To be sure, Section Three clearly bears the hallmarks of its historical context. It is, for one thing, a radical rule. The sheer sweep of the disqualification from offices that it imposed on former Southern officeholders-turned-rebels was dramatic. Its operation was hugely disruptive of antebellum patterns of elite political leadership, apparently indifferent to inconvenience, and seemingly rather punitive in its consequences. Section Three is harsh. It is categorical. It is insistent. It seems to have been deliberately designed to turn the prior Southern political order upside down. As Eric Foner puts it, "Section 3 aimed to promote a sweeping transformation of Southern public life.”7
In these respects, the disqualification reflects and embodies the distinctive political impulses of the so-called Radical Republican Congress that proposed the Fourteenth Amendment in 1866. If its disqualification had radical policy consequences for the South, so be it.8 It was more important to strip insurrectionists and rebels of governing power completely, to remake Southern political society thoroughly, and to prevent Southern backsliding from the full consequences of Union victory entirely, than to be concerned about such things as seeming harshness, impracticality, or disruptiveness. Section Three is very much a creation and creature of its day.
Yet it is (or should be) basic constitutional law that it is the enduring text of the Constitution that supplies the governing rule, not the ostensible "purpose” or specific historical situation for which the text was written. Constitutional provisions, written into our fundamental law, live beyond the circumstances that prompted their adoption. And many such constitutional provisions are written in broad, or general, terms that obviously extend beyond the specific situation or situations that led to their enactment. Sometimes this is by design: the text’s drafters wrote a general rule, applicable to a broad class of circumstances, as a more general, "neutral,” way of addressing a class of situations of which the specific problem motivating the writing of the text might be just one instance. The thinking might be that if the principle giving rise to the text is a correct one, it should be correct in like circumstances, not just the one situation that provoked the rule’s adoption. And sometimes a text’s breadth and generality might not reflect conscious design: the text’s drafters wrote a general rule that unintentionally went further than the problem they had in mind. Put colloquially, the text sometimes “overshoots” its drafters’ intended purposes. (A text might undershoot the problem its framers had in mind to address, too—or achieve only part of its intended purpose, perhaps because of political compromise.)
The reason does not really matter. It is the rule as drafted and enacted in the written text that counts, whether it goes further than the purposes supposed to have inspired its adoption, or even whether it falls short of fully achieving those purposes. While evidence of intention, usage, purpose, and political context can assist in ascertaining the meaning of the enactment, it is that objective meaning that constitutes the law, not the ostensible purposes o

Why Was It So Hard for Nikki Haley to Say ‘Slavery’? History Has the Answer
The presidential candidate’s recent comments about the Civil War helped spread a myth that has warped American history for over a century.
In William Faulkner’s novel, Sartoris, someone asks the title character, Colonel John Sartoris, why he had fought for the Confederacy so many decades before. “Damned if I ever did know,” replied the aging veteran, now a pillar of his community in fictional Yoknapatawpha County, Mississippi.
Of course, we know why Colonel Sartoris raised arms against the United States. So does anyone with a high school diploma — assuming they used up-to-date textbooks. And so did Alexander Stephens, the vice president of the Confederacy, who in 1861 famously asserted that the “cornerstone” of the new Southern nation rested “upon the great truth that the negro is not equal to the white man; that slavery, subordination to the superior race, is his natural and normal condition. This, our new government, is the first, in the history of the world, based upon this great physical, philosophical, and moral truth.”
All of which makes it disappointing, though not surprising, that at this late date — almost 160 years after the Civil War — Nikki Haley, a leading contender for the GOP presidential nomination, shares Colonel Sartoris’ selective amnesia on the topic. When asked a softball question this week about the causes of the Civil War, Haley, a former South Carolina governor, flubbed the answer, calling it a “difficult” question and mumbling on about “basically how government was going to run — the freedoms and what people could and couldn’t do.”
As Haley must know — after all, as governor of South Carolina, she presided over the removal of Confederate flags from the Statehouse — many Americans do question the fundamental fact that slavery precipitated the Civil War, and her equivocation played into a long-standing agenda to rewrite American history. Haley was effectively parroting the Lost Cause mythology, a revisionist school of thought born in the war’s immediate aftermath, which whitewashed the Confederacy’s cornerstone interest in raising arms to preserve slavery. Instead, a generation of Lost Cause mythologists chalked the war up to a battle over political abstractions like states’ rights.
With red states doing battle with American history, seeking to erase the legacy of violence and inequality that counterbalance the great good also inherent in our national story, it’s worth revisiting the rise of the Lost Cause, not just to remember how damaging it was, but to confront just how damaging it still is.
The Lost Cause painted a picture of Southern chivalry — mint juleps, magnolias and moonlight — that stood in sharp contrast with the North, a region marked by avarice, grinding capitalism and poverty. The rebellion, by this rendering, had been a legal response to the North’s assault on states’ rights — not a violent insurrection to preserve chattel slavery. Even Confederate veterans like Hunter McGuire knew that to admit the war had been about slavery would “hold us degraded rather than worthy of honor … our children, instead of revering their fathers will be secretly, if not openly, ashamed.”

Donald Trump’s MAGA movement is fundamentalist at its core — with fundamentalism being understood as a psychological rather than a religious concept.
Pretty much every large-scale public movement, secular or sacred, has its share of extremists, and as the religious columnist Paul Prather has argued: “Remove the labels, close your eyes and quickly the fundamentalists in one group start sounding uncannily like the fundamentalists in all other groups, as if they were reading from the same script.”
It’s another word for fanatic.
Most Trumpists call themselves “conservative,” which used to signify a belief in limited government, low taxes, free trade and freedom of conscience but which under Trump signals tribal loyalty and revenge.
This explains what some see as the central paradox of the MAGA movement: that a congenital braggart who embodies what Christianity has traditionally called the seven deadly sins — greed, lust, envy, sloth, gluttony, pride and wrath — has come to seem the totem of faith for millions of Republican evangelicals.
Trump spent Christmas Day typing up and posting laments and threats in ALL CAPS on his Truth Social, targeting “JOE BIDEN’S MISFITS & THUGS, LIKE DERANGED JACK SMITH.” They’re “COMING AFTER ME,” he warned, “AT LEVELS OF PERSECUTION NEVER SEEN BEFORE IN OUR COUNTRY??? ... looking to destroy our once great USA. MAY THEY ROT IN HELL. AGAIN, MERRY CHRISTMAS!”
A bit lacking in the spirit of the holiday, some would say.
Not to mention he’s the world’s biggest crybaby.
But they would be wrong, the MAGA faithful would insist. George Orwell captured the essence of the whiny strongman in reviewing the British edition of Adolf Hitler’s “Mein Kampf” way back in 1940, after the German dictator had driven Germany to war, but before it was clear he had doomed his country to catastrophe.
Hitler, Orwell wrote, “knows that human beings don’t only want comfort, safety, [and] short working-hours ... they also, at least intermittently, want struggle and self-sacrifice, not to mention drums, flags and loyalty-parades.”
Orwell understood fascism’s appeal to an aggrieved population. While European and North American democracies, he wrote, told people in effect that “‘I offer you a good time,’ Hitler has said to them, ‘I offer you struggle, danger and death,’ and as a result a whole nation flings itself at his feet.”
Orwell also understood the personal psychology of the crybaby conqueror: “The initial, personal cause of [Hitler’s] grievance against the universe can only be guessed at; but at any rate the grievance is here. He is the martyr, the victim, Prometheus chained to the rock, the self-sacrificing hero who fights single-handed against impossible odds. If he were killing a mouse he would know how to make it seem like a dragon.”
Sound like anybody we know?
That said, I do believe Trump when he says he never read “Mein Kampf.” Too long, too many big words. Trump never learned anything from a book. He stole his whole act from 1950s professional wrestlers at Sunnyside Gardens in Queens, specifically from Dr. Jerry Graham, who swaggered around boasting that “I have the body men fear and women adore.”
The hairstyle, too — a bleached blond pompadour that taught a generation of wrestling fans how a “heel” behaved — that is, basically like a cartoon Nazi. Graham was a masterful showman who aroused thousands to frenzy with balsa wood chairs and fake blood capsules. He was as fat as Trump, too, although there was muscle under the lard.

A Far-Right Court Just Admitted a Truth That Abortion Foes Want to Hide

When the Supreme Court overturned Roe v. Wade, it claimed to be removing the judiciary from the abortion debate. In reality, it simply gave the courts a macabre new task: deciding how far states can push a patient toward death before allowing her to undergo an emergency abortion. On Tuesday, the U.S. Court of Appeals for the 5th Circuit offered its own answer, declaring that Texas may prohibit hospitals from providing “stabilizing treatment” to pregnant patients by performing an abortion—withholding the procedure until their condition deteriorates to the point of grievous injury or near-certain death. The ruling proves what we already know: Roe’s demise has transformed the judiciary into a kind of death panel that holds the power to elevate the potential life of a fetus over the actual life of a patient.
If that description seems hyperbolic, consider the facts of Tuesday’s decision, Texas v. Becerra. It involves a clash between a federal law and Texas’ stringent abortion ban. Texas law reflects the anti-abortion movement’s fundamental hostility toward any health exceptions; it permits emergency abortions only when a patient is “at risk of death” or “substantial impairment of a major bodily function.” Any doctor who terminates a pregnancy before this point is subject to a 99-year prison term. The Texas Supreme Court affirmed the narrow scope of this exception last month when it forbade Kate Cox from terminating her pregnancy. Cox suffered “severe cramps, leaking fluid and elevated vital signs” due to an abnormality that rendered the fetus incompatible with life. Yet the court unanimously decreed that, until her symptoms grew considerably more dire, Cox was legally obligated to continue the failing pregnancy.
This draconian ban, and others like it, conflicts with a federal statute, the Emergency Medical Treatment and Active Labor Act, or EMTALA. That law compels federally funded hospitals to provide “necessary stabilizing treatment” to any patient experiencing an “emergency medical condition.” It defines the term as any condition that “could reasonably be expected” to seriously jeopardize a patient’s health, bodily functions, or organs. In July 2022, President Joe Biden’s Department of Health and Human Services issued guidance noting that EMTALA applies when a pregnant patient requires an abortion for “stabilizing” care. It clarified that any stricter abortion laws must yield to EMTALA, granting red-state doctors permission to terminate a pregnancy well before a patient is dying.
Texas promptly attacked the Biden administration’s guidance, filing a lawsuit in a division that ensured the case would land in front of one of conservatives’ favorite judges: James Wesley Hendrix, a far-right Trump appointee. The state argued that it has the right to force patients into more extreme medical distress before allowing them to terminate a pregnancy, and that EMTALA’s “stabilizing” standard does not apply to abortion. Predictably, Hendrix agreed.

One party is dedicated to bringing about a dictatorship that plans to seize power for “a generation or two,” purging society of the enemies that are purportedly destroying the nation from within. The other party is a vaguely center-left coalition, too weak to bring about effective change because the country’s Constitution and societal fragmentation make it politically and legally impossible.
As bad as this is, I haven’t even gotten to the really depressing part. Most people assume that if fascism came to America, we would recognize it as individuals and refuse to go along with it. In reality, very few people are directly affected by living in an authoritarian country; life is mostly “boring and tolerable” for the majority. “Yes,” most people would say, “but if asked to do things I know were wrong, I would refuse to comply. Because I’m an American, and I know better.”
Except, we’re already testing this every day in red states, and failing miserably. Let’s discuss a scenario that is already happening frequently.
A woman goes into the E.R. She’s 18 weeks pregnant, her water broke, and she’s miscarrying. There’s no way to save the fetus. She’s likely to either bleed out or die of sepsis if left untreated. A doctor assesses her and quickly reaches this conclusion. But because there’s a heartbeat (for now), he can do nothing. The doctor calls hospital administrators. They pass it along to general counsel. Counsel comes back with the determination that there are greater civil and criminal liability risks if they perform a D&C than if the woman dies from lack of treatment. This is passed to the administrators, who passes it to the doctor, who tells the woman to go wait in the car until she’s nearly dead and then maybe he can treat her, if there isn’t a fetal heartbeat.
The doctor knows this is wrong at a fundamental level. The hospital administrators probably do as well. The woman is very likely to die, painfully and slowly, from gross neglect. But the doctor is just following orders from the administrators. The administrators are just following orders from counsel. Counsel is acting on the raw calculus that the state attorney general will never grant a life of the mother exception, and that there’s less risk if she dies in the parking lot than if she’s alive in the hospital. Neither the state legislators nor the attorney general can be held criminally or civilly liable for the suffering and death that they cause. Nor can the legislators ever be removed from office, because of gerrymandering.
Ultimately, when the power of the state comes to bear on people, including Americans, the vast majority will not do the right thing. Most (sane) people admire Martin Niemöller, but when confronted with the reality of how fascism corrupts ordinary men, almost no one emulates his willingness to do the right thing by defying the state. When Trump takes power and turns the full might of the government against anyone who might resist, the guardrails of individual conscience will evaporate faster than a snow flurry in hell.

Robert F. Kennedy Jr. Pulls Out of Troubled Fundraiser
Afundraiser for Robert F. Kennedy Jr. – having falsely been billed as an event attended by a world-renowned tenor and several high-profile celebrities – won't include the candidate himself, the independent presidential hopeful's campaign said Monday.
A super PAC backing Kennedy, who is the son of the slain former Democratic presidential candidate of the same name, promoted a Jan. 22 fundraiser in Indian Wells, California. The promotion on social media said singer Andrea Bocelli would perform and that actor Martin Sheen, Grammy Award-winning singer Dionne Warwick and former prizefighter Mike Tyson would be there as "well-wishers."
That seemed to come as a surprise to the high-profile alleged invitees. Warwick said she didn't know anything about the event, meant to also serve as a celebration of Kennedy's 70th birthday, and "certainly won't be there."

Trump’s leads over Biden in key swing states narrow: Survey
The poll found that the margins between Trump and Biden grew closer in Arizona, Georgia, North Carolina and Pennsylvania, but that the former president still maintains an edge in all six states surveyed. Neither candidate received more than 50 percent of support in any state, signaling that the swing states remain divided on who they will likely support in the general election.
The closest battleground state appears to be Pennsylvania, with Trump holding just a 1-point lead over Biden. Trump secured 40 percent of support in the state, while Biden had 39 percent. Trump’s lead in Pennsylvania has diminished since November, according to the poll, when he had a 7-point lead over Biden.

Don’t Be Surprised if Trump Starts Attacking the Federal Reserve
Jan. 8, 2024, 7:00 p.m. ET
Why? Because there are very good reasons for the Federal Reserve, which controls short-term interest rates — that’s how it makes monetary policy — to start reversing the sharp rate hikes it carried out beginning in March 2022. There’s a vigorous debate about whether those rate hikes were excessive, which I’m not going to litigate here. Whatever you think about past policy, the case for cuts going forward is very strong, and I hope the Fed will act on that case.
What I don’t know is whether the Fed is ready for the political firestorm it’s about to face, and whether it will stand up to the pressure to keep rates too high for too long. Because it’s a safe prediction that Donald Trump and his supporters will scream that the coming rate cuts are part of a deep-state conspiracy to re-elect President Biden.
Let’s talk first about the economics, which should — but might not — be the only thing guiding the Fed’s decisions.
The Fed raised rates in an attempt to rein in inflation, which was running hot at the time — its preferred measure of underlying inflation was running far above its target rate of 2 percent. It kept raising rates until the middle of 2023, trying to cool off the economy and ensure that inflation came down.
As it turns out, the economy still hasn’t cooled much, at least by the usual measures; the unemployment rate remains near a 50-year low. But inflation has plunged. Over the past six months, the core personal consumption expenditures deflator — try saying that five times fast — has risen at an annual rate of only 1.9 percent, below the Fed’s target, and more complex measures are close to 2 percent. Basically, the war on inflation is more or less over, and we won.
So why keep interest rates this high? Right now the labor market looks a lot like it did on the eve of the pandemic, with both unemployment and other measures of market heat, like the rate at which workers are quitting, similar to what they were in late 2019. The Fed is projecting higher inflation over the next year than it was in 2019, but only slightly higher.
Back then, however, the federal funds rate — the interest rate the Fed controls — was 1.75 percent. Now it’s 5.5 percent. It’s really hard to come up with a good reason it should stay that high.
True, high rates haven’t produced a recession — yet. But there are hints of economic weakness, and the Fed is supposed to try to get ahead of the curve. So it’s time to start cutting rates.
But rate cuts will have political implications. They will be good for Biden, although not exactly for the reasons you might think.
I don’t know what the unemployment rate or the rate of economic growth will be in November, but because monetary policy works with a lag, what the Fed does in the next few months won’t have much effect on these numbers.
Biden, however, is already presiding over a very good economy by normal standards, with solid job growth and plunging inflation. What he needs is for more Americans to accept the good news. And Fed rate cuts will help him with that. They will signal to the public that inflation really is under control; they will lead, other things being equal, to higher stock prices and lower mortgage rates.
So we can expect howls from Trump and his allies that politics, not economics, is driving the coming rate cuts — even though Trump himself appointed Jerome Powell, the Fed’s chair.
Why do we know this will happen? Partly because paranoia is MAGAworld’s normal condition: It sees sinister conspiracies everywhere.
Beyond that, Trump and his allies constantly engage in projection, assuming that their opponents are doing or will do what they themselves would do or have done, like weaponizing the Justice Department for Trump’s own political ends.

Former President Donald Trump thinks history could have been different, if only Abraham Lincoln had read The Art of the Deal. “The Civil War was so fascinating, so horrible,” he said last weekend. “So many mistakes were made. See, there was something I think could have been negotiated, to be honest with you. I think you could have negotiated that. All the people died, so many people died. You know, that was the disaster.”
As if the cake even needed icing, Trump added: “Abraham Lincoln, of course, if he negotiated it, you probably wouldn’t even know who Abraham Lincoln was.”
Longtime readers, hold onto your hats. I’m going to do something that even I never imagined. I’m going to agree with Donald Trump. Sort of.
Set aside, for a moment, the awful moral and humanistic implications of Trump’s wish that Lincoln had bargained away the freedom of four million enslaved people for a tenuous peace. Also, the risible implication that he, Donald Trump, could have managed the secession crisis better than Lincoln.
All of that notwithstanding, compromise was possible, and a lot of respectable voices in 1860 and 1861 called for it. Some historians — small in number, but still reputable — have made a similar case over the years.
The awfulness in Trump’s argument isn’t that it’s wrong. It’s that it might be right. To understand how, it’s important first to assess the compromise that was on the table — an option that Lincoln rejected — and the catastrophic counterfactual history that would follow had he taken the deal.

Former President Donald Trump’s efforts to claim federal immunity in a defamation lawsuit brought by writer E. Jean Carroll were thwarted once again as a federal appeals court declined to reconsider his case. The U.S. Court of Appeals for the Second Circuit, in a concise one-page order, chose not to rehear Trump’s appeal before its full 13-judge bench, leaving the Supreme Court as his final potential avenue for appeal.
The 2nd Circuit denied Trump’s requests on Wednesday, following standard procedure. Trump now has the option to appeal to the Supreme Court, although there is no guarantee that they will accept the case.

Did Donald Trump just say that he’s hoping for an economic crash? Not exactly. But what he did say was arguably even worse, especially once you put it in context.
And Trump’s evident panic over recent good economic news deepens what is, for me, the biggest conundrum of American politics: Why have so many people joined — and stayed in — a personality cult built around a man who poses an existential threat to our nation’s democracy and is also personally a complete blowhard?
So what did Trump actually say on Monday? Strictly speaking, he didn’t call for a crash, he predicted one, positing that the economy is running on “fumes” — and that he hopes the inevitable crash will happen this year, “because I don’t want to be Herbert Hoover.”
If you think about it, this isn’t at all what a man who believes himself to be a brilliant economic manager and supposedly cares about the nation’s welfare should say. What he should have said instead is something like this: My opponent’s policies have set us on the path to disaster, but I hope the disaster doesn’t come until I’m in office — because I don’t want the American people to suffer unnecessarily, and, because I’m a very stable genius, I alone can fix it.
But no, Trump says he wants the disaster to happen on someone else’s watch, specifically and openly so that he won’t have to bear the responsibility.
Speaking of which, when did Trump start predicting economic disaster under President Biden? The answer is before the 2020 election. In October 2020, for example, he asserted that a Biden win would “unleash an economic disaster of epic proportions.”
Now, everyone who makes economic predictions gets some of them wrong. I personally predicted a recession if Trump won in 2016, partly because markets seemed to believe that a Trump victory would be bad for the economy. But I retracted that call just three days after the election, acknowledging that I had briefly succumbed to motivated reasoning.
Trump, by contrast, has been predicting disaster under Biden for more than three years, without ever admitting that his predictions haven’t come true. What we’ve gotten from Trump instead is a series of desperate false claims about the state of the economy. No, the price of bacon isn’t “up five times” under Biden.
Some of these false claims fall into the category of: Who are you going to believe, me or your own eyes? Last month, for example, Trump declared that gas costs “$5, $6, $7 and even $8 a gallon,” when there are big signs all around the country advertising gas prices a bit over $3.
Maybe he doesn’t get out much.
What Trump surely does do, though, is watch a lot of TV, which means that he’s aware that the stock market has gone up a lot lately. This clearly troubles him. Indeed, he’s apparently so rattled by stock gains under Biden that in a recent speech he managed both to dismiss those gains as irrelevant — just “making rich people richer” — and to claim credit for them: “The stock market is good because a lot of people think we’re going to win the election.”
If this sounds ridiculous, that’s because it is. Here we have a guy who spent much of his time in office bragging about a rising stock market suddenly declaring that stock gains are bad when someone else is in power, while insisting that he deserves credit for good things (or are they bad things?) that happen when he isn’t even running the country.
Does this matter? Trump may want an economic crash, but he doesn’t have any tools I’m aware of that could produce one. But as I wrote the other day, there’s a risk that pressure from Trump and his allies will lead the Federal Reserve to keep interest rates too high for too long.
Practical concerns aside, however, Trump’s flailing on the economy and the stock market deepens the mystery of his political appeal.

Begin with fundamentals. Trump got three big things right — or at least more right than wrong.
1) Arguably the single most important geopolitical fact of the century is the mass migration of people from south to north and east to west, causing tectonic demographic, cultural, economic, and ultimately political shifts. Trump understood this from the start of his presidential candidacy in 2015, the same year Europe was overwhelmed by a largely uncontrolled migration from the Middle East and Africa. As he said the following year, “A nation without borders is not a nation at all. We must have a wall. The rule of law matters!”
Many of Trump’s opponents refuse to see virtually unchecked migration as a problem for the West at all. Some of them see it as an opportunity to demonstrate their humanitarianism. Others look at it as an inexhaustible source of cheap labor. They also have the habit of denouncing those who disagree with them as racists. But enforcing control at the border — whether through a wall, a fence, or some other mechanism — isn’t racism. It’s a basic requirement of statehood and peoplehood, which any nation has an obligation to protect and cherish.
Only now, as the consequences of Biden’s lackadaisical approach to mass migration have become depressingly obvious on the sidewalks and in the shelters and public schools of liberal cities like New York and Chicago, are Trump’s opponents on this issue beginning to see the point. Public services paid by taxes exist for people who live here, not just anyone who makes his way into the country by violating its laws. A job market is structured by rules and regulations, not just an endless supply of desperate laborers prepared to work longer for less. A national culture is sustained by common memories, ideals, laws and a language — which newcomers should honor, adopt and learn as a requirement of entry. It isn’t just a giant arrival gate for anyone and everyone who wants to take advantage of American abundance and generosity.
It said something about the self-deluded state of Western politics when Trump came on the scene that his assertion of the obvious was treated as a moral scandal, at least by the stratum of society that had the least to lose from mass migration. To millions of other Americans, his message, however crudely he may have expressed it, sounded like plain common sense.
2) The second big thing Trump got right was about the broad direction of the country. Trump rode a wave of pessimism to the White House — pessimism his detractors did not share because he was speaking about, and to, an America they either didn’t see or understood only as a caricature. But just as with this year, when liberal elites insist that things are going well while overwhelming majorities of Americans say they are not, Trump’s unflattering view captured the mood of the country.
In 2017, the demographer Nicholas Eberstadt joined this pessimistic perception with comprehensive data in an influential essay for Commentary. He noted persistently sluggish economic growth and a plunging labor-force participation rate that had never recovered from the 2008 financial crisis. There was a rising death rate among middle-aged white people and declining life expectancy at birth, in part because of sharply rising deaths from suicide, alcoholism or drug addiction. More than 12 percent of all adult males had a felony conviction on their record, leaving them in the shadowlands of American life. And there was a palpable sense of economic decline, with fewer and fewer younger Americans having any hope of matching their parents’ incomes at the same stages of life.
Far too little has changed since then. Labor-force participation remains essentially where it was in the last days of the Obama administration. Deaths of despair keep rising. The cost of living has risen sharply, and while the price of ordinary goods may finally be coming down, rents h

Trump’s latest about-face: He now says 2020 election was ‘long over’
In the months after the 2020 election, Donald Trump leaned on his campaign to launch ad blitzes and legal challenges to the results, insisting to his supporters that the election was “a long way from over.” He even told state and federal courts he was suing in his capacity as a political candidate.
Now, in a bid to derail criminal charges, he’s saying the opposite. At least six times in the past two weeks, Trump has declared that the election was “long over” by the time he began pushing state officials and then-Vice President Mike Pence to overturn his defeat.
It’s a new piece of rhetoric that’s meant to bolster Trump’s assertion of “presidential immunity” from his criminal charges for interfering with the transfer of power. He wasn’t a candidate anymore, Trump’s new theory goes, so he must have been doing his job as president to ensure elections are fair.
But there’s a problem: It flies in the face of the legal arguments Trump made three years ago, during his frenetic push to subvert the election results. Even after the votes had been counted and certified, Trump filed lawsuits contesting the results — and he claimed he was doing so not as the outgoing president, but as a candidate.

'Tuned out': Expert says voters switching off because they can't believe GOP is for real
Voters are still having a hard time wrapping their heads around the fact that the Republican Party is really going to nominate former President Donald Trump for the presidency again, according to an analyst.
Trump, who was impeached twice during his lone term in office and who is now facing 91 felony charges in four separate jurisdictions, is the overwhelming favorite to win the 2024 Republican presidential nomination, despite a better-than-average likelihood that he will be a convicted criminal by the time the election rolls around.
CNN reports that internal research from President Joe Biden's campaign shows that it's currently having trouble attracting undecided voters at the moment — simply because those voters don't really think Trump will once again be their sole major-party alternative.
One senior campaign official who spoke with CNN said that these voters at the moment are politically disengaged and still believe they will have a different Republican to pick from in 2024.

Swing state Republican parties are engulfed in turmoil ahead of key 2024 races
Republican parties in three battleground states are navigating turbulence that has many in the GOP concerned that the discord and dysfunction will jeopardize their candidates up and down the ballot in critical races this fall.
In Michigan, Nevada and Florida — three states that will feature competitive presidential and Senate contests — state parties have been gripped with leadership strife in recent weeks. In Florida, the GOP chairman was ousted after facing a rape accusation. In Nevada, the top two state party officials have been indicted for their alleged role as “fake electors” for former President Donald Trump after he lost the 2020 election there.
Nowhere has the chaos been more pronounced than Michigan, though, where rivalrous factions can’t agree on who’s in charge.
A large group of Michigan state GOP committee members voted last week to remove Kristina Karamo as chairwoman, asserting that she was leading the party toward bankruptcy and failing to live up to promises of transparency and reform. The party’s No. 2 official then declared herself acting chair. Karamo rejected the vote, arguing that the process was illegitimate and a violation of state party bylaws. Karamo has called her own meeting for Saturday.
“I’m the chair of the Michigan Republican Party, and that will not change,” Karamo said this week in an interview with NBC News. “Now, per the bylaws, there is a process to remove people, and if that process is lawfully filed, then, yes, I will accept the results. But none of this has occurred.”

On Monday, with Donald Trump sitting in court, his lawyer said Trump, if president, had the constitutional power to order the US military to commit political assassinations. Mark the moment. It took 3,125 days between Donald Trump’s descent down the escalator in Trump Tower until the quiet part was said out loud. Trump is surrounded by people who would kill for power, and kill with power.
Just this week, Trump confidant Roger Stone was caught on tape provoking his security chief, a rogue NYC cop, to assassinate Congressman Eric Swalwell or Jerry Nadler, or both. Stephen Miller, who is speculated about as a potential Trump attorney general, wanted the US military to murder defenseless migrants at sea. He also claimed that cities were turning into war zones during Black Lives Matter protests. The chairman of the Joint Chiefs of Staff at the time, Mark Milley, turned towards Miller in the Oval Office and said, “Shut the f@#k up, Stephen.”

On George Washington’s birthday in 1892, former President Grover Cleveland urged graduating students at the University of Michigan to “take with you … a strong and abiding faith in the value and potency of a good conscience and a pure heart. Never yield one iota to those who teach that these are weak and childish things, not needed in the struggle of manhood with the stern realities of life.”
The speech embracing Washington’s virtues was “perhaps the most unusual kickoff to a presidential campaign in American history,” wrote Cleveland biographer Troy Senik.
Nine months later, Cleveland won the presidency for the second time, becoming the only person in American history to serve non-consecutive terms in the White House. It is a feat former President Donald Trump is trying to duplicate this year.
Cleveland overcame scandal in his first run for president when he had to admit to having possibly fathered a child out of wedlock — his opponents derisively chanted, “Ma, ma, where’s my Pa?”
But his travails pale in comparison to Trump’s 91 felony charges — and Cleveland’s speech saluting homely American virtues is worlds away from the 2024 Republican frontrunner’s repeated focus on his own grievances, spoken as he travels from primary appearances to courtrooms. And, of course, Cleveland didn’t refuse to accept that he lost his bid for reelection — in 1888 to Benjamin Harrison — as Trump has, claiming without evidence that the 2020 election was a fraud.
Violence and immunity
In the world of legal developments swirling around Trump last week, the most significant was the DC Circuit Court’s oral arguments over his claim to immunity from criminal prosecution under nearly all circumstances.
Right out of the gate, Judge Florence Pan, who emerged as the panel’s most incisive questioner, presented Trump’s counsel John Sauer with a hypothetical that exposed the unthinkable consequences of Trump’s extreme position: Could a president who used his official authority to order SEAL Team Six to assassinate a political rival ever be prosecuted?
The question answers itself, and Sauer couldn’t square his client’s immunity claim with that and other confounding hypotheticals about extreme presidential action — an ominous sign for how Trump’s appeal will ultimately fare.
Placing presidents above the law — by making them immune from criminal accountability — gets separation of powers backward and upends the rule of law.
The SEAL Team Six hypothetical “resonated because it aligns with the Trump we have all come to know: a politician who has encouraged, promoted, justified and even praised political violence, as long as he sees it as a sign of support for him,” Frida Ghitis observed. “And it resonated because Trump is once again sending very clear signals that he endorses and even encourages political violence to support his cause.” He is calling those imprisoned for the Capitol riot “hostages,” rather than people convicted of crimes, Ghitis noted.
