I'm not an economist. But I was wrong about the litigation to bar Donald Trump from the ballot as an insurrectionist. I wrote in August that the project was a "fantasy." Now, by a 4-3 vote, the Colorado Supreme Court has converted fantasy into at least temporary reality.
The Fourteenth Amendment provides that anyone who swore an oath to support the Constitution of the United States, and who then "engaged in insurrection or rebellion against the same," is forbidden to hold any federal or state office unless pardoned by a vote of two-thirds of both houses of Congress.
I doubted that any contemporary court would apply this Civil War legacy to the politics of the 2020s. Colorado's supreme court just did. Trump swore an oath to the United States when he entered the presidency in 2017. According to Colorado's court, his actions leading up to the violent coup attempt of January 6, 2021, amounted to "engaging in" an insurrection. Therefore, the court ruled earlier today, Trump is disqualified from appearing on the Republican primary ballot in Colorado.
The Colorado decision is not the final word. The Colorado Supreme Court is the ultimate word only on Colorado law. In this case, however, the Colorado court is interpreting a federal constitutional amendment. Its decision can and will be appealed to the U.S. Supreme Court.
But the possibility of one more judicial appeal does not diminish the drama of what just happened—or the political potential.
The big winner from tonight's decision is not President Joe Biden. The Colorado Supreme Court decision is not about the general election in November 2024. It's about Colorado's Republican primary. If the decision stands, the principal beneficiaries will be Trump's Republican rivals, one of whom—Florida Governor Ron DeSantis, former New Jersey Governor Chris Christie, former South Carolina Governor Nikki Haley, or the entrepreneur Vivek Ramaswamy—will win Colorado's delegates to the national Republican convention. If the decision is extended to other states, one of that roster will win those delegates too.
The U.S. Supreme Court now has the opportunity to offer Republicans an exit from their Trump predicament, in time to let some non-insurrectionist candidate win the Republican nomination and contest the presidency.
The Colorado court has invited the U.S. political system away from authoritarian disaster back to normal politics—back to a race where the Biden-Harris ticket faces more or less normal opponents, rather than an ex-president who openly yearns to be a dictator.
I personally didn't expect such a possibility to open, and I worried about the risks that accompany this possibility. Will pro-Trump voters accept the legitimacy of court actions against their candidate? But the timing of this case mitigates the risk.
The Colorado Supreme Court harshly condemned Trump personally. It ruled him an insurrectionist, in effect a traitor. It joined his name to the roster of the Confederate rebels whom the authors of the Fourteenth Amendment wanted to ban from politics. And at the same time, that court offered emancipation from Trump to Trump's party.

After he lost in 2020, Trump refused to concede, plotted a coup, incited an insurrection, stole national security documents, was found liable of sexual abuse & business fraud, had his mugshot taken in one of the 4 jurisdictions where he is currently under indictment and today, under the 14th Amendment, he was disqualified from running for president in the state of Colorado.

I have to laugh at those who still say the 2020 election was stolen. To those who say all the courts, 64 of them, who denied Trump a victory are in on the election steal.
To those same people who believe Trumps own justice department colluded with others to deny Trump a victory, still believe that Trump can win, how? If any of this bullshit was true, they should realize those who kept him from winning in 2020 will just do it again.

This stunt was absolutely meaningless. Trump was NEVER going to win Colorado, and he was NEVER going to win any deep blue shithole state that follows suit.
I hope the Supreme Court just stays out of it and we can all watch Trump win the election with 10 deep blue shithole states kicking him off the ballot.
Maybe then they'll finally do Americans a favor and make good on their promises and secede from the Union when that happens.

For years, some of the most vocal critics of the Supreme Court’s ethical lapses, its lack of transparency, and its refusals to take seriously its own brokenness and errors, have warned that the day would come when an election would be decided by a body that has refused to clean house and has blamed the press and the academy for the stench of its own illegitimacy. The worry wasn’t that the court would decide the election; that seems almost inevitable. The worry was that the public, grown weary of the stench, would not abide by their decision.
Lavish world cruises, secret deals with moneyed donors, threats to step down unless someone ponied up with a pay raise, fishing trips with parties who have business before the court, an amicus brief industrial complex wholly bought and paid for by billionaire donations, leaked drafts, and secret speeches are not the stuff of constitutional democracy, or infallibility, or finality. When the hyperpolitical supercharged Trump cases catch up with the court—and that is beginning to happen, right now, this week—all that stench will run headlong into the questions about why the husband of the woman who went to the pep rally for the insurrection and the folks who lied to us all about Dobbs are objective enough to decide the outcome of an election. The same people entrusted with protecting the reputation of the court have blundered into being wholly responsible for protecting democracy. Not one thing suggests they will take the latter any more seriously than they took the former.

Of course the Supreme Court is political. Just like every court is political. Just like the Colorado Supreme Court is. Just like every Judge in every level is.
The Supreme Court here doesn't matter.
I hope they ignore this blatant abuse of Democratic power and allow all the deep Blue states to remove Trump from the ballot.
Trump is going to win, regardless. But at least you guys can claim he won the popular vote by 25 or 30 million this time when Democrats kick Trump off the ballot in 10 states.
