OK, JO753, I wanted to get back to you on the Rachel Madcow video - which I only listned halfway thru, she's such a roomba ... with something other than an automated response.

WHY, for god's sake, is she spewing about "how our DoJ is not supposed to work" NOW?'

Didn't she notice that Hillary Clinton had hired Perkins- Coie (law firm) to hire Fusion GPS, who hired Christopher Steele, who paid a drunken disaffected Russian (who had a habit of telling people what they wanted to hear, for money) and that disinfo was used to concoct a "dossier" full of lurid, evidence-free allegations?

Didn't Madcow notice that this evidence-free "dossier" was back-channeled by Nellie Ohr (CIA) to her husband, Bruce Ohr (Associate Deputy Attorney General) who stove-piped it to James Comey ( Director of the FBI), Peter McCabe (Acting Director of the FBI, after Comey was fired), and Peter Strzok (FBI "investigator/instigator"), and that a witch-hunt was begun on that basis?

She also didn't object to Comey using the discussion of the "dossier" with Trump (while assuring him that he was not under investigation) as an excuse to divulge the allegations against Trump to Senators, so that it could be leaked to Buzzfeed (via McCain aide David Kramer,

Didn't Madcow notice that the FBI charged Michael Flynn wiht lying, even as their internal reports indicated that his interviewers - including Pter Strzok- believed he wsa telling them THE truth?

She didn't notice that the same firm (Perkins- Coie) ALSO hired Crowdstrike to "examine" the suposedly hacked, and leaked, DNC emails, which blared to the public that they had found "evidence" of Russian involvement, but that THE FBI ITSELF NEVER LOOKED AT THE SERVERS? Meanwhile, Crowdstrike was secretly testifying to the Senate that there was NO evidence that the emails had been "exfiltrated" - i.e. remotely uploaded- by ANYONE, let alone Russians?

And what about that form on Trump aide Carter Page, that was illegally changed by FBI Lawyer Kevin Klinesmith to aver that Page was NOT working for the CIA - which he was- which would explain his contacts with Russians .... because he was passing that info back to the CIA!

I could go on and on about the conspiracy on the DOJ to fabricate "evidence" about Trump, involving the FBI, CIA, Senators, the abuse of the FISA Court, suppression of exculpatory evidence, and illegal leaks to the media (these investigations are supposed to be hush hush) ... why didn't she object THEN?

This trail of abuse of process and illegalities by the CIA and FBI are not rumors or allegations, JO753, they are FACT, found in various Inspector General reports and internal investigations. It forms a clear picture of a multi-year conspiracy to dislodge a duly elected President from office. Why wasn't Madcow hyperventilating about the subversion of the DOJ and an ACTUAL attempted coup and loss of democracy THEN?

There were thousands of allegtions of improprieties observed during the ballot-counting process, backed by hundreds of affidavits (sworn testimony). This was NOT "made up" by Giuliani. It was the concern of roughly 75 million Americans.

What would have happened if the DOJ had NOT "investigated"? There would have been a huge hue and cry of a coverup. As it is, the DOJ did the establishment a huge favor by investigting and finding nothing.

The office of Special Counsel John Durham has confirmed that Igor Danchenko, a key source for British ex-spy Christopher Steele, has been arrested. This is the third arrest by Durham who is moving toward the prosecution stage of his investigation into the origins of the Russian collusion scandal. Durham is variously described as either painfully methodical or positively glacial as a prosecutor. But he is widely credited with being a dogged and absolutely apolitical prosecutor. Danchenko’s arrest is a seismic development and confirmed Durham is far from done with his investigation.

Washington was recently rocked by the indictment of Michael Sussman, former counsel for Hillary Clinton’s 2016 presidential campaign and the Democratic National Committee, for his alleged role in spreading a false Russia conspiracy theory.

Now Danchenko is being charged with lying to the Federal Bureau of Investigation.

Danchenko is widely referenced as the sub-source for former British intelligence officer Christopher Steele for his controversial dossier. That dossier, funded by the Clinton campaign, served as the basis for Foreign Intelligence Surveillance Act (FISA) warrants against Trump campaign aide Carter Page.

Danchenko told the FBI that the dossier was “unsubstantiated” and said that Steele asked him to look for any “compromising” information on Trump. Mr. Danchenko worked for the Brookings Institution, a liberal Washington think-tank that often produced reports critical of Trump.

Danchenko is not someone who immediately comes across as an apex defendant — the highest target in an investigation. He was a key source used by others to advance false or unsubstantiated claims against Trump. He is the type of defendant that prosecutors pressure to flip against those who retained him or used him in this effort. In other words, he strikes me as someone who can be used as a building block to apex defendants.

Potential apex targets above him in investigation range from Steele himself to Clinton general counsel Marc Elias to Clinton campaign officials.

There is no indication if Durham has possible evidence of criminal acts by those figures but there is every indication that he is not done by a long shot with this investigation.

I just wanted to make sure you see REAL evidence, found by criminal investigation and durable enough to warrant actual arrests, instead of "allegations" and "indictments" (later withdrawn.)

I do hope you open your mind up to the possibility that you might be wrong, JO. It's not so terrible to reach erroneous conclusions, it's only bad when you cling to them.

Apparently, not only did the Russian ad agency accused by Mueller of interfering in the 2016 elections show up for it's day in court ... causing the DOJ to withdraw it's case... so did AlfaBank, which had been accused of secretly communicating with a Trump Tower server.

The parties at the other end of the lawsuit-FusionGPS et al, -are taking a playbook from Hillary Clinton, hiding evidence etc.

Special Counsel Durham found those hidden emails, and Alfa is petitioning the court to have them introduced as evidence.

Overview

For background, the fight arises out of a lawsuit – Fridman, et al. (Alfa Bank) v. Bean LLC a/k/a Fusion GPS, and Glenn Simpson, where the owners of Alfa Bank have sued Fusion GPS and Simpson for falsely accusing “the Plaintiffs—and Alfa (“Alfa”), a consortium in which the Plaintiffs are investors—of criminal conduct and alleged cooperation with the ‘Kremlin’ to influence the 2016 presidential election.”

The case was filed in October 2017. Litigation has been ongoing for over four years – with Alfa Bank still fighting to obtain written discovery from Fusion GPS that is material to its case. Our previous report had to do with that very discovery dispute. Back in May, Alfa Bank “filed a motion to compel, asking the Court to require Fusion GPS and Glenn Simpson to produce nearly 500 critically important documents improperly withheld as privileged.” (More background here.)

These documents included e-mail correspondence within Fusion GPS regarding the “Alfa Playbook” and showed the early development of the Fusion GPS/Simpson work on Trump/Russia. One would assume this entails the early or emerging thought process of the “intelligence” group as they sought to falsely accuse the Trump campaign of colluding with Russia.

In a later post from July 2021, we observed that records indicated Fusion GPS had been in contact with Michael Sussmann of Perkins Coie regarding Alfa Bank. More communications Fusion GPS is trying to keep secret.

What nobody realized at the time, however, was the importance of these communications. Michael Sussmann – the DNC/Hillary Clinton campaign lawyer – would later face false statement charges and be basically accused of being part of a conspiracy to defraud the federal government with respect to the Trump/Alfa Bank allegations.
The Latest Developments

Today, the attorneys for Alfa Bank filed this their “Supplement to Plaintiffs’ Second Motion to Compel Defendants to Produce Documents Improperly Withheld as Privileged.” The motion was filed to inform the court that Fusion GPS and Glenn Simpson (and/or their attorneys) “possess numerous documents responsive to Plaintiffs’ RFPs [requests for production] that [Fusion/Simpson] neither produced nor included in their privilege log.”

[Brief interlude: generally, the parties request and exchange documents in a federal civil case like this. A party can avoid producing documents where they claim a privilege – they just need to typically submit a “privilege log” to the other side. This doesn’t mean the privilege will ultimately prevail.]

What does the latest filing by Alfa Bank reveal?

Fusion GPS/Glenn Simpson (or their attorneys) failed to submit in the privilege log certain communications ultimately uncovered by Special Counsel John Durham. I’ll let the Alfa Bank motion explain:
