vote was a county that used touch screen voting.

He was claiming that he won the popular vote in 2016, not just the electoral vote, because illegal aliens (whose votes should not have counted) voted for Hillary. But Trump's electoral fraud commission couldn't find the millions of fraudulent votes. What little they found is in the wiki, but it wasn't enough to give Trump a popular vote victory.

A slick video posted on Twitter by the head of the Republican Party takes snippets of news and events from around the country to spin a conspiracy theory about the 2020 elections.
Democrats have fought in court and pushed state legislatures for years to increase avenues for voting. State election officials from both parties are expanding vote-by-mail this year to mitigate the risk of spreading the novel coronavirus. President Trump has fumed at these moves and for weeks has been spreading false information about vote-by-mail laws and safeguards, often tweeting baseless warnings about a phantom plot to steal the election.
The RNC video made for an interesting fact check. Like Trump, it warns that widespread voting by mail is a recipe for election fraud. In a curious twist, these dire warnings are all delivered with a comedic tone, the finished product resembling a late-night TV skit.
Although the video is satirical, an RNC official said the claims are all grounded in fact. So here we go.
The Facts
States and local governments are in charge of running U.S. elections. Each jurisdiction has its own set of rules, but all states offer accommodations for voters who cannot make it to the polls. “In two-thirds of the states, any qualified voter may vote absentee without offering an excuse, and in one-third of the states, an excuse is required,” according to the National Conference of State Legislatures.
Documented instances of voter fraud are exceedingly rare in the United States, the odds being lower than those of being struck by lightning, according to the Brennan Center for Justice. More than 250 million votes have been cast via mail ballots since 2000, according to the Vote at Home Institute. In 2018, more than 31 million Americans voted by mail, representing one-quarter of election participants. Five states — Colorado, Hawaii, Oregon, Utah and Washington — use mail ballots as the primary method of voting.

The interview with Flynn begins with a lot of talk about “waking up” to reality, followed by Clark claiming that PCR Covid tests are rigged, and that once you’re into the hospital doctors give you drugs developed by George Soros to kill you (one of the drugs he cites, Remdesevir, was administered to President Trump), all the while withholding “100-percent effective” treatments like hydroxychloroquine and Ivermectin, also known as the horse paste that has caused a flood of calls to poison control from victims of Clark-type con men.
“Does it shock you that the CDC protocols, General Flynn, are actually causing people with a soul who love America, doctors, to be accidentally euthanizing Americans at scale?” Clark asks eventually. “Does that shock you?”

Michael Flynn Thinks They Might Be Putting the Covid Vaccine in Your Salad Dressing
The interview with Flynn begins with a lot of talk about “waking up” to reality, followed by Clark claiming that PCR Covid tests are rigged, and that once you’re into the hospital doctors give you drugs developed by George Soros to kill you (one of the drugs he cites, Remdesevir, was administered to President Trump), all the while withholding “100-percent effective” treatments like hydroxychloroquine and Ivermectin, also known as the horse paste that has caused a flood of calls to poison control from victims of Clark-type con men.
“Does it shock you that the CDC protocols, General Flynn, are actually causing people with a soul who love America, doctors, to be accidentally euthanizing Americans at scale?” Clark asks eventually. “Does that shock you?”
“It doesn’t shock me,” Flynn replies, adding that even though the doctors may be accidentally euthanizing Americans with the Soros drugs, they’re also to blame because it’s incumbent upon them to understand what they’re giving people. “You can’t say you’re just following orders,” Flynn says. “It sounds like the Nazis.”
The discussion continues like this, conspiracy theory on top of conspiracy theory, one playing off of the other. It’s hard to overstate how far afield of reality, or even mainstream conspiracy-theory culture, the discussion ventures. At one point, Flynn suggests that the government could be secretly administering the vaccine through salad dressing, as Ron Filipkowski first pointed out on Twitter.

Flynn wraps up his tweet with another lie: "Commit yourselves to freedom before we lose every bit of ours to a tyrannical and overreaching government." Flynn says any old lie that pleases himself.
