Trump shuts the border on the pretense of disease

Stephen Miller has been thinking for a while about how to bring back Title 42 expulsions along the border, which were imposed during the COVID epidemic and then lifted when the emergency was declared over. But no matter how hard Miller looked, there were no suitable diseases around. So apparently he just gave up:
President Donald Trump is preparing to send 10,000 troops to the southern border, and Border Patrol agents have been directed to deny entry to asylum seekers if they “traveled through a country with communicable disease,” according to a U.S. Customs and Border Protection briefing document obtained by The Washington Post.
The order does not list any specific disease, essentially closing the border to anyone attempting to exercise the right to seek humanitarian refuge under U.S. law.
That should do the job, since every country has some communicable diseases. As with so much of Trump's activity, however, it has a fatal flaw: It's illegal. But I guess he doesn't care. I suppose the idea is to shut the border until a judge orders him to open it back up, in hopes that the confusion by itself will scare everyone off. Who knows? It might work.
But that's true of lots of things as long as you don't care about the law.

Trump’s First Flurry of Executive Orders Plagued by Shoddy, Shoddy Lawyering

Look at the order purporting to halt all immigration at the southern border; it just says there is an “invasion” of immigrants, so he’s suspending all of the immigration laws. Thousands of pages of federal law enacted over the course of many decades—all frozen in one fell swoop because Trump says there is an “invasion.” That is barely even a legal argument. That is a line in a campaign speech. And it has been transplanted into an executive order with barely anything to support it.
We expected to see a much more coherent work product this time around because the administration had so much time to prepare, and because allegedly the nation’s top conservative lawyers had all lined up behind MAGA. The so-called rift within the Federalist Society is over; I think it’s very clear the conservative legal movement has totally thrown its weight behind Trump. There are very few holdouts remaining. So we were supposed to see the work product of the smartest guys in the room, and instead what we see is more of the same shoddy workmanship and legal reasoning that’s questionable, if not outright laughable.
What’s surprising to me is that in Trump’s first administration, he lost big cases because of bad lawyering. He lost the census citizenship case because of bad lawyering. He lost the DACA rescission case because of bad lawyering. Chief Justice John Roberts kept saying: I will not sign off on this. Or: I would not put my name to this if I were a lawyer, and I certainly won’t approve it as chief justice. And so one might assume that this administration would learn its lessons and do better, but we aren’t seeing that yet.
Now, let’s remember, there isn’t a confirmed attorney general yet. The Justice Department is certainly not fully staffed yet. Perhaps when Pam Bondi is confirmed and can staff up the Justice Department, we will see an improvement here. But again, Trump had pretty much endless time and resources to put all of this together into a coherent package. And in my view, he failed. Which suggests to me that he and his advisers are not taking this more seriously perhaps because they think they now have the Supreme Court fully in their pocket. But if that’s their belief, I think they might actually be mistaken.
I think the Supreme Court does not want to be seen as a lapdog of the executive branch under any circumstances or any administration. I certainly don’t think that John Roberts, Amy Coney Barrett, or perhaps even Brett Kavanaugh want to be seen as rubber stamps for Donald Trump. They still view themselves as the ultimate arbiters of the Constitution. I don’t think they want to defer to terrible lawyering from Trump’s most nakedly nativist aides and say, “Sure, good enough.”
I also think they came to the court with pretty strong priors and constitutional views and theories, and some of what Trump is doing is an affront to that. For instance, I really struggle to believe that John Roberts thinks birthright citizenship is optional. His conception of the 14th Amendment might be deeply flawed, with his decisions about colorblindness and affirmative action. But unless you reject the 14th Amendment itself, the citizenship clause is as clear as could be, and I just think that John Roberts would be embarrassed to sign off on the abolition of it by executive fiat. He doesn’t want history to remember him as the most compliant chief justice who lost his spine the second Trump came back into office.
I could be naive. I could be wrong. But I think that there is value in still believing in the rule of law.

Trump moves to raise drug prices.
One of the nearly 200 executive orders that newly inaugurated President Donald Trump signed on Tuesday reversed several critical policies that President Biden had put in place. Among those was lowering drug costs for Americans. With the stroke of his pen, Trump removed a $2 price cap on certain generic drugs, did away with a provision that would improve access to high-cost therapies for Medicaid recipients, and ended an effort to expedite the evidence-gathering process for new drugs.
To put it another way, President Trump just opened the door for drug prices to skyrocket . . .
That should help with inflation.

Reason 1 was the price of housing. What will voters do when Trump can't lower the price? Vote for J.D. Vance? Or vote for a Democrat? Prices are not in the control of Presidents, but 99% of voters will never completely understand that. The top 1% do know who sets prices because they set the prices. The 1% also set wages, but 99% of voters think it is the President. Who controls the economy? 99% of voters think it is the President, but once again it is the top 1% who control it.
There are gonna be a lot of voters disappointed with the Republican Party because it doesn't make their dreams come true. It can't because it doesn't control what the top 1% do. The system where the top 1% have most of the control could be disassembled, but that ain't gonna happen because most people in Congress don't understand that the 1% took charge of America two centuries ago because Congress would not take charge, and 99% of voters are confused, uncertain, dithering between Democrat and Republican.
Personally, I think the 1% are doing a pretty good job running America for their best advantage. But if Congress would stop avoiding its Constitutional responsibilities, America would run even better. My favorite and simplest example of irresponsibility by Congress is the fact that there have been no declarations of war from Congress since 1942, but there have been numerous wars, most of which were lost because Congress could not make up its fucking tiny mind to either win or stop a belligerent President from botching a war. See Vietnam. Or Iraq. Or Afghanistan.
My next favorite and not-so-simple example of irresponsibility by Congress is taxation. There would be no National Debt if Congress taxed the top 1% the way it should be taxed, but Congress can't make up its tiny mind about that. Instead, the top 1% made up their mind to not pay. America has not died, yet, because its top 1% haven't lost their individual purpose. As for the other 99% of Americans, most of them have lost their purpose, other than to get high or into heaven, a place that doesn't exist.
