Representatives of the U.S. Postal Service were called before a federal judge on Wednesday after the agency’s failure to comply with a court-ordered sweep of facilities to locate some 300,000 ballots that had reportedly entered the postal system and not been scanned for delivery to election authorities.

It looks like there may be 300,000 missing mail ballots. The mail in ballots seem to be breaking hard for Biden. This is an interesting development. It may go long, but those votes need to be counted.

It’s a scenario election-monitors have warned of for months: the results of Tuesday’s nail-biter remain uncertain on Wednesday, with large swaths of mail-in ballots still uncounted in critical areas like Philadelphia and Detroit. Despite that, President Donald Trump declared victory in an early-morning announcement, threatening to call on a Supreme Court dominated by conservatives to stop remaining votes from being counted. Trump also took to Twitter in a since-flagged post, baselessly accusing Democrats of “trying to STEAL the Election.”
The remark served as a growing rallying cry among a far-right audience that, for months, has been primed—by Trump, and by the most compartmentalized media apparatus imaginable—to cry fraud over any result besides a Trump victory.

In a late-night speech from the White House, President Trump declared the plan he has been openly signaling for weeks: He hopes to steal the 2020 election by prematurely declaring himself the winner and halting the tabulation of outstanding ballots that, if counted, would give Joe Biden a strong chance of victory.
Trump’s argument is simple and farcical. In states where Trump trails, like Arizona, he urges that more votes should be counted and that he will probably win. (Fox News has called Arizona for Biden, a projection that was followed up around 3 a.m. by the Associated Press.) In states where Trump leads, no more votes should be counted. Trump on Georgia, where his opponent is slightly favored to pull ahead by projections: “They’re never gonna catch us, they can’t catch us.” There is no principle here more sophisticated than “Heads I win, tails you lose.”
“We were getting ready for a big celebration … all of a sudden it was just called off,” the president complained, when “a very sad group of people is trying to disenfranchise that group of people [who supported him]. We won’t stand for it … We were winning everything and all of a sudden it was just called off.” This is a completely fantastical description bearing no relation to what happened. As analysts have predicted for weeks, late-arriving ballots favored Joe Biden and have eaten into Trump’s early lead.

State data initially showed Trump had almost 108,000 votes in Chester County, just ahead of Biden’s 106,000. But just 38% of some 146,000 mail ballots received by officials there had been counted.
Chester County updated the count Wednesday morning, and Biden had pulled ahead with about 130,000 votes, compared to Trump’s 113,000 — a 7 percentage point advantage for the former vice president.

Trump made premature declarations of victory, put forth false claims of fraud, sued to stop ballot counts in places where he was trailing, and pushed for states where he still had a chance to not be called until more votes were in.
On Wednesday afternoon, Trump campaign officials held a press call with reporters in which they repeated the president’s claim that he had already won. “We are declaring a victory in Pennsylvania,” campaign manager Bill Stepien said. At the time, hundreds of thousands of mail-in votes in largely Democratic areas still had not been counted. But Stepien claimed that counting those ballots would be theft, saying the campaign had sent Rudy Giuliani to Philadelphia “to ensure that we don’t see magical ballots delivered by Gov. [Tom] Wolf, that this margin of victory that we are certain of is not stolen by the Democrats and stolen by Joe Biden.” By Wednesday evening, after a day of local officials slowly but steadily tallying the votes, Trump’s once sizable lead had shrunk considerably.
