Lt. Gov. Dan Patrick blasts Hidalgo, Turner as 'liars' in fiery press conference on GOP voting bill
(Republicans can get away with bad behavior because there is not one Democrat in Texas who will fight back, other than with words followed by even more words. Texas Lt. Gov. Dan Patrick accused Democrats of “race-baiting” as they fight election bills in the Texas Legislature and said elected officials like Harris County Judge Lina Hidalgo and Houston Mayor Sylvester Turner are lying about what the legislation would do.
“Senate Bill 7 is not voter suppression, it's voter security,” Patrick said during a more than 30-minute press conference in which he repeatedly slammed the media, Harris County officials, American Airlines, Democrats including Beto O’Rourke a “nest of liars” for saying the legislation seeks to disenfranchise people of color.
Patrick aimed his criticism at Harris County officials Hidalgo and Turner who have labeled the legislation as a form of voter suppression.
“They’re lying to you,” Patrick said looking into a bank of television cameras.
The back and forth on the Texas voting bill has escalated since last week as major Texas-based businesses including American Airlines, Southwest and Dell have put out statements of concern about it. That resistance comes as businesses and sports leagues including Major League Baseball oppose voting legislation in Georgia pushed by Republicans that similarly has been called an attempt to suppress the vote, particularly in minority communities that vote overwhelmingly in favor of Democrats.
Patrick’s fiery press conference came less than 24 hours after Hidalgo, Turner and other Harris County officials rallied in opposition to the legislation in Houston. At that event, Hidalgo said Republicans had “bought into a conspiracy theory” about widespread voter fraud, which has never been proven to exist.
Turner used similarly pointed rhetoric, labeling the voting bills “Jim Crow 2.0” and “part of a national campaign to restrict people’s right to vote.”
That brought an at-times angry response from Patrick.
“We must stop this race-baiting on every issue,” Patrick said. “Election security is what the public wants.” (What Patrick meant was that Democrats should lose every election because they won't punch him when he lies.)

Patrick’s reaction to the media only got more intense when he was asked if he was going to pay a million-dollar reward to Pennsylvania Lt. Gov. John Fetterman, who pointed to three cases of election fraud in that state in the 2020 election. All of the cases were filed against Republicans.
Patrick last year offered up $1 million in reward money for those who uncovered voter fraud in the 2020 election. Since then, Fetterman has insisted his state deserves the money since it documented those three cases.
When asked about Fetterman’s claim on Tuesday, Patrick blasted the reporter who asked the question.
“Don’t ask me stupid questions,” Patrick said. “I didn’t come here to take stupid questions from the media.” Nobody punched Patrick in the face for lying about paying a reward. Why would he pay if not paying has no consequences?

The party that celebrated the Citizens United Supreme Court decision that gave corporations and the wealthy almost unlimited influence over elections is suddenly denouncing business leaders for speaking their minds?
I would prefer to write less about politics and more about economics and industry. But we no longer live in an age where commerce and legislating only intersect a few times a year when the chamber of commerce asks for lower taxes and less regulation.
For decades, the GOP presented itself as the party of free markets. Former Gov. Rick Perry spent most of his time focused on lowering taxes, reducing regulations, and attracting corporate relocations. He was focused on business and liked to say that he didn’t leave the Democratic Party; it left him.
The corporate world is beginning to realize the GOP is leaving them, prioritizing culture wars and power-grab politics that average Americans do not countenance. America’s CEOs would not be so woke if Republicans were more moderate and their consumers less terrified.

McConnell’s threat to punish corporations opposing GOP election policies is unconstitutional
As the Supreme Court explained in Perry v. Sindermann (1972), “even though a person has no ‘right’ to a valuable governmental benefit and even though the government may deny him the benefit for any number of reasons, there are some reasons upon which the government may not rely.” Among other things, the government “may not deny a benefit to a person on a basis that infringes his constitutionally protected interests — especially, his interest in freedom of speech.”

The constitutional rule against stripping someone of a government benefit to control their speech stretches back many decades.
California law gave a property tax exemption to honorably discharged World War II veterans. Yet, in 1954, it revised the form that veterans use to claim this exemption to require those veterans to swear a loyalty oath: “I do not advocate the overthrow of the Government of the United States or of the State of California by force or violence or other unlawful means, nor advocate the support of a foreign government against the United States in event of hostilities.”
After some veterans refused to swear this oath, their refusal wound up in the Supreme Court, and the Court ruled in Speiser v. Randall (1958) that these taxpayers “could not be required to execute the declaration as a condition for obtaining a tax exemption or as a condition for the assessor proceeding further in determining whether they were entitled to such an exemption.”
Speiser was a fairly early articulation of what is known as the “Unconstitutional Conditions Doctrine.” Both Congress and the states provide many benefits to individual citizens that are not required by the Constitution — California is not required to give tax breaks to veterans. But once a benefit is offered, the government may not strip someone of that benefit because they exercise their First Amendment rights.

The Big Lie - If voter fraud is an epidemic, why can't Texas find it?
Texas Gov. Greg Abbott declared voter fraud an “epidemic” way back in 2005, when he was still attorney general, and launched a unit to root it out. His successor, Ken Paxton, beefed up his election integrity unit last year, with prosecutors toiling more than 22,000 hours on the taxpayers’ dime hunting for polling improprieties. In November, Lt. Gov. Dan Patrick topped them all by dangling a $1 million bounty, payable from his own campaign account, to anyone who came forward with information leading to a voter fraud conviction.
So, if voter fraud is the scourge of our democracy, if it’s capable of stealing a presidential election, as some claim, if it’s widespread enough to qualify for “emergency” status in the state Legislature to ratchet up voting restrictions, then surely, the proof of its magnitude lies in Texas.
After 15 years of looking for election fraud among the 94 million votes cast in Texas elections since 2005, the Texas Attorney General’s office has dutifully prosecuted all of 155 people. Add to that 19 cases cataloged by the conservative Heritage Foundation, which include federal and county prosecutions, and you get a grand total of 174.
That’s not a typo. It’s not 174,000 or 17,400 or even 1,740. It’s 174 little ol’ Texas souls.
Together, they represent .000185 percent of the total votes cast — or 1 in 540,000 voters. Statistically, voters are more likely to get struck by lightning than to be prosecuted for voter fraud.
Alas, most crimes were so minor that only 33 of the 174 perpetrators went to jail, most for less than a year. An analysis of media accounts and the attorney general’s prosecution records obtained by this editorial board through the Texas Public Information Act shows that most cases ended with plea agreements — pre-trial diversion deals or probation. Of the 33 people who were sentenced to any jail time, none were the criminal masterminds conjured up to instill fear in the hearts of freedom-loving Americans.
Some are felons who were not yet eligible to vote again, a few were small-town politicians falsely registering voters, others filled out another person’s absentee ballot. Only five cases — yes, five out of 94 million — involved voter impersonation at the polls, that near-mythic species of voter fraud that launched Texas’ epic battle for a voter ID law.
So, what of the “epidemic” Abbott declared in 2005? A year later, he had rooted out about a dozen people, mostly Black and Latino seniors, accused of assisting others in casting their absentee ballots — a practice that had been largely allowed until 2004.
And what of Paxton’s beefy voter fraud unit and its 22,000 hours, nearly double the time logged on such cases two years earlier? It resolved only 18 minor cases in 2020, all of them Harris County residents who gave false addresses on their voter registration forms.
We can understand why Texas’ top Republicans want to hide that reality, and the true picture of voter fraud in Texas. It isn’t alarming. It isn’t scary. It doesn’t foment the kind of fear and mistrust in the electoral system that Republicans need to push through onerous voting requirements that disproportionately target minorities, who tend to vote Democratic.

They and all the pioneers of similar all-white political organizations that sprang up in counties across Texas after Reconstruction would see their legacy well-preserved, their cunning strategies of restricting Black and Latino voting access well-heeded.
While they’d probably be flattered to see their protégés still relying on the same pretext they used to suppress minority voting — ‘voter fraud’ — they might wonder why, 100 years later, Texas lawmakers haven’t gotten some new material. And why, after courts have repeatedly debunked the notion of widespread voter fraud, Texans are still falling for it.
But here we are in 2021, with the Texas Senate having just passed SB 7, another attack on ballot access under the guise of “election integrity.” It would ban such threatening practices as voting after 9 p.m., drive-thru voting, and dropping off an absentee ballot in a secure drop box.
For anybody under the impression that President Trump invented the boogeyman of widespread voter fraud, or that maybe Republican strategist Karl Rove dreamed it up after that troubling close call in 2000 between George W. Bush and Al Gore, we’ve got some news for you, and some history.
Texas politicians have been crying voter fraud since at least 1902, when they used it to justify a poll tax. Supporters claimed that charging Black and Mexican-American laborers nearly a whole day’s pay to cast a ballot would make their votes too expensive for their political bosses to buy.
The true intent for the poll tax, according its architect A. W. Terrell, was to “protect the citizen” against “corrupt methods at the polls” and to eliminate “irresponsible voters,” or so he claimed in a 1906 piece published in the Dallas Morning News, headlined “Purity of Ballot.”
For ruling conservatives in this state — first white Democrats, now white Republicans — “voter fraud” is the trusty password that unlocks an arsenal of underhanded, often unconstitutional, tricks to retain political power and keep it out of the hands of those deemed undeserving of a voice and unqualified for a role in governing. Namely, Black and brown folks.
In a chilling exchange cited in the Fifth Circuit’s 2016 opinion on the Texas voter ID law, the court quotes the testimony of Vernon Burton, an historian of the South and race relations, who was asked about Texas’ “stated rationale” for each of its attempts to disenfranchise minority voters.
“What, in your opinion, was the stated rationale for the enactment of all-White primaries in Texas?” an attorney asked.
“The stated rationale was voter fraud,” Burton replied.
And “for the use of secret ballot provisions in Texas?”
“The stated rationale was to prevent voter fraud,” Burton replied.
And “for the use of the poll tax in Texas?”
“The stated rationale by the State was to prevent voter fraud,” Burton replied.
And “for re-registration requirements and voter purges?”
“The stated rationale was voter fraud,” Burton replied.
“Dr. Burton,” the attorney asked, “in your expert opinion, did these devices actually respond to sincere concerns or incidents - incidences of voter fraud?”
“No,” Burton replied.
It’s not that voter fraud didn’t exist in Texas history — it did; see Lyndon Johnson’s 1948 Senate election. But voter fraud in this century is extremely rare: only 174 people have been prosecuted out of 94 million votes since 2005.

Arizona’s Republican-Run Election Audit Is Now Looking for Bamboo-Laced “China Ballots”
On Wednesday, a member of the Arizona election audit team that has been heavily touted by former President Donald Trump revealed that its examination of the 2020 vote in Maricopa County will include a “forensic” analysis of ballots to determine if the paper is made of bamboo—in order to determine whether or not China delivered tens of thousands of fraudulent ballots to tip the state to Joe Biden.
If that sounds much too crazy for an audit that was initiated by the Republican-led Arizona Legislature and whose communications are being spearheaded by the Republican former Secretary of State Ken Bennett, it very much is not.
On Wednesday, audit liaison John Brakey told a reporter from the local CBS affiliate in Phoenix that the audit team was checking to see if 40,000 Biden ballots were smuggled into Arizona from Asia by checking the paper’s fiber to try to detect bamboo:

“There’s accusations that 40,000 ballots were flown in and stuffed into the box and it came from the southeast part of the world, Asia. And what they’re doing is to find out if there’s bamboo in the paper,” Brakey told Dennis Welch of CBS5 News.

Again, is the bamboo analysis truly part of the audit effort? Apparently, it has been from the beginning.
During a press conference for the audit last week, Brakey said what auditors were “looking for is folds in pieces of paper, because there’s a guy who came out and said certain things, that the ballots were stuffed, that we’re going to find bamboo in the paper.”
Bennett, the spokesman for the audit, then confirmed, “We’re evaluating the paper. We’re evaluating the paper.”
Where did this theory—apparently of major concern for the Arizona auditors—that someone in Asia had sent 40,000 ballots to Maricopa County in order to sway the election for Joe Biden and against Donald Trump come from? It appears to have come from an election fraud gadfly named Jovan Pulitzer, who Slate’s Aaron Mak reported earlier this week is supporting the work of the Maricopa audit firm, Cyber Ninjas.
In addition to Pulitzer having claimed to invent a technology that would detect whether a ballot’s ink and folds might indicate forgery, Mak flags that back in December Pulitzer began to espouse a theory that China had imported ballots to tip the election to Biden and that he could detect such malfeasance by uncovering bamboo particles via “a forensic analysis.”

Michael McCaul, a senior US House Republican, told CNN he thought the law in his native Texas “may be more of an optics issue, restoring confidence with with the American people. In my state you actually do believe that there was tremendous fraud.”
Texas has a pending case of possible voter fraud arising from the 2020 election.

Texas Republicans have a simple reason for the broad changes they have proposed to tighten the rules on who can vote when and how: It's the only way to combat rampant election fraud.
No matter what Trump says, there is zero evidence of widespread voter fraud in modern American elections. Like, none.
Trump administration Attorney General Bill Barr late last year: "To date, we have not seen fraud on a scale that could have affected a different outcome in the election."
The man who succeeded Barr in the job -- acting Attorney General Jeffrey Rosen -- said the same in testimony to Congress in May: "During my tenure, DOJ maintained the position publicly announced previously that the Department had been presented with no evidence of widespread voter fraud at a scale sufficient to change the outcome of the 2020 election."
Trump and his legal team filed dozens of cases -- in state and federal courts -- alleging widespread voter fraud. And lost the cases.
Recounts and audits in a variety of states affirmed the original results.
In the 2016 presidential election, there were a total of four documented cases of voter fraud out of more than 135 million votes cast.
In a database of all types of election fraud, there have been 491 cases of reported absentee-ballot fraud since 2000.
Against all of that evidence and data is, well, not much other than Trump's wild accusations and the occasional anecdotal story about how some guy voted twice for Trump.
There's an important point to be made here: An isolated incident of someone voting twice (or trying to) is NOT widespread voter fraud. It is one person acting irresponsibly.
So why are Republicans across the country -- 14 states have passed almost two dozen laws aimed at restricting voting access -- pushing so hard on this issue if it's not to solve the nonexistent problem of widespread voter fraud?
Republican leaders have acknowledged that more voters voting is bad for them. In 2019, Senate Republican Leader Mitch McConnell dismissed the idea of a making Election Day a holiday as a "power grab" by Democrats. In March 2020 Trump told Fox & Friends this: "They had levels of voting, that if you ever agreed to it you'd never have a Republican elected in this country again."
So, yeah. When people tell you who they are and what they are doing believe them -- the first time.

Donald Trump’s speech before the North Carolina Republican Party Saturday night was a reminder of the danger the former President poses as he undermines America’s election system.
At a time when online forums supportive of Trump have touted the deadly military coup in Myanmar as a remedy that should occur in the United States so Trump can be reinstated, recent polling shows that a majority of Republicans believe the 2020 election was stolen despite the fact there is no evidence of widespread voter fraud.
And the former President continued to fan those flames of disinformation on Saturday night, stating that the 2020 election will “go down as the crime of the century.”
“We’re not going to have a country – if you don’t have election integrity, and if you don’t have strong borders, our country can be run like a dictatorship and that’s what they’d like to do,” Trump said. “They want to silence you. They want to silence your voice. Remember, I’m not the one trying to undermine American democracy. I’m the one that’s trying to save it.”
The former President also praised states like Texas, Florida and Georgia that have advanced laws making it harder for Americans to vote – measures that will disproportionately affect Black and Latino Americans.

He criticized Democrats and Republicans for politicizing election reform to seek partisan advantage and urged both sides to work along to find a path forward.
He suggested that the John Lewis Voting Rights Advancement Act is a good starting point to gain bipartisan support for election reform.
The senator also expressed concern over the trend of vying for absolute power over cooperation inside the Beltway.
“It has been said by much wiser people than me that absolute power corrupts absolutely,” he wrote. “Well, what I’ve seen during my time in Washington is that every party in power will always want to exercise absolute power, absolutely.”
After a contentious 2020 election, a number of states started election reform legislature in various forms to guarantee election integrity.
However, Democrats in Washington are aggressively pushing one-sided election reforms in an attempt to codify into law some operations conducted during the last presidential election at the federal level in the For The People Act.
The act would federalize components of the election system, eliminating nearly all requirements for photo identification, require states to offer 15 days of early voting, allow “no-excuse” absentee balloting, require states to implement a system of automatic voter registration, and allow same-day registration on any day voting is allowed.
Senate Majority Leader Chuck Schumer (D-N.Y.) told Democrat colleagues in a memorandum that he will force a Senate vote on the sweeping election reform bill “that is essential to defending our democracy, reducing the influence of dark money and powerful special interests, and stopping the wave of Republican voter suppression happening in states across the country.”
The bill is expected to get little, if any, support from the Republican side.
Senate Republican leader Mitch McConnell (R-Ky.) has promised to block the bill, which he characterizes as undue government overreach into state election systems. He said no GOP senators support it.
Sen. Cindy Hyde-Smith (R-Miss.) has described the bill as “a massive federal takeover of elections.”
Manchin’s objection will dim Democrats’ hope of passing it in the Senate, which is split 50-50, even without the filibuster.
The Epoch Times reached out to Schumer’s officer for comment.
The House version of the For The People Act, H.R. 1, was passed in March.
All Republicans and one Democrat, Rep. Bennie G. Thompson (D-Miss.), voted against the bill.
Critics have promised to bring a flood of lawsuits if it’s passed by the Senate and signed into law by President Joe Biden.
“There are a number of constitutional infirmities and deficiencies that stem from its treatment of presidential and congressional elections identically, even though Congress has vastly reduced powers to regulate presidential elections under the Constitution,” Jason Snead, executive director of the Honest Elections Project, told reporters.

What was the result? How an American nightmare will become real
It is so obvious where all of this is heading. President Trump tells a big lie that elections are rigged. This authorizes him and others to seek power in extra-democratic ways. The lie is institutionalized by state legislation that suppresses voting, and that gives state legislatures themselves the right to decide how to allocate the electoral vote in presidential elections.
The scenario then goes like this. The Republicans win back the House and Senate in 2022, in part thanks to voter suppression. The Republican candidate in 2024 loses the popular vote by several million and the electoral vote by the margin of a few states. State legislatures, claiming fraud, alter the electoral count vote. The House and Senate accept that altered count. The losing candidate becomes the president. We no longer have “democratically elected government.”
No one is seeking to hide that this is the plan. It is right there out in the open. The prospective Republican candidates for 2024, Donald Trump, Ted Cruz, and Josh Hawley, are all running on a big lie platform. If your platform is that elections do not work, you are saying that you intend to come to power some other way. The big lie is designed not to win an election, but to discredit one. Any candidate who tells it is alienating most Americans, and preparing a minority for a scenario where fraud is claimed. This is just what Trump tried in 2020, and it led to a coup attempt in January 2021. It will be worse in January 2025.
9/11 led us to the invasion of Iraq, the foreign policy disaster that marked our century. 1/6 leads us to a catastrophe on that scale, but inside our own country. It is not at all clear that the plan to take power undemocratically will work, but it is clear that it will generate a lot of resistance. African Americans are right now being told the absurd lie that the problem in America is that it is too easy for them to vote. As the scenario plays out, all Americans will face an open denial of everything they have been told about their country.
When Trump told his big lie, the airplane hit the building.
The anti-voter laws proposed and passed by Republican state legislatures around the country move the scenario to its next step. Halting them might well be the only way to halt the scenario as a whole. As such, Manchin’s desires are the subject of daily speculation and the vessel into which his party has projected a mix of hope and rage.
It would be a relief of sorts if Manchin would simply tell us what he wants. The problem is that his statements frequently conflict with each other. (On infrastructure, he has alternatively demanded that the bill be enormous, that it be fully paid for, and obtain Republican support, all of which are individually difficult and collectively impossible.) The internal contradiction of Manchin’s position is summarized in the first two sentences. Here we have two values in conflict: the right to vote, and the evil of partisan voting laws. Manchin claims the first to be “fundamental,” but if he is unwilling to violate the second value to secure it, then it clearly isn’t.

In the final days of President Donald Trump’s time in office, his chief of staff sent five emails to the acting attorney general designed to pressure the nation’s top cop to investigate a series of ridiculous claims of election fraud in the 2020 election – among them that Italy had deployed technology that somehow switched votes from Trump to Joe Biden.
No, that sentence above isn’t parody although it reads like it. It is fact – first reported by The New York Times on Saturday and then confirmed by CNN. That actually happened. In the United States of America. In 2021 (and in late 2020).
What’s stunning to me is that this isn’t a bigger story.
Consider, again, what we are talking about: The top aide to the President of the United States tried to get the head of the Department of Justice to launch investigations into appallingly ridiculous election fraud claims solely because the aforementioned President couldn’t (and can’t) accept that he lost the 2020 election.
That these efforts came in the run-up to the violent insurrection at the US Capitol on January 6, which left more than 100 police officers injured and five people dead, make them all the more appalling. As Trump was publicly fomenting doubt in the election results – via a series of failed lawsuits and debunked conspiracy theories – his chief of staff was working privately to cajole the nation’s chief law enforcement official to resuscitate these fallacies in order to please Trump.
Illinois Sen. Dick Durbin, the Democratic chairman of the Senate Judiciary Committee, got it right when he said Meadows’ pressure campaign “underscores the depths of the White House’s efforts to co-opt the department and influence the electoral vote certification. This is a five alarm fire for our democracy.”
