Supreme Court Chief Justice John Roberts has tried to keep the Supreme Court above the Partisan Fray. Confirming Kavanaugh would deal “a significant blow to the perceived legitimacy and integrity of the court.”

During a case last year involving gerrymandering, John Roberts said that if the court issued a ruling that favored the Democratic Party, people would ask, “Well, why did the Democrats win?…It must be because the Supreme Court preferred the Democrats over the Republicans.” A partisan reputation, he insisted, “is going to cause very serious harm to the status and integrity of the decisions of this court in the eyes of the country.” Since his appointment as chief justice in 2005, Roberts has also expressed concern that “partisan hostility” during Supreme Court confirmation hearings threatens the court’s integrity.

It was hard not to wonder what he was thinking during Thursday’s Supreme Court confirmation hearing, when the most vocal partisan hostility was coming from the nominee himself, Brett Kavanaugh. John Roberts has done quite a bit to try to lift up the institution as a fair and neutral place to bring claims. Kavanaugh’s partisan outburst during his testimony before the Senate Judiciary Committee has raised the possibility that Congress will confirm the most openly politically biased Supreme Court justice in modern history. His addition to the court threatens to undermine public confidence in an institution already struggling under criticism that it’s a captured agency, dancing to special-interest tunes.

Once upon a time, I had a personality test done at work; it was for us to understand our personalities and approaches in the hope that we would work better together, and one aspect of my personality is that I like to consider ALL possibilities before making a decision. I think that is why I'm one of the people here saying ... Don't rush to judgment ... which it seems MOST people are intent on doing. But IMHO as long as there are equally-possible scenarios which explain events and EVIDENCE doesn't definitively point us in one direction or another then we should withhold judgment until better information comes along. For example there are women who said that Kavanaugh did (or may have) sexually assaulted them, but there are people who were there - pointed out as witnesses or friends by the self-proclaimed victims - who said HUH?? I don't even know you or I don't remember any such thing.

How to account for these accusations - and lack of corroboration?

Well, it DOES seem that there was a lot of drinking going on. That's one thing that people agree on. So it's very possible that these things happened, but unless they happened TO YOU, nobody would notice or remember out of sheer drunkneness. Possibly these events happened but the witnesses were also complicit, or don't want to get tainted/involved, and are backing away from the story.

It's also possible that the victims simply mis-remember; even THEIR memories are fragmentary, and piecing together fragile impressions warps them in some way (See FALSE MEMORY) especially if you combine it with a ideological motivation to put someone's face in the picture as the attacker. Or maybe the self-proclaimed victims are looking to make money or are attention-seeking.

At this point ... especially with the denials/lack of corroboration of the potential witnesses who were supposedly involved ... the evidence is equivocal.

There's ONE thing that I wouldn't rely on, however... people who "talked about" an event but who didn't witness it PERSONALLY. Unless YOU WERE THERE or there was a POLICE REPORT filed, hearsay shouldn't count.

I know how stories can run like wildfire and get completely overblown in the process; seen it happen at work and the inet only makes it worse.

In fact, I have a funny story about that. Maybe later.

And now for the funny story.

I did something at work that could have gotten me in hot water. I was talking with a guy, let's call him YYYY, in another department about how rumors can spread with NOTHING behind them because he was saying that with so many rumors about *** that there must be something behind them.

So I bet him that I could start a rumor about HIM. Now, you have to realize that this was one straight-laced guy. He was married, always talked about his family, worked hard at work and was very concerned about doing the job right, did at lot at home (he said), never drank to excess that I saw or heard of, never even swore that I heard (said "gosh" in private conversation when I might have said something stronger), never made a pass at anyone ... And just to add to the straightlaced impression that others had of him, he was Japanese, which many people interpret as being particularly polite

There's word that there will be an investigation into how this was handled, and how the information was leaked. I'd be more than a little worried about that if I was Feinstein. Unlike a 30+ year old rape investigation that has no corroborating witnesses, this would have happened only a few months back and there will be plenty of electronic evidence of it taking place if it did.

I'm glad Ford is going to get 3/4 of a million dollars at this point. Her family shouldn't have to pay for any security costs either. The Dems in power shamelessly used her and put her in that position. If the investigation shows wrong doing, those involved should be removed from their positions immediately, and the Ford's security costs should be paid for out of their pensions.

But it’s pretty clear that a key driver of pro-Kavanaugh sentiment from the grassroots to the White House and, likely, to Kavanaugh himself is simply a conviction that what Ford said he did is not seriously wrong.

Kevin Cramer (R-ND), currently a candidate for US Senate, is one of the few to actually say what conservatives largely seem to think about this: that since Ford got away, it’s essentially a “no harm, no foul” situation. Cramer called the Kavanaugh accusation "absurd" because they were drunk and assault attempt "never went anywhere."

CNN ran a telling segment featuring Republicans who simultaneously maintained that Ford’s accusations were an outrageous smear campaign and that Kavanaugh is merely accused of doing things that every boy does.

You are not just a little bit wrong, Signym. I don't see him as guilty of a 35 year old crime. But Kavanaugh did make a decision last week to handle these allegations from day one with angry denials and weird dissembling. Kavanaugh made statements highly hostile toward all Democrats in general, while Chief Justice John Roberts wants his court to be non-partisan. The future Justice Kavanaugh could be making angry denials and weird dissembling about his written Supreme Court opinions when he is accused in the future of being highly partisan instead of highly learned about law.

Judge Kavanaugh is certainly guilty of Colluding with the biggest Enemy the Democraps have! Oh, I remember reading that criticism of Thomas many many years ago ... a history of his votes and how closely they mirrored Scalia's, along with an analysis of his written opinions. In fact, at the time of that analysis, I believe he had written ZERO opinions; altho I could be wrong. Over the years, whenever a SC ruling came down, I never found any reason to change that opinion of Thomas. You never hear his opinions quoted, for example.

Once upon a time, I had a personality test done at work; it was for us to understand our personalities and approaches in the hope that we would work better together, and one aspect of my personality is that I like to consider ALL possibilities before making a decision. I think that is why I'm one of the people here saying ... Don't rush to judgment ... which it seems MOST people are intent on doing. But IMHO as long as there are equally-possible scenarios which explain events and EVIDENCE doesn't definitively point us in one direction or another then we should withhold judgment until better information comes along. For example there are women who said that Kavanaugh did (or may have) sexually assaulted them, but there are people who were there - pointed out as witnesses or friends by the self-proclaimed victims - who said HUH?? I don't even know you or I don't remember any such thing.

How to account for these accusations - and lack of corroboration?

Well, it DOES seem that there was a lot of drinking going on. That's one thing that people agree on. So it's very possible that these things happened, but unless they happened TO YOU, nobody would notice or remember out of sheer drunkneness. Possibly these events happened but the witnesses were also complicit, or don't want to get tainted/involved, and are backing away from the story.

It's also possible that the victims simply mis-remember; even THEIR memories are fragmentary, and piecing together fragile impressions warps them in some way (See FALSE MEMORY) especially if you combine it with a ideological motivation to put someone's face in the picture as the attacker. Or maybe the self-proclaimed victims are looking to make money or are attention-seeking.

At this point ... especially with the denials/lack of corroboration of the potential witnesses who were supposedly involved ... the evidence is equivocal.

There's ONE thing that I wouldn't rely on, however... people who "talked about" an event but who didn't witness it PERSONALLY. Unless YOU WERE THERE or there was a POLICE REPORT filed, hearsay shouldn't count.

I know how stories can run like wildfire and get completely overblown in the process; seen it happen at work and the inet only makes it worse.

In fact, I have a funny story about that. Maybe later.

Rather, it’s whether Kavanaugh has shown a level of candor in the present about all this stuff (never mind his angry partisanship and openly displayed contempt for the critical role that opposition lawmakers play in this process) that we expect in a Supreme Court justice.

Kavanaugh defenders who have addressed that question point out that he admitted to drinking. But this doesn’t get Kavanaugh off that particular hook: All of this new information, on top of other things we’ve already learned, credibly indicate that he blatantly falsified multiple aspects of his conduct in a highly specific way. Undecided senators need to decide whether Kavanaugh has really demonstrated the integrity — and respect for the vetting process — that this position, with all the influence it wields over American life, and all the judiciousness and deliberative qualities we expect from those on the high court, demands.

Lying doesn't disqualify politicians, but Kavanaugh isn't a politician. He's a law technician, where lying his head off should disqualify him.

It won't make a difference. A while ago I asked the question 'what will happen if the FBI finds nothing?' Because I suspected that - as is proving to be the case - people will find a way to cling to the narrative they hold so dear, despite a lack of evidence.

Hey SECOND, BUSH proposed the "Patriot Act"; it was passed by Congress. BUSH started warrantless surveillance by tapping into the AT&T exchange in San Francisco (I posted about it at the time). BUSH also eliminated the concept of habeas corpus (Military commissions Act 2006).

OBAMA expanded the warrantless surveillance to include, well, everyone. In addition, he held Star Chamber proceedings and developed a "kill list" for a secret drone strike program (commanded by the CIA) which included an American citizen. So much for jury trials!!

Congresspeople of BOTH parties and Presidents of BOTH parties have torn up the Constitution, irrespective of who was on the Supreme Court.

Kavanaugh will likely be confirmed.

Get over it.

The focus now should be on Congress. If Congress writes explicit, comprehensive, proactive laws which protect the rights of ALL Americans and which benefit working Americans ... or if Congress REPEALS or FAILS TO EXTEND destructive laws ... or responds adequately to Executive Orders ... then it doesn't matter WHO is on the Supreme Court.

Can we count on Dems to do that? Or will they continue with their divisive identity politics and paranoid focus on other nations?

But it will make a difference.

Sure, some "people" will cling to that narrative, but those same people wouldn't have been dissuaded even if time machines were real and you could take them back in time to witness nothing happening. The exact same could be said about some people on the other side who would deny what they saw if you could go back and show them the events going down exactly as alleged.

These people on either side are the extreme minority in the country.

On any given night only about 2 to 3% of the people in America are watching one of the Cable News Networks. Nobody could say that ALL of people tuning in all the time are extremists on either sides, but they are the ones most likely to be.


I'm starting to believe that most people are somewhere in the middle, they are rational, and they don't like being dictated to by anybody how they should think and feel about anything.


What we need are the facts. There needs to be a lot more transparency in the government that is supposed to be serving the people. There absolutely should be a complete and unredacted FBI report regarding this investigation after what the MSM has put the people through the last few weeks over the issue.

Sure, some "people" will cling to that narrative, but those same people wouldn't have been dissuaded even if time machines were real and you could take them back in time to witness nothing happening. The exact same could be said about some people on the other side who would deny what they saw if you could go back and show them the events going down exactly as alleged.

These people on either side are the extreme minority in the country.

On any given night only about 2 to 3% of the people in America are watching one of the Cable News Networks. Nobody could say that ALL of people tuning in all the time are extremists on either sides, but they are the ones most likely to be.


I'm starting to believe that most people are somewhere in the middle, they are rational, and they don't like being dictated to by anybody how they should think and feel about anything.


What we need are the facts. There needs to be a lot more transparency in the government that is supposed to be serving the people. There absolutely should be a complete and unredacted FBI report regarding this investigation after what the MSM has put the people through the last few weeks over the issue.

The democrats have a long history of failures starting in 1995 that brought us to this point. Despite that history, the party doesn't seem to feel the need to do anything different.

With the brief exception 2007 through 2011, republicans have held the House of Representatives since 1995. (Before that, democrats held the House nearly continuously for 60 years.)

In 2011 governorships flipped to republicans 29 to democrats 20 and one independent; the current number is now republicans 33, democrats 16, and one independent.

In 2015 democrats lost the Senate.

Democrats lost the presidency in the 2016 elections.



With the brief exception 2007 through 2011, republicans have held the House of Representatives since 1995. Before that, Democrats held the house nearly continuously since 1935.

I agree with you completely! But facts don't change minds that are already made up. If anything, people will dig in deeper to reduce the discomfort of 'cognitive dissonance'.

Perhaps if the government and the media started the process of transparency, over time it would engender trust. Perhaps people would be more willing to listen to and credit facts over narratives. Maybe, over time, it would change the nature of our politics.

In this IMMEDIATE timeframe, though, I'm not sure if it would help.

BTW, one thing I do find fault with is the characterization of the FBI's efforts as an 'investigation', which gives people the idea that the FBI is looking for any criminal activity. It's more like a deep pre-employment vetting.

The only thing that might stop a Kavanaugh appointment are $wildcard$ republicans who might vote against the party line.

Stevens had praised Kavanaugh and one of his rulings in his 2014 book, “Six Amendments: How and Why We Should Change the Constitution.” He said at the time that he thought Kavanaugh “had the qualifications for the Supreme Court should he be selected.”

“I’ve changed my views for reasons that have no relationship to his intellectual ability,” Stevens said on Thursday, referring to Kavanaugh’s temperament.

Stevens, 98, who was appointed by President Gerald Ford, said he believed that lawmakers should take into account the criticism of Kavanaugh’s testimony.

My argument with how the narrative has shifted from "He's Guilty!" to "He's not fit to be a judge" is this:

No judge on the Supreme Court has ever been defending his or herself in front of a world-wide audience against alleged crimes that are of a caliber one step below murder itself.

I'm betting that most Americans couldn't name two Supreme Court Justices, let alone all of them. But everybody knows Kavanaugh's name now.

This man is going to be judged for the rest of his life. He knows that, yet he still wants the job. I think that says a lot about his character, or at least puts into question anybody's personal opinions about his "job interview" performance.


Stick with his previous stances on issues as a reason that he shouldn't be sworn in. This is just background noise.

And for a day or two I'm going to have fun rubbing it in RF's face, and there are going to be jokes at T's expense about his "tick tock"... but then there will be the sobering realization that the Patriot Act just got stronger and we've got another two years of a Trump administration with a GOP majority in the other two branches.

They didn't have the votes to defeat Kavanaugh. They probably never WOULD get the votes to defeat Kavanaugh, no matter WHAT they did.

But when you can't get results, you can always take a stand.

So what did the Dems "stand for"? A last-minute smear campaign? Guilty until proven innocent? More "identity politics"?

They COULD have pounded on issues they thought were important ... privacy. Roe v Wade. Individuals over corporations.

When people looked back on the proceedings they might have remembered ... Hey, the Dems stood up for me. They might have failed but at least I can count on them next time.

Instead, I think a lot of people are just left with a bad taste in their mouths, having been (once again) pitted against each other, women against men, when we could all be standing up for fairness.

For the record, I oppose Kavanaugh because he would represent his politics, which I disagree with, rather than the law.

That said, I find myself having to find fault with the democrats for this whole fiasco.

The 'democratic' (ie big money, back-room) party has been retrenching since 1995 when they lost the House of Representatives. And instead of trying to figure out what they were doing wrong - and fixing it - they continued on with 'business' as usual. Now they are without a single majority claim to government.

And they are STILL playing politics. Somebody should tell them that that stopped working 23 years ago, because they have yet to clue in.

As a retrospective on the 2016 election ... for a brief moment, Bill at least mouthed a good game: "it's the economy, stupid". That would have been a good theme for Hillary as well. But instead of going with what worked, the party went with 'identity politics'. Why? Did they really believe that people were happy with the lack of full-time jobs with decent pay? Did they think they were going to pull the wool over everyone's eyes with a Gish-gallop of multitudes of victim-hood?

I agree with Signy. You can tell what democrats stand for by noticing what they fail to do. And people have been noticing.

That the 'democratic' party is where it is - that's on them.

The sheer scope of Kavanaugh’s dishonesty under oath has been detailed in numerous articles, perhaps none as exquisitely comprehensive as Nathan J. Robinson’s essay in Current Affairs. Honesty is important in any job, of course, but for the particular job Kavanaugh seeks, truth is utterly paramount and non-negotiable.

In saner times, the Canons of the Model Code of Judicial Conduct read like quaint truisms. For example, Canon 2A of the Model Code speaks in the mandatory language of “shall,” and requires that judges “shall respect and comply with the law” and “shall act at all times in a manner that promotes public confidence in the fairness and impartiality of the judiciary.”

Has our political tribalism really become so acute as to render foundational maxims such as the Canons controversial? If so, then truly the loss will be felt by both Democrats and Republicans equally.

Kavanaugh is certainly in an incredibly difficult circumstance, both personally and professionally. I'm not convinced this poll is legitimate, nor were the questions worded in a way that weren't leading.

Sure, it says that 48% of Evangelical White Christians "Should Be Confirmed" if "If the charge of sexual assault during a party in high school by
Christine Blasey Ford against Brett Kavanaugh is true, do you
think Brett Kavanaugh"...

But 32% of Latinos would support him, 31% men and 27% women overall would support him as well... at least according to this survey of 800-900 people that we're expected to believe reflects the beliefs of 320+ Million people. (That's a survey of 0.0000028125% of the people, for anybody not good at math).




At the very least, the article shows the bias of the reporting from Vox. And yes, it was Vox that reported this, so I'm not sure why you linked to an article on a different site that ripped the article off of Vox.

As for Gutfield himself, at least in the article, there was no quotes of his that said he would give sexual assault a pass. The article is based purely off the 100% assumption that Kavanaugh assaulted Ford, and anything he said would be viewed as supporting a predator.

Here's as piece of advice for everyone, including me.

Our discussions would be FAR more productive if we would stop arguing with the voices in our heads. It seems like people (like GSTRING, SHIT, and THUGR) spend FAR too much time imputing motives and points of view to others .... motives and points of view which those others don't have.

Why not just stick to responding to WHAT POSTED, instead of ranting at something that might not even exist? The Sen. Joe Manchin III of West Virginia voting to approve Kavanaugh is interesting to me. 538 has him at over an 88% chance of winning his election, so I can see that vote being in hopes to get re-elected like I thought some Democratic Senators would do last minute.

I can't see on 538 what that percentage was yesterday or last week before this vote took place, but I can't imagine with that wide of a margin that he was plotting.



Senator Donnelly in my state just lost my vote because of this. I have said in the past here that I had every intention of voting for him in the mid-terms.

Back when I said I was voting for him, he seemed to have a comfortable lead. He's now listed on RCP and 538 as a toss up, although with an advantage. This may not have been a smart move on his part.

I'm not sure what you mean here. Maybe it was worded a little confusingly?

When I said that Joe Manchin's vote was interesting to me it's because he was the lone Democrat who went against party lines.

When I said that I was no longer voting for Donnelley when I said I was going to a few months back it is because he is a Democrat and he voted along party lines.

I will not vote for anybody who is in support of making judgements without Due Process, or possibly even worse, somebody who would throw out their principals on that stance in order to vote along party lines.

If I was in West Virginia, Joe Machin would have my vote right now.

With RARE exception, the vote went along party lines. That's my meaning. Despite all the possible Republican wildcards - Snow, Flake, Murkowski, Collins - who indicated reservations - only Murkowski who was opposed - voted 'present'. And despite any potential election considerations or concerns over process, only 1 democrat - Manchin - voted yes.

As I understand, Collins only voted that way so that a different Senator could attend his kid's Wedding.


All of these high standards that the Liberals have now developed, such as Honesty, bearing. Why couldn't they have exercised such objections when Kagan, Sotomayor, Ginsberg where before them?

We can always hope Ginsberg kicks it while Trump is still Preezy.

Yeah, much like Dr. Ford. She had to move from her home and hire bodyguards
(in the hearings I saw the bodyguards and they were huge, like professional
wrestler huge).

So when I hear folk talking about how the Dems behave, it really rankles me to no end. When I saw her, Dr. Ford, I was anxious to hear what she had to say.
I found her testimony riveting and that this poor woman was quite pained to
expose a tragic and violent occurrence in her life.

I worked with battered women and it is oftentimes painfully sad how it affects their lives. They live in constant fear.

When I watched Kavanaugh, ugh, a big difference in comportment and attitude.
I know I'm going to repeat myself, but it bares repeating - what a scumbag.
He consistently lied, evaded and otherwise insulted the committee members
during his testimony. A political tool if ever I saw one. Nothing in his statement, or lies for that matter, spoke of or depicted his stature as judge.
He was smug, arrogant and entitled. A real douche-bag.

It doesn't surprise me that Murkowski received threats. This is typical of
how the Trump/McConnell scumbags operate. They try their damndest to intimidate. Fear is their only response. Fear and ridicule.
