The only responsibility and power of the Vice President under the Constitution is to faithfully count the electoral college votes as they have been cast.

The Constitution does not empower the Vice President to alter in any way the votes that have been cast, either by rejecting certain of them or otherwise.

How the Vice President discharges this constitutional obligation is not a question of his loyalty to the President any more than it would be a test of a President's loyalty to his Vice President whether the President assented to the impeachment and prosecution of his Vice President for the commission of high crimes while in office.

No President and no Vice President would -- or should -- consider either event as a test of political loyalty of one to the other.

And if either did, he would have to accept that political loyalty must yield to constitutional obligation.

Neither the President nor the Vice President has any higher loyalty than to the Constitution.

Don't get over-confident, 6ix. Trump's political career would have ended if 10 Senators had been slightly braver.

Twelve Republicans, while voting against conviction because Trump was no longer president, explicitly deplored his behavior or assigned him some blame for the attack. One of the 12, Sen. Rob Portman, said Trump had violated his oath of office. These 12 senators, combined with the 57 who voted to convict, formed a two-thirds majority to condemn the former president.

What about the others? There’s a hard core of about 15 Republicans who have reached for any excuse, denounced any criticism of Trump, or concocted smears to deflect the evidence against him. It’s a shameful nest of apologists. Here’s how they rationalized their votes:

1. The evidence is fake. House impeachment managers documented their case with hours of video, as well as written comments from Trump and the Capitol assailants. Nevertheless, some senators refuse to accept any of it. “The entire House managers’ case is based on hearsay,” said Sen. Ted Cruz. “The trial record was a complete joke,” said Sen. Lindsey Graham. Even after Trump’s lawyers agreed to admit as evidence a written statement from a Republican congresswoman about an incriminating conversation with House Republican Leader Kevin McCarthy, Graham dismissed her account.

2. Anyone who denounces Trump must be denounced. Graham and Johnson repeatedly castigated Senate Minority Leader Mitch McConnell for objecting to Trump’s conduct. In radio interviews over the weekend, Johnson said McConnell should “zip his lip” because his criticism of Trump “divides the Republicans.” Johnson also repudiated the Jan. 6 speech in which McConnell criticized Trump for lying about the election results. Meanwhile, in Fox News interviews, Graham complained that McConnell had “put a load on the back of Republicans” by making anti-Trump statements, to which other Republican senators would now have to respond.

12 Republican Senators said Trump was guilty but wouldn't convict him because it would damage their political careers. 7 more Republicans voted to convict because they weren't afraid of Trump but were afraid of looking like gullible fools to believe Trump's lies.

Attorney General Bill Barr launches blistering attack on Trump in new book

‘The absurd lengths to which he took his “stolen election” claim led to the rioting on Capitol Hill’

Before announcing that he was stepping down from his role early, in December 2020 – after Mr Trump’s election defeat but before the Capitol riot – the outgoing attorney general told the then-president that the Justice Department had seen no evidence of widespread fraud that could have affected the result of the election.

In his book, expected to be published on 8 March, Mr Barr recalls the reaction to his assessment. Mr Trump reportedly shouted: “This is killing me – killing me. This is pulling the rug right out from under me.”

“He stopped for a moment and then said, ‘You must hate Trump. You would only do this if you hate Trump.’”

Mr Barr then offered to resign. “Accepted!” Mr Trump yelled, banging his palm on the table. “‘Leave and don’t go back to your office. You are done right now. Go home!’” However, White House lawyers apparently persuaded Mr Trump not to accept the resignation offer.

As he has before, the two-time former attorney general – who also served under George HW Bush from 1991 to 1993 – blames Mr Trump for the Capitol riot on 6 January.
