Retired conservative Judge J. Michael Luttig helped stop Trump on Jan. 6. He wants to finish the job
His obsessively precise written opinions for the U.S. Court of Appeals for the 4th Circuit in Richmond had marked Luttig as one of the leading conservative intellectuals in the legal system — the most conservative judge on the most conservative court in America.
More than a quarter-century later, it was Luttig (pronounced LEW-tig) who would get a late-night call to come to the aid of his tribe: Mike Pence, in his final days as vice president, would seek out Luttig’s legal advice on the night of Jan. 4, 2021, as Donald Trump pressured him to help overturn the results of the 2020 election. But Pence and his allies would need more from Luttig than his private counsel.
They needed his imprimatur.
What began as a late-night phone call has turned into the quest of a lifetime for Luttig, the pinnacle of a long and storied career, highlighted last summer by his stirring appearance before the congressional panel investigating the Jan. 6 uprising at the U.S. Capitol and by the committee’s final report released in late December, which mentions his name more than 25 times.
“Donald Trump and his supporters and allies are a clear and present danger to American democracy,” Luttig told the committee on live television.
But Luttig wasn’t just condemning Trump and Trumpism. He was trying to bring a nation to its senses.
“We Americans no longer agree on what is right or wrong, what is to be valued and what is not, what is acceptable behavior and not, and what is and is not tolerable discourse in civilized society,” he said. “America is adrift.”
Months removed from that star turn, Luttig’s worries have begun to ebb ever so slightly. He now envisions a nation one day disentangled from Trump’s influence, even as the former president launches a new campaign. It’s a future Luttig is trying to shape in court cases, in legislative chambers where he’s helped craft election law changes and in professorial public appearances where he explains in painstaking detail how American democracy, though imperiled, can still be preserved. . . .

In his recent book "Thank You for Your Servitude", my colleague Mark Leibovich quoted a former Republican representative who bluntly summarized his party’s plan for dealing with Trump: “We’re just waiting for him to die.” As it turns out, this is not an uncommon sentiment. In my conversations with Republicans, I heard repeatedly that the least disruptive path to getting rid of Trump, grim as it sounds, might be to wait for his expiration.
Ha! Good luck with that. Consider this:
• Donald Trump has a Filet-O-Fish–centered diet, exercises only by playing golf, and employs some of the least trustworthy-seeming doctors to have ever been associated with the medical profession.
• He did not take the threat of COVID seriously at all and actually got COVID himself just before the last election.
• He’s 76 years old.
• He nonetheless recovered fully from COVID and has had no known health problems since. He looks fine. (He looks less frail than the Democrats’ likely 2024 nominee, for one.)
Have you ever seen Velveeta go bad? No, because it’s not real food. The same is true of Donald Trump and being a human.

RNC Urges Candidates to Double Down on the Thing That Made Them Lose in November
It's a bold plan.
In the wake of a disappointing midterm election cycle for the GOP, which analysts and exit polls attributed in large part to widespread public dissatisfaction with the party’s efforts to criminalize abortion, the Republican National Committee is urging party members to … er, redouble their efforts to criminalize abortion.
A resolution passed on Friday at the winter meeting of the RNC exhorts GOP lawmakers to “pass the strongest pro-life legislation possible”—essentially, to double down on one of the least popular parts of the party’s platform. The document suggests that six-week abortion bans, such as the one that took effect in Georgia after the Supreme Court overturned Roe v. Wade, are one example of the types of laws Republican legislators should pursue, but it implies something much stricter: The “strongest possible” anti-abortion legislation would be a total abortion ban. The resolution also makes an oblique comparison between abortion and human enslavement, noting that the party’s original 1856 platform “rejected ‘the twin relics of barbarism,’ polygamy and slavery.”
Abortion, the document states, is one of “the new relics of barbarism the Democratic Party represents.”
The resolution goes on to criticize Republicans who, in the lead-up to the 2022 midterms, strove to attract moderate voters by keeping quiet on the topic of abortion or walking back their extreme stances. In the parlance of the document, these candidates “failed to remind Americans of our proud heritage of challenging … the forces eroding the family and the sanctity of human life.”
As a strategic move, this all very unwise. But what’s the Republican Party to do? It has spent the past several decades rallying its base by claiming abortion is literally murder—the RNC would look like a bunch of chumps if they backed down now that the dog has caught the proverbial car.
