Hilton was NEVER convicted of DUI. She was so sober that police immediately released her without posting bail. Her mugshot looked so sober that police refused to release it. Breath-alcohol tests do NOT test for "alcohol", and have no guarantee from the manufacturer. Dieting can result in a false positive test result. No human being can pass a so-called Field Sobriety Test. She got "convicted" of "reckless driving" (without wrecking). The only reason she was arrested for DUI, and convicted of "probation violation" (civil contempt of court), was because she "voluntarily" testified against herself under duress at gunpoint (violation of 5th Amendment to US Constitution). The only reason she was sentenced to 45 days jail was because she dared defend herself in court, "so she had to be punished as an example to the sheeple," which is what Gangsta Govt tries to do to everyone who asserts their Constitutional rights.
She apparently DID have a driver license to drive to work (or thought she did), etc, which is routinely granted for DUI convictions (Restricted Driver License), but is extremely rare for RD cases (since regular license is NOT suspended). In Hilton's case, the probation period was THREE YEARS, which is a FELONY - very strange when reckless driving is a misdemeanor, with a max six months in jail.

Within 24 hours of my email to Hilton's PR firm, Hilton immediately hired a "DUI lawyer" to handle the appeals, thus firing their "Hollywood entertainment lawyers", on this one case. Coincidence theory? Or ESP?

Good move on Hilton hiring a DUI specialist. I've gotten into debates with many lawyers and judges, on radio and in law college, over many myths on DUI cases. All I did was read legal textbooks on DUI law ( www.duicenter.com), which those lawyers and DUI judges either never read, or are covering up in order to reap higher profits from gullible clients and defendants.
The key evidence was Hilton's "confession" to "drinking ONE drink" (a near-fatal mistake), when she did not realize the fact that the so-called "legal limit" is 0.00% blood-alcohol level (or breath alcohol), which is PROHIBITION. The cop is paid "commission" (overtime to appear in court), so it's more profitable to arrest for DUI than write a ticket for "speeding". "One drink" is translated by the cop to mean "one six pack" or "one case of beer", etc. If the BAC score is low, then police allege the defendant meant, "one beer and a bottle of illegal narcotics", or "one drink and a vial of crack", etc.
Note that the alcohol in ONE beer is metabolized by a healthy non-Asian liver within one hour of digestion. So drinking one alcohol beverage results in a BAC score of 0.00% after a couple of hours. But BAC machines are so unreliable that no manufacturer provides a warantee that any BAC machine can test for alcohol! False positives are common. Dieting, without drinking alcohol, can result in a BAC false score of 0.30%, which is COMA level, due to ketoacidosis. Paris testified to not eating that day, which is by definition, "dieting".
DUI judges literally brag in their college textbooks that prosecutors NEVER need any proof of drugs, never need to find drugs, or never need to test for drugs, "because there's so many different kinds of drugs that it's impossible to test for, so everybody is guilty!" This is why a score of 0.00% BAC is a FAILING score.
The CORRECT answer to EVERY question by police is always NO ANSWER, or, "I respectfully decline to answer that question". The 5th Amendment to US Consitution protects everyone against self-incrimination.
According to US Supreme Court, all that's required is to show "identification" to avoid arrest (NOT a driver license). That could be done verbally. But DUI lawyers write that a verbal response gives police an opportunity to "testilie" about "slurred speech", or "odor of alcohol" (alcohol has NO odor).
It's also interesting that every person has a Constitutionally guaranteed God-given Natural right to travel while driving a car WITHOUT a license (or walking, or riding a dangerous horse, or driving a dangerous horse & buggy, or driving a boat, or flying an ultralight airplane). Civil "driver license contracts" are only required for "commercial drivers for hire", such as truckers or taxi drivers. For 1,00s of years, everyone had the right to travel without a license. Only since the Communist Manifesto has that right been stolen - the 6th Plank of the commie Manifesto is "Government control of communications and transportation". Driver licenses are ANTI American.

Being both really rich and really famous Miss Hilton could have chosen any lawyer she wants. She also could have proceeded without a lawyer. That she chose poorly is not a valid issue for appeal. Just because her lawyers lost the case does not make their assistance ineffective.

Thats true and false. I interned for credit for the office I now Prosecute for and learned DUI law during that internship. The purpose of lawschool is not to learn all the laws, there's too many to remember them all. The purpose is to learn legal thinking and core concepts. Today, Nancy Raving Psycho Bitch Grace again committed slander by falsely claiming Paris Hilton was convicted of DUI. Which just goes to show the rest of CNN's "news coverage" is equally defective (Lou dobbs excepted).
"Reckless driving" is NOT a "lesser included offense" of drunk driving. Thus, when the prosecutor decided to dismiss the DUI charge, there was no other crime to charge Paris with - THAT MEANS SHE WON.
In California, RD carries a max sentence of 90 days jail, so the 3-year "probation" contract was defective, and thus void, as an unconscionable civil contract.
Paris' Simple Life TV partner Nicole Richie was also arrested for DUI. Twice - just like Dick Cheney. She also was arrested for heroin possession, that was DISMISSED after diversion and probation, just like Bush Jr's cocaine arrest. Nicole does have a DUI conviction on her record, just like the soon-to-be-impeached "president" and impeached "VICE president".

This week, a motion for new trial was filed with Tennessee Court of Criminal Appeals, to overturn a murder conviction of a kid who shot his school principal, and sentanced to 45 years. The motion was filed due to inneffective assistance of counsel, as confessed by the ineffective counsel. His guilty plea was "withdrawn" (rescission of civil contract). The appellate judges will agree that the 15-year-old kid was too young to sign a civil contract "without his parents' permission". Only adults over 18 years of age are allowed to sign contracts.
