On Tuesday, a panel of the U.S. Court of Appeals for the D.C. Circuit issued a 2–1 decision upholding a lower-court ruling that ordered the Department of Justice turn over to Congress the parts of the Mueller report that have until now remained secret.

Rao’s latest efforts to shield the president from legal liability, though, appear likely to fail. The judicial precedents involved stretch back to the Nixon administration, and Rogers, in invoking them, was backed up by a jurist with conservative bona fides. Griffith added a concurrence demolishing Rao’s dissent, and the DOJ now has one week to appeal the decision. We may soon learn what is in the portions of the Mueller report Attorney General William Barr has been so desperate to keep from Congress and the public that his DOJ was willing to argue that key Watergate-era precedents should no longer be enforced.

In dissent, Rao claimed that the court did not have authority to compel DOJ to release grand jury materials, only to authorize that it be turned over. The president, under her analysis, would hold an effective veto over whether a court’s judgment required the administration to hand over evidence of high crimes and misdemeanors to Congress.

Griffith’s’ concurrence emphatically rejected this theory:

The dissent insists that “possession” is the “dispositive factor” in our jurisdictional analysis: When the court holds the grand jury materials, it may hand them over; when it does not, it may not compel the Department to do so.

Griffith punctured this argument by noting that the court clearly has authority to compel in-camera review that would bring the grand jury materials into its own possession. If the court can compel the DOJ to turn over the grand jury materials to a judge, and it can then decide to hand over the materials to Congress, it can similarly “cut itself out as the intermediary” and order they be handed over directly to Congress.

Rogers and Griffith recognized together that the DOJ has no good reason to ignore its own history of repeatedly turning over grand jury materials to Congress during impeachment cases—including Watergate—and that the court controls the evidence in question, not the DOJ.

The Mueller Report said that Trump should be in jail for obstruction of justice but also said the Department of Justice cannot arrest a President. Once Trump is NOT President, he can be arrested. This is exactly like Trump's tax cheating. He cannot be jailed for cheating as long as he controls the IRS, but once Trump is NOT President, he can be arrested.

If you search the Mueller Report document, "obstruction" is mentioned 176 times. But Trump will pardon himself before he leaves the White House, then the validity of the pardon will be litigated for the rest of Trump's life. As for his tax cheating, the statue of limitations will keep Trump out of jail. That is what saved Roy Cohn, Trump's mentor. Roy litigated and delayed paying his taxes until he died of AIDS, using death as his way out of both going to jail and paying. Trump will do the same and get away with criminal behavior, unless a Democratic President orders his Attorney General to stomp Trump's ass. Trump would give the order, if the tables were turned, but I don't think a Democratic President would.

What the Democrats need is a vindictive Democratic President, such as LBJ, rather than a nice guy like Biden. LBJ would stomp retired President Trump's fat greasy ass with all the might of the Justice Dept. and the IRS, but Biden would not.

Essentially, America has a screwed up justice system for Presidents and ex-Presidents. If 67 Senators won't discipline Trump, he can do as he pleases while President. If the next President won't discipline Trump for what he did, he can do as he pleases. See what happened to Bush and Cheney: nothing happened because Obama didn't punish them, although Bush and Cheney were convicted in a war crimes trial.
