I've been waiting for someone else to post on this topic, so I can knock some neoCON heads off. Jeff Christy, aka Rusty "Rush" Limbaugh is now a convicted felon. Has a nice ring to it. It sure is a popular club fed Loony Bin.
Why wasn't he raided at gunpoint, tortured with electroshock of his testicles, burned with cigarette butts, beaten with a baseball bat, a loaded gun put to his head to blow his brains out, threaten to rape his wife, and jailed like this poor guy, who, unlike Rush, wasn't caught with drugs in his possession?

If RWED is going to be essentially a Troll Country annex, then why not change its title? Would save time for lots of folks who mistakenly came here to discuss Real World Events.

My understanding is that Limbaugh is on some kind of deferred adjudication now, and has to take random drug tests for 18 months and pass some kind of treatment program. If he does that he will not be found guilty. That's my understanding of his plea deal.

He was arrested. He faced at least 5 years in state prison.
It didn't matter if he pled not guilty, since the judge ordered that he WAS GUILTY. Many people PLEAD Not Guilty, then get found GUILTY by a court of law. It's not what you plead that counts, it's what the court decides that counts.
Rush was found guilty of a felony with a jail sentence of 1 year and 6 months, "suspended" on condition of surviving probation. That's the only way to get probation.
You don't get a jail sentence in state prison when you are not found guilty.
You don't pay $30,000 in criminal fines and court costs unless you are found GUILTY of a crime.
It's VERY hard to survive probation without a traffic ticket or failing a piss test or missing a weekly appointment with a probation officer. Altho Rush has a chauffeur, he's still a drug addict. One slip and it's civil contempt of court, and back to the state pen for the entire 18 months. Most people in prison failed to survive their probation slave contract, and were rearrested.
Same thing happened to JEB Bush's crack ho daughter Noelle Bush, busted with crack in the Loony Bin jailhouse.

Expungement of a felony conviction, however, remains on file FOREVER. It's just a little harder to find in the public records than a regular conviction with a local court clerk. Since EVERYBODY already knows about it, expungement is a moot point. J.E.B. won't be governor forever...
Hero, am I accurate on my legal assessment?
Or is this nolle prosequi voluntary dismissal without prejudice (after 18 months of parole or probation), with judge signing order of dismissal on payment of court costs, and some kind of diversion rehab contract? Most people never get offered this "good" of a deal, and I bet it cost Limbaugh $1-million or more for his trial lawyer.

I'm not sure how it works in Florida but I think Limbaugh was given a very sweet deal. If he were in Texas he would have plead not guilty or no contest, the judge would have then deferred his judgment until Limbaugh's probationary period was up, which is 18 months in this case. At the end of 18 months (assuming he doesn't violate his terms of probation in the meantime) the judge will enter a finding of no guilt if Limbaugh meets all terms of probation. If this is the deal he received he will technically not be convicted of anything so long as he successfully completes his probation, so the only thing on his criminal record will be the arrest, which he won't be able to expunge. This kind of deal is available in Texas to most non violent first time offenders. Drug related crimes are sometimes the exception to that rule, but generally only dealers are not eligible for deferred adjudication.

Yeah, that sounds right. He did dodge the indictment by a couple of days. But the grand jury can still indict him at any time. As the Legal Maxim says, "A prosecutor can get a grand jury to indict a ham sandwich". And Rush is a Kosher ham.
But this "diversion" is nothing but an 18-month continuance. The Police State axe will remain over his head for 18 months. The charges are NOT yet dismissed. He still risks 5 years in state prison. That's a lot of pressure.
If he has ONE sip of alcohol in a restaurant, or if any customer ALLEGES they saw Rush sip an alcohol beverage in a restaurant with his dinner, then Rush will be immediately arrested, jailed overnight or over the weekend, and faces 5 years in prison. Hear that Libs? Stakeout time!
That same court sentenced an airline pilot to prison for 5 years for the noncrime of carrying a cup of coffee through the airport. His voluntary admission to Loony Bin "Rehab" was used by the judge as a sentence enhancement factor, since its a de facto confession to guilt of addiction. All of Rush's Rehab psychiatrists will be called to testify against him in court, and every word out of their mouths will hang him as a crazy alcoholic junkie.

Diversion is a de facto plea of guilt, since it's NOT an adversarial trial by jury, without an aquittal of "not guilty".
Court costs are very high if there are many motion hearings and depositions with court reporters and transcripts, as there were in this case - $500 to $1,000/day. Rush's trial lawyers fought for years over Dept of Homeland Security investigating his medical records for "terrorism" under Bushes' U.S.A.P.A.T.R.I.O.T. Act.

Limbaugh, 55, a Palm Beach resident, his lawyers and prosecutors reached an agreement on the single felony charge, and the conservative radio talk show host surrendered at the Palm Beach County Jail late Friday afternoon. He spent less than an hour in custody and was fingerprinted before being released on $3,000 bail.
The agreement requires Limbaugh to continue seeing the therapist who has been treating him since he admitted to an addiction to painkillers in October 2003 and entered a month-long treatment program. It also requires him to undergo drug testing and pay $30,000 toward the cost of the investigation, according to prosecutors.
If Limbaugh successfully completes the terms of his 18 months of supervision, the felony charge will be dismissed and Limbaugh's record will be clean.
"If he does not successfully complete it, then the state will go forward with the charge," Palm Beach County State Attorney's Office spokesman Michael Edmondson said.
Prosecutors routinely use such "pre-trial intervention" agreements with drug offenders, Edmondson said.
"It is a resolution that is standard for first-time offenders with no other criminal history or arrests and individuals with a history of drug addiction," Edmondson said.
The doctor-shopping charge alleges Limbaugh obtained overlapping prescriptions from three doctors, one in New York and two in Palm Beach County, without telling them. That is a third-degree felony punishable by up to five years in prison.
While Limbaugh was being treated for back pain at the Jupiter Outpatient Surgery Center, he signed a pain-management contract that required him to get all his drugs from the center and reveal which pharmacy he would use to fill the prescriptions, according to Limbaugh's arrest affidavit.

If only to point out what a DANGEROUS position Rush has put himself in by agreeing to this diversion "bargain", with its impossible probation contract trap. I wish he had fought it and won a precedent setting case, based on the Constitutions, to repeal Drug Prohibition and its Communist Police State Gulag. But Rush has always been a chickenhawk draft dodger, and lacks the intestinal fortitude to do anything requiring guts and integrity. Heck, he met his 3rd wife on the internet, since he's too chicken to date.

Um...folks? I gotta say this...if these people weren't famous (or relatives of famous people) we would have a lot more compassion for them. Regardless of their choice of profession or who they are related to, they are still human beings with problems many of us face. Granted, I can't stand those that feel they're "above the law", but still...

Rush's level of fame has less to do with this than his previous tirades on drug users, including white, white-collar, abusers...the hypocracy is why this matters.

Now personally, I have a lot of compassion for addicts...and for recreational users, for that matter. I don't think drug use should be illegal, and I think a big chunk of the revenue should be used to help people curb their addictions, and to educate people on the subject.
But if anybody should be 'sent up the river,' its somebody who has preached the lack of compassion on these issues. On the other hand, we should have that compassion for the worst of us I guess, and Rush, being the worst of us, has already shown his kinder and gentler side in regards to his coverage of Pat Kennedy's car wreck, and his own case is being dealt with the way drug cases should be(while drugs are illegal anyway)...
And Auraptor, Jesus Christ, you love your party line B.S. Rush turned himself in, and agreed to monitoring for like 6 months to a year, at which point, if he is found to be using he will be prosecuted. His high profile gave him treatment that most drug users aren't privileged to, which would be a good thing, if it wasn't so unfair.
