The Audit That Never Happened. Trump claimed he was being audited by the IRS. He completely lied about that, which is par for the course:
House committee votes to make public Donald Trump’s personal and business tax records
The panel obtained the tax returns last month after a yearslong court fight.
For example, in 2019, the last year that the committee obtained records, Trump appeared to owe nothing in taxes, according to the JCT report. That was thanks to Trump claiming $15 million in business losses, which resulted in him having negative $4 million in adjusted gross income. Trump then claimed a $5 million refund, the report says.
The committee report listed several overarching issues it believed the IRS should have investigated but did not. For example, Trump claimed large cash donations to charities but the report said the IRS did not verify them. Additionally, Trump's tax filings were large and complicated, but the IRS did not assign experts to work on the audit at the request of the then-president's lawyer who argued including more agents could compromise the confidentiality of the documents.
Rep. Brendan Boyle, D-Pa., said the more detailed returns will likely be made public later this week.
"The actual returns themselves will also be transmitted to the full House and become public, but I was told it will take a few days to a week in order to redact some info that needs to be redacted,” Boyle said.
Ways and Means Committee Chairman Richard Neal, D-Mass., said Trump's returns were subject to scant oversight by the IRS, even though all presidents are supposed to be subject to automatic audits.
“For all practical purposes the research that was done as it relates to the mandatory audit program was nonexistent. The tax forms were really never audited, and only my sending a letter at one point, prompted sort of a rear view response,” Neal said during a news conference after the vote.

The defendants had been charged with seditious conspiracy against the United States and other crimes related to the January 6, 2021, attack on Congress.1
In his testimony that day, Young explained to the jury how he and other Oath Keepers were provoked to travel to Washington by President Donald Trump’s tweets and by Trump’s false claims that the 2020 Presidential election was “stolen” from him.2 And, in emotional testimony, Young acknowledged what he and others believed they were doing on January 6th: attacking Congress in the manner the French had attacked the Bastille at the outset of the French Revolution.3 Reflecting on that day more than a year and half later, Young testified:
Prosecutor: And so how do you feel about the fact that you were pushing towards a line of police officers?
Young: Today I feel extremely ashamed and embarrassed.…
Prosecutor: How did you feel at the time?
Young: I felt like, again, we were continuing in some kind of historical event to achieve a goal.

Prosecutor: Looking back now almost two years later, what would that make you as someone who was coming to D.C. to fight against the government?
Young: I guess I was [acting] like a traitor, somebody against my own government.4
Young’s testimony was dramatic, but not unique. Many participants in the attack on the Capitol acknowledged that they had betrayed their own country:
• Reimler: “And I’m sorry to the people of this country for threatening the democracy that makes this country so great...My participation in the events that day were part of an attack on the rule of law.”5
• Pert: “I know that the peaceful transition of power is to ensure the common good for our nation and that it is critical in protecting our country’s security needs. I am truly sorry for my part and accept full responsibility for my actions.”6
• Markofski: “My actions put me on the other side of the line from my brothers in the Army. The wrong side. Had I lived in the area, I would have been called up to defend the Capitol and restore order...My actions brought dishonor to my beloved U.S. Army National Guard.”7
• Witcher: “Every member—every male member of my family has served in the military, in the Marine Corps, and most have saw combat. And I cast a shadow and cast embarrassment upon my family name and that legacy.”8
• Edwards: “I am ashamed to be for the first time in my 68 years, standing before a judge, having pleaded guilty to committing a crime, ashamed to be associated with an attack on the United States Capitol, a symbol of American democracy and greatness that means a great deal to me.”9
Hundreds of other participants in the January 6th attack have pleaded guilty, been convicted, or await trial for crimes related to their actions that day. And, like Young, hundreds of others have acknowledged exactly what provoked them to travel to Washington, and to engage in violence. For example:
• Ronald Sandlin, who threatened police officers in the Capitol saying, “you’re going to die,” posted on December 23, 2020: “I’m going to be there to show support for our president and to do my part to stop the steal and stand behind Trump when he decides to cross the rubicon. If you are a patriot I believe it’s your duty to be there. I see it as my civic responsibility.”10
• Garret Miller, who brought a gun to the Capitol on January 6th, explained: “I was in Washington, D.C. on January 6, 2021, because I believed I was following the instructions of former President Trump and he was my president and the commander-in-chief. His statements also had me believing the election was stolen from him.”11
• John Douglas Wright explained that he brought busloads of people to Washington

During the nearly nine hours that Congress was under attack on Jan. 6, 2021, the official White House call logs show former President Donald Trump not placing a single phone call. The missing call logs bolster the expected criminal case against Trump.
“The first thing one thinks of is the Nixon tapes, the missing 18 minutes. It’s never been resolved,” said American University professor Chris Edelson, who studies the power of the presidency.
Edelson was referring to the Watergate scandal that took down President Richard Nixon, who taped White House discussions of the burglary coverup but conveniently erased 18-and-a-half minutes of those damning talks—much to the chagrin of federal investigators.
Trump—who was already impeached a second time over his incitement of the Jan. 6, 2021 insurrection and now faces a highly secret Justice Department investigation—is now in the same boat.
“It’s exactly like that… all you’re left to surmise is that, for nefarious reasons, this particular president didn’t want any record kept,” said Barbara Ann Perry, presidential studies professor at the University of Virginia.
The gap starts at 11:04 a.m. that day, when an incoming call was logged from then-Senator David Perdue (R-GA) with the attached note, “Talked Ok.” The next item appears nearly eight hours later at 6:54 p.m., when Trump asked the switchboard operator to ring his social media director. “POTUS instructed operator to call back with Mr. Dan Scavino,” it reads.
But similar to Nixon, there’s ample evidence that former President Donald Trump did indeed have damning conversations that aren’t reflected in the official record. Rep. Kevin McCarthy (R-CA), Rep. Jim Jordan (R-OH), and Sen. Tommy Tuberville (R-AL) have all admitted to having phone conversations with the former president during the harrowing hours while the attack unfolded in the afternoon, yet the White House switchboard typically used for official calls doesn’t reflect any of those calls. It’s unclear what phone he used to make these calls, but Trump was known to sometimes use the mobile devices of his aides or even his own cell at times.
“Yes, this is missing evidence of wrongdoing on the president's part,” Perry told The Daily Beast. “This would be part of that story. Why would he be hiding this?”
The eight-hour phone log gap might prove to be just a speed bump for the Department of Justice, which is currently reviewing Trump’s election reversal efforts as part of a larger probe into various criminal actions by the former president. That’s because FBI special agents can instead use subpoenas to quietly collect the phone toll records of McCarthy, Jordan, Tuberville, and anyone else who spoke to Trump during those hours to find which phones at the White House made those calls.
Should the DOJ make the historic but anticipated decision to indict the former president, a key challenge will be proving that Trump knew what he was doing was wrong. Political scientists who spoke to The Daily Beast wondered aloud if the the call log would prove to be as damning to Trump as the erased tapes were to Nixon—particularly if federal prosecutors determined that Trump’s criminal intent was evidenced by him taking steps to deliberately avoid making an official government record of damning phone calls to key lawmakers who supported his insurrection.
“The White House switchboard is highly regarded in historical literature,” said Bowdoin College presidential scholar Andrew Rudalevige, who emphasized how important these kinds of records are.
“I have very little doubt he was discussing things that were at best unsavory at that time,” he said.
But political scientists stressed that the missing records mean more than potential criminal evidence—they serve as a stark reminder of how low the Trump administration sank before its shameful exit.
“One thing we tend to lose track of with Trump is just how bizarre, unusual, unprecedented and unpresidential his term was. ‘Normalization’ was a real thing. People have come to accept these things that in any othe

There were no government safety nets – no unemployment insurance, minimum wage, social security or Medicare.
Economic despair gave rise to panic and unrest, and political firebrands and white supremacists eagerly fanned the paranoia of socialism, global conspiracies and threats from within the country. Populists Huey Long and Father Charles Coughlin attacked FDR, spewing vitriolic anti-Jewish, pro-fascist refrains and brandishing the “America first” slogan coined by media magnate William Randolph Hearst.
On 4 March 1933, more than 100,000 people had gathered on the east side of the US Capitol for Roosevelt’s inauguration. The atmosphere was slate gray and ominous, the sky suggesting a calm before the storm. That morning, rioting was expected in cities throughout the nation, prompting predictions of a violent revolution. Army machine guns and sharpshooters were placed at strategic locations along the route. Not since the civil war had Washington been so fortified, with armed police guarding federal buildings.
FDR thought government in a civilized society had an obligation to abolish poverty, reduce unemployment, and redistribute wealth. Roosevelt’s bold New Deal experiments inflamed the upper class, provoking a backlash from the nation’s most powerful bankers, industrialists and Wall Street brokers, who thought the policy was not only radical but revolutionary. Worried about losing their personal fortunes to runaway government spending, this fertile field of loathing led to the “traitor to his class” epithet for FDR. “What that fellow Roosevelt needs is a 38-caliber revolver right at the back of his head,” a respectable citizen said at a Washington dinner party.
In a climate of conspiracies and intrigues, and against the backdrop of charismatic dictators in the world such as Hitler and Mussolini, the sparks of anti-Rooseveltism ignited into full-fledged hatred. Many American intellectuals and business leaders saw nazism and fascism as viable models for the US. The rise of Hitler and the explosion of the Nazi revolution, which frightened many European nations, struck a chord with prominent American elites and antisemites such as Charles Lindbergh and Henry Ford. Hitler’s elite Brownshirts – a mass body of party storm troopers separate from the 100,000-man German army – was a stark symbol to the powerless American masses. Mussolini’s Blackshirts – the military arm of his organization made up of 200,000 soldiers – were a potent image of strength to a nation that felt emasculated.
A divided country and FDR’s emboldened powerful enemies made the plot to overthrow him seem plausible. With restless uncertainty, volatile protests and ominous threats, America’s right wing was inspired to form its own paramilitary organizations. Militias sprung up throughout the land, their self-described “patriots” chanting: “This is despotism! This is tyranny!”

Members of the Proud Boys are reportedly telling former President Donald Trump to stand back and stand by for a subpoena.
According to New York Times reported Alan Feuer, members of the Proud Boys who have been accused by the government of engaging in a seditious conspiracy are saying they "intend to subpoena Donald Trump as a witness at the trial."

After nine weeks of testimony from multiple government witnesses, including FBI agents, the Justice Department finally concluded its case-in-chief in the Proud Boys’ seditious conspiracy trial on Monday.
... Most of the evidence is nothing more than inflammatory, braggadocious chatter in group texts; Tarrio wasn’t even present at the Capitol on January 6. Another defendant, Ethan Nordean, can be seen on surveillance video walking through an open door as Capitol police stood nearby.
Similar to other so-called “militia” groups tied to January 6, no one brought weapons to the Capitol that day; no one was charged with assaulting police officers or lawmakers. A key piece of evidence that prosecutors claimed was a road map for the “attack” on the Capitol wasn’t produced by any Proud Boy but by a former intelligence asset who himself sent the plan to Tarrio through a third party.
The document represented just one more instance of how a government agent helped shape the government’s narrative that the Proud Boys plotted in advance to carry out an “insurrection” on January 6. In fact, much like the FBI-engineered plan to “kidnap” Michigan Governor Gretchen Whitmer in 2020, court proceedings confirm that FBI assets might outnumber criminal defendants.
At least 10 and possibly up to 15 FBI informants were embedded in the group months before and continuing after the events of January 6. Informants participated in numerous group chats, cozied up to leadership, and even accompanied the Proud Boys to Washington.
One known informant, according to a September 2021 New York Times report, was involved in the first breach of Capitol grounds and entered the building that afternoon.
But prosecutors and Judge Timothy Kelly have tried their best to prevent the public from learning the full scope of the FBI’s involvement. The docket is littered with sealed hearings and filings; prosecutors presented to the defense team heavily redacted reports related to FBI informants just before the trial began.
“Everything has been done under cover,” one defense attorney recently complained in court. A consortium of major news corporations also knocked Kelly this week for holding “sealed hearings and exclud[ing] the press and public from attending proceedings in this high-profile case.”
Kelly also took the highly unusual and prejudicial step of requiring the defense to “pre-clear” questions with prosecutors before asking a witness about the use of informants— but information is slowly trickling as the defense finally gets their turn.
For the second time this month, Kelly suspended the trial on Wednesday after prosecutors confessed that a key witness for the defense, who was scheduled to testify on Thursday, had worked as an FBI informant during the entire investigation. Although prosecutors have known for months that the defense might call this person as a witness, they waited until the last minute to tell defense attorneys, who were blindsided by the news.

Former top national security officials have testified to a federal grand jury that they repeatedly told former President Donald Trump and his allies that the government didn’t have the authority to seize voting machines after the 2020 election, CNN has learned.

Trump’s former national security adviser Robert O’Brien, in a closed-door interview with federal prosecutors earlier this year, also recounted conversations about seizing voting machines after the 2020 election, including during a heated Oval Office meeting that Trump participated in, according to a source familiar with the matter.
Details about the secret grand jury testimony and O’Brien’s interview, neither of which have been previously reported, illustrate how special counsel Jack Smith and his prosecutors are looking at the various ways Trump tried to overturn his electoral loss despite some of his top officials advising him against the ideas.
Now some of those same officials, including Wolf, Cuccinelli and O’Brien, as well as others who have so far refused to testify, may have to return to the grand jury in Washington, DC, to provide additional testimony after a series of pivotal court rulings that were revealed in recent weeks rejected Trump’s claims of executive privilege.
Cuccinelli was spotted going back into the grand jury on Tuesday, April 4.
Without that privilege shield, former officials must answer questions about their interactions and conversations with the former president, including what he was told about the lack of evidence for election fraud and the legal remedies he could pursue.

Trump's indictment accidentally overshadowed a major MAGA development in Michigan.
Tuesday’s indictment of former President Donald Trump for conspiring to overturn the 2020 election overshadowed the announcement of a related indictment that same day in Michigan. Both cases are incredibly important, and Michigan case’s under-the-radar significance should not be overlooked.
A grand jury there charged Matthew DePerno, the November 2022 Republican candidate for state attorney general, with four criminal charges: undue possession of and willfully damaging a voting machine, both five-year felonies, and conspiracy to commit undue possession of a voting machine and false pretenses. In September 2021, Trump endorsed DePerno for attorney general, the state’s top law enforcement position.
The grand jury in Michigan also charged Daire Rendon, a former Republican state representative, with “conspiracy to unlawfully possess a voting machine and using false pretenses ... in unlawfully acquiring one of the machines.”
(Both DePerno and Rendon are of course innocent until proven guilty. DePerno’s attorney told the Detroit News his client “categorically denies any wrongdoing and firmly asserts that these charges are unfounded and lack merit.”)
But this prosecution has implications far beyond Michigan, for three primary reasons.
First, DePerno and Rendon, both vocal 2020 “election deniers,” are alleged to have illegally obtained a voting machine in a wildly ill-advised attempt to prove election fraud that, despite Trump and his allies’ pronouncements, did not exist. A nation that holds secure elections cannot allow self-deputized vigilantes improperly seizing possession of voting machines under false pretenses.

That summer, Milley visited Chiarelli in Washington State and, over breakfast, described what he thought was coming next. “It was unbelievable. This is August 2, 2020, and he laid out in specific detail what his concerns were between August and Inauguration Day. He identified one of his biggest concerns as January 6,” the day the Senate was to meet to certify the election. “It was almost like a crystal ball.”
Chiarelli said that Milley told him it was possible, based on his observations of the president and his advisers, that they would not accept an Election Day loss. Specifically, Milley worried that Trump would trigger a war—an “October surprise”—to create chaotic conditions in the lead-up to the election. Chiarelli mentioned the continuous skirmishes inside the White House between those who were seeking to attack Iran, ostensibly over its nuclear program, and those, like Milley, who could not justify a large-scale preemptive strike.
In the crucial period after his road-to-Damascus conversion, Milley set several goals for himself: keep the U.S. out of reckless, unnecessary wars overseas; maintain the military’s integrity, and his own; and prevent the administration from using the military against the American people. He told uniformed and civilian officials that the military would play no part in any attempt by Trump to illegally remain in office.
The desire on the part of Trump and his loyalists to utilize the Insurrection Act was unabating. Stephen Miller, the Trump adviser whom Milley is said to have called “Rasputin,” was vociferous on this point. Less than a week after George Floyd was murdered, Miller told Trump in an Oval Office meeting, “Mr. President, they are burning America down. Antifa, Black Lives Matter—they’re burning it down. You have an insurrection on your hands. Barbarians are at the gate.”
According to Woodward and Costa in Peril, Milley responded, “Shut the fuck up, Steve.” Then he turned to Trump. “Mr. President, they are not burning it down.”

As Judge Sarah Wallace puts it in her 102-page decision: “The court finds that . . .Trump engaged in an insurrection on January 6, 2021 through incitement, and that the First Amendment does not protect Trump’s speech.”
Thus, the Colorado court has both affirmed the commitment to truth that animates the justice system under the rule of law and set another marker of Trump’s deviation from constitutional governance. The court’s decision makes a record for history.
We now have arguably the most important 14th Amendment ruling about Donald Trump to date. Friday’s decision from Colorado isn't entirely convincing, but its most useful feature may be that it lays the groundwork for the U.S. Supreme Court to weigh in.
Colorado District Judge Sarah Wallace found in her lengthy opinion that Trump engaged in insurrection. That might lead one to think that Trump is therefore barred from the presidency under the Constitution’s insurrection clause. But Wallace also said the president isn’t an “officer” under the provision in question, so, according to the Colorado state judge, Trump isn’t banned from the presidency despite his otherwise unconstitutional behavior. My colleague Hayes Brown explained why it’s a dubious distinction on Wallace’s part.
But the state trial judge won’t have the last word. Importantly, unlike other courts that have punted on the subject recently, Wallace issued an actual ruling, based on facts and evidence, even if her conclusion is wanting. On that note, the Colorado challengers are attacking the “officer” distinction on appeal to the state’s Supreme Court. If they’re successful in doing so — leading to a ruling that Trump is ineligible — then the U.S. Supreme Court will more likely step in to make a definitive, nationwide ruling.
The U.S. justices have discretion over their docket, but they’ll be more likely to review a decision that keeps Trump off the ballot; if a lower federal court or state high court says he can stay on the ballot, then the justices can maintain the status quo by simply rejecting any appeals of such decisions and declining to get involved.
But if the Colorado Supreme Court endorses her insurrection finding yet disagrees with her “officer” rationale on legal grounds, then Wallace’s decision may have been the first step in the issue’s judicial resolution.
