Sounds like a pretty typical diversion program for first time offenders.

I suspect that if the Prosecutor had anything substantial, Limbaugh would have had to go to trial. From what I've read, the Prosecutor was overeaching from the start, just like the one in the Duke case.

If this is the deal he received he will technically not be convicted of anything so long as he successfully completes his probation, so the only thing on his criminal record will be the arrest, which he won't be able to expunge. It varies from state to state, but for 1st time offenders such as this, rarely if ever is jail time given. A celebrity ( forget who ) was recently found w/ COCAIN and didn't serve any time. And of course there's the issue of fishing into folks medical records w/ out due process. But w/ such a political witch hunt as this, what's to be expected?

Limbaugh has been undergoing random drug testing and has already gone through rehab, so there really isn't any extra penalty being imposed here. He's got 18 months to stay clean, and hopefully for him, that will be that.

Yes, this type of sentence is typical for first time offenders, so Limbaugh was not given preferential treatment. If this had taken place in Texas the result would have been the same. This is an interesting thing. On one hand I realize it's easy to become addicted to painkillers and I feel sorry for people who have that problem and agree with this type of pre trial intervention to give them a chance to get clean without a felony on their record. On the other hand this is a guy who has worked hard to demonize people with the same addiction he has, so my compassion for Limbaugh is limited. I think the deferred adjudication for Limbaugh is fair, I just hope that this experience will give him a little more compassion for people with drug dependency problems.

And no Hero, Limbaugh wasn't offered this deal due to a weak case for the state, he was given the deal because it's standard procedure to do so for first time offenders.

I'm just curious. To me a first-time offender is someone caught with a small amount of pot whose home, auto, record and history come up clean. Not someone who has scarfed up literally thousands of illegally obtained pills over a long time.

So, what IS a first-time offender?

A first time offender is someone who has never been convicted of a crime or received deferred adjudication. Traffic and parking tickets are not counted as first offenses.

Yes, if a person hasn't been convicted before (or received deferred adjudication) they're treated as a first offender, regardless of the number of possible offenses they've committed. Only convictions count. That doesn't mean that all first time offenders receive deferred adjudication. Murderers, rapists, armed robbers and large scale drug dealers, for example, won't receive deferred adjudication. Generally courts will grant deferred status to non violent first time offenders, especially if the crime did not result in damage to others or property damage.

The law works funny, then, when it comes to 'evidence'. The administration said IR snooping was just like public visibility, but a simple observation over a century old (you have to be taking that stuff a long time to develop a tolerance that big) gets ignored.
