Ginsberg Dies, Trump Is President

She was age 87. She reportedly told her family that she wants the world to wait until a Dem President is elected before her replacement is selected. As always, she want the Constitution to be warped to conform to her whims and delusions.


So back in reality, Trump is President. The Senate is GOP controlled. Trump has already gone through the long-list and short-list processes several times, so they could be ready to go, or just updated.
If a new Justice is selected and seated, then will that be incentive to vote for Trump, or will his purpose be fulfilled for many voters?
The other Libtards on SCOTUS are young enough that they will be there forever, corrupting the legal standards.
Would a seating of Justice be a dis-incentive to vote for Trump?

I was thinking the same thing, to be honest...

I hadn't heard about it until my old man told me late last night. The first thing I told him was that I don't know if this is a good or a bad thing because replacing Ginsberg was 50% of the reason to vote for Trump.

But then I realized that a majority of voters on both sides are very low info and probably don't even think about anything like this unless one of the evil talking heads on either side brings it up and it will probably have very little net effect on the results.


Two more justices are very, very old. 4 years is a long time. Make sure you vote.

If You Care About the Court, Don’t Talk About It
Fixating on the open Supreme Court seat will provoke a culture war.

I know that Ruth Bader Ginsburg’s empty Supreme Court seat has provoked an epic, long-awaited clash between Democrats and Republicans, that the very principle of judicial independence hangs dangerously in the balance. But Democrats should not spend the weeks between now and November talking solely about the Supreme Court.

Why? Fixating on the Court organizes the electorate along two fronts of a culture war, and forces people to make stark ideological choices. Instead of focusing voters on the president’s failure to control COVID-19 or the consequent economic collapse, the culture war makes voters think only of their deepest tribal identities. To put it differently: Americans who define themselves as “pro-life” or as socially conservative might consider voting for Joe Biden if the issue at stake is the botched pandemic response. If the issue is conservative judges versus liberal judges, then they may stick with the Republicans.

Given the quirks of the American electoral system, these undecided voters matter, even more than the fired-up, well-organized inhabitants of liberal enclaves. The Democratic base may now be making record donations to Democratic campaigns, but if money was the only thing that mattered, Jeb Bush would be president. On its own, the Democratic base can’t determine the outcome of presidential elections, let alone the Senate majority. These contests are settled in a small number of states by a tiny number of independents and disillusioned partisans, the kinds of voters who used to be “Reagan Democrats,” but who now might become “Biden Republicans.” And they may well be spooked by the prospect of “liberal judges,” a phrase designed to evoke lawlessness, degeneracy, and disorder.

The Republican Party knows how to use polarizing rhetoric to split people along tribal lines. Donald Trump spent most of the 2018 midterm campaign talking up the “caravan,” the Central American refugees who were marching toward the U.S. border seeking asylum. Their numbers were small to begin with, and they dwindled further as they neared the border. Nonetheless, they made a useful talking point for Republicans, who wanted to remind their base on which side of the ideological divide they belonged. When Trump sent the U.S. military to the border, the subsequent outrage was justified, but it was also a trap: It drew attention away from real-life issues and encouraged voters to think they had to make a false choice between the caravan, crime, and illegal immigration on the one hand, and tradition, safety, and law and order on the other.

In a few key states, that gimmick worked. “The caravan helped him,” former Senator Claire McCaskill of Missouri bluntly said after she lost to Josh Hawley, a Republican.

Inciting a culture war didn’t work everywhere. And in places where it didn’t—in all those suburban House seats won by centrist Democrats, for example—that was often not because candidates loudly denounced the president’s use of troops at the border, but because they changed the subject. When undecided voters were thinking about jobs and health care, they were prepared to break their habits and vote for Democrats.

Democratic politicians and activists, and even ordinary voters who use social media, should concentrate as much as they can on the tangible issues that people grapple with every day — why their children aren’t in school, why their business has shut down, why their health-care plan is insufficient, why 200,000 people have died — and why the choice of president affects those issues so profoundly.

Why does Trump need to replace Ginsberg immediately? With less than six weeks to go before Election Day, and with over 250 election lawsuits filed across 45 states, the litigation strategy of the Trump campaign has become clear: create enough chaos in the system and legal and political uncertainty in the results that the Supreme Court can throw the election to Trump if the outcome is at all close or in doubt. Remember the 2000 election decided by the Supreme Court? America is going there again, but this time it will be cases from 45 states, not just Florida. Trump needs at least another Supreme Court justice to win this election, since Chief Justice John Roberts might not automatically side with Trump. Trump's preemptive arson attack on the vote count in 45 states is a five-alarm fire for democracy. Trump doesn't want Justice Roberts to extinguish the conflagration Trump ignited. Trump needs an extra Justice he can depend on to pour more gasoline on the flames.

Trump says Supreme Court will need 9th justice to decide election outcome

Trump has already planned on taking the election to a GOP controlled Court because he is crooked:

President Donald Trump on Wednesday suggested the Supreme Court will have to make a ruling on the Nov. 3 presidential election, so a new justice for the high court should be confirmed before Election Day.

“I think it’s better if you go before the election, because I think this scam that the Democrats are pulling — it’s a scam — the scam will be before the United States Supreme Court,” Trump told reporters at the White House, in an apparent reference to efforts to increase mail-in voting during the coronavirus pandemic.

“I think having a 4-4 situation is not a good situation, if you get that. I don’t know that you’d get that. I think it should be 8-0 or 9-0, but just in case it would be more political than it should be, I think it’s very important to have a ninth justice.”

The president has frequently made unsubstantiated claims about fraud with mail-in ballots, and experts have been pushing back.

“I want people to know many of us, and I’m one of them, have looked into vote fraud for decades, and there are certainly isolated examples, but it’s just not there. This is made up. It is a fiction,” said Larry Sabato, director of the University of Virginia’s Center for Politics. It is fact, not fiction, Trump is a crook.

But he definitely stole something because he refused, after the election, to keep his promises to publicize his income tax returns. The very best way for Trump to hold on to what he stole is to control the Supreme Court, which has recently allowed him to delay publicizing his income tax returns. With Ginsberg replaced, maybe the Supreme Court will allow Trump to permanently keep his taxes a secret.

How we define the truth matters, especially for someone serving on the supreme court.

Barrett’s anti-abortion views have come to bear in public stances. In 2015, she signed a letter to Catholic bishops affirming the value of “life from conception” alongside prominent anti-choice figures such as Marjorie Dannenfeiser, president of anti-choice fundraising organization the Susan B Anthony List. As a law professor at Notre Dame, Barrett was a member of the anti-abortion group University Faculty for Life, and in 2006, she signed a paid ad in a South Bend newspaper that called for “an end to the barbaric legacy of Roe v Wade". In 2013, she delivered two talks to anti-abortion student groups at Notre Dame. Barrett has also been critical of the Affordable Care Act guarantee that requires employers to provide birth control to their employees.

Like the late Justice Scalia, for whom she clerked, Barrett is a self-described textualist and originalist; she interprets the US constitution based on its plain language and an attempted understanding of the intent and mindset of the original drafters. Barrett has also written that, in her view, it is appropriate and legitimate for judges to overturn precedents when they conflict with their personal interpretation of the constitution.

I have a problem when evidence exists, in words and actions, that her faith paired with her legal theory might compel her to make decisions that would negatively impact the lives, agency and wellbeing of generations of Americans.

Since the early 1970s, Mr. Koch has sought to dismantle most federal regulatory institutions, and the federal courts have been central to that battle. In 1974, Mr. Koch gave a blistering speech to a libertarian think tank, called the Institute for Humane Studies, in which he outlined his vision of the American regulatory state, and the strategy he would employ over the ensuing decades to realize that vision. Amy Coney Barrett's Supreme Court hearing is a formality, but Democrats have one last card. Here is how to play that card:

Every day in 2016, Trump seemed to do something crazier and more extreme than the last. Instead of being a blessing, it ended up luring us into a game of self-defeating political whack-a-mole, pushing dozens of different messages against Trump that never really had a chance to take hold with the public. On the other side, Republicans were able to prosecute a single message that involved Hillary Clinton's emails. And we all know which one proved more effective.

We need to apply the lessons from 2016 to this fight and hit Senate Republicans where it hurts — over and over again. That means pushing a single, clear message that anyone who votes to confirm Barrett is really voting to take away millions of Americans' health care in the middle of a pandemic.

If we make it that simple, we can make it really difficult for Trump and Mitch McConnell.

Judge Amy Coney Barrett on the Supreme Court is Charles Koch's goal. Do you not realize that someone in your lowly position has surrendered to Koch? First, you gave away your life to people who employed you. They could do what they want to you while you are their employee. You avoid that by being unemployed. Despite her efforts to tell the committee as little as possible about her beliefs, Barrett revealed an enormous amount about her judicial philosophy. In her opening statement on Monday, she told the committee that “courts are not designed to solve every problem or right every wrong in our public life.”

After some close questioning it became evident that meant the real-world consequences of the decisions she will make should not be relevant to her, the Senate, or the general public. If Barrett's decision means 20 million Americans lose their health coverage and 100 million people lose their protections for preexisting conditions, Barrett does not care because she has higher and very abstract values she will be upholding once on the Supreme Court. She figuratively told the Democrats that it was too goddamn bad if they don't like it because she is gonna do it whether they like it or not.

Barrett, without notes, said she did not remember that timing of her article—and Harris followed up that it was published in January 2017—and Trump nominated Barrett in May 2017.

I make $4,500 last an entire year, with ease, without wanting for anything.

That says nothing of what my income is now, or has been in the past.

The trouble with explaining a complicated network of influence is that it starts to sound, well, conspiratorial. That’s because these are actual, well, conspiracies! And there are a lot of confusing moving parts!

Cruz and Graham did not look happy with Whitehouse. Republican senators strive to keep these hearings high-minded and abstract; see Republicans Mike Lee and Ben Sasse’s civics lessons about how the Constitution clearly says only Republicans are allowed to appoint Supreme Court justices. Whitehouse didn’t even bother to play their game. He just showed us who’s funding it.

it’s all too easy for Republicans to simply dismiss Whitehouse as a conspiracy theorist. Republicans do have a dark-money network that they tap to fund these judicial confirmation battles. But it’s opaque and contorted—by design, because that’s how dark money works. The donors don’t want the American people to know they’re pouring tens of millions of dollars into these battles. So they (legally) launder their money through phony nonprofits. And that, at bottom, was what Whitehouse was trying to explain with his big red Sharpie.

While much of the coverage of the hearings have focused on the important issue of preexisting conditions and the ACA, I think that more attention needs to be focused on statements made during Sen. Duck Durbin and Sen. Amy Klobuchar’s questioning. During their questioning, they pointed out that Amy Coney Barrett wrote in a court opinion, unrelated to voting rights, that it should be easier to take away someone’s voting rights than to take away their right to own a gun. As Amy Klobuchar pointed out, she had even stated that only “virtuous” citizens should have the right to vote. Since she refused to answer Klubuchar’s question about what “virtuous” actually meant, we are forced to wonder who she might deem unworthy of voting.

Considering her extreme fundamentalist religious views that are out of step with the American populace, it is likely her definition of virtue is far different than most Americans’. In fact, in one ruling from her past, she had claimed there was no evidence that the use of the n-word “created a hostile or abusive working environment”. So it seems what most Americans would consider to be overt racism and categorically unacceptable, somehow gets by that virtue test.

Another point highlighted by Sen. Klobuchar was the well-understood role of Congress in setting standards to ensure voting rights across the nation, which Barrett seems to reject, instead favoring unmitigated “states rights” in deciding who should and shouldn’t get the right to vote. This comes just a couple years after much of the voting rights act was stripped away and amid the decades-long practice of republicans purging black voters from the rolls and closing polling places in poor areas. Plain and simple, republicans have made it clear through their actions that they have no interest in letting Black Americans vote, in fact as some courts have said they have been targeting Black voters with “surgical” precision in their purges. This context makes it very clear that Amy Coney Barrett has no problem letting states keep Black people from voting. In my view when she says “virtuous” citizens should be the only ones voting, she may as well be saying “white”.
