Dark Horizons appears to confirm my theory - Ashmore has been told the two films clash, and has to do X-Men. Marsden on the other hand wasn't signed for 2 sequels so Cyclops will have to be re-cast or dropped.
Have to say, in this modern movie world where the trilogy for event movies seems the done thing (the law of diminishing returns versus growing budgets taking over thereafter in general), why they didn't option all the actors for 3 is beyong me.

If they can't get Jean or Cyclops back then they should just go for a different story instead of Phoenix. They have plenty of stuff to draw on...

I don't really mind if they recast - Jean's could even be explained as resurrecting herself in a younger body (not that Famke Janssen's old per se, but she was noticeably older than Cyclops which made it seem a little odd)... as for Cyclops... well, frankly, I don't think James Marsden's really distinctive enough to have the edge on the role especially since the upper portion of his face is covered much of the time.
However, if they do the Phoenix/Dark Phoenix story, Cyclops has to be there IMHO - the story doesn't work with Wolverine in his place.
There are other stories that can be done, but none that really have the iconic status that Dark Phoenix does - if they don't go this route, I'd rather they try to come up with a completely new story (or maybe even lift the idea of 'The Cure' from Whedon's run on Astonishing, although go in a different direction since a lot of the elements in the story wouldn't work).

That would be a great storyline. Maybe intertwine it with something like the Legacy Virus... with the cure being like a vaccination.
Turns out both were created at the same time as a way to get rid of mutants (either they die or are stripped of their powers).
Could be a good way to introduce Moria McTaggert and a host of mutant cameos.

Other plots I wouldn't mind seeing from the books:
1) The Morlock Massacre. I was a kid when this happened, and remember reading elements of it vividly. I don't think it'd be fodder for a movie though because it's not 'a big concept' - it's basically just a rescue mission from the X-Men of minor mutants. Maybe it would be best saved for like a 4th movie when most of the cast have moved on and nobody really _expects_ the movie to be great, so they have more fun with it (and cast some minor characters like the New Mutants or something).
2) Days of Future Past - Have to be modified, of course, because of things in the first two movies, but it could be hard for the public to take because of the 'time travel' aspect - the 'glimpse at a dystopian future that must be prevented at all cost' is an element that's been so overused by nearly every SF show it's become cliche.
3) Something involving Genosha might work -
First movie was protecting the humans from a fringe element of mutants, second movie was protecting the mutants from a fringe element of humans bent on extermination, third movie could be a glimpse at a state where persecution of mutants is the norm - maybe even, over the course of the movie, have Magneto take over to get both sides of the coin. Doubt it could be accomplished, but you never know.
You could work, say, the Hellfire Club as antagonists into a plotline without Phoenix being involved, but I'm not in favour of it.

I recall a big noise being made by the stars when they started X2, and the studio removed Bryan Singer. Seems they didn't want to do the film without him. (from what I heard, could be wrong) now they follow him to a different film? Seems the studio should get a clue and do what is neccesary to get Singer back on board, as he is likey the second best director out there. (slot #1 reserved for Joss). Or on that note, introduce the cast to Joss.

Eh....I guess having the Jean chick back is ok.
I wouldn't have minded a recast though. She just doesn't play a good Jean to me.
I'm also worried about X3 going too over the top for most people. X-men and X2 were semi-believable stories. Basically accepting mutants and a few out there machines is all people had to do.
Now if they have phoenix flying off to fight aliens I think a lot of people are just going to turn away from the movie. It will probably still be successful but not as well as it could have been.
Hopefully if they do something with phoenix they will make it a much smaller story.

Oh yeah, if they do Phoenix I can't imagine them NOT changing it and making it almost exclusively Earth-central.
