The Trump administration has attempted to block a key witness from testifying in the impeachment inquiry by claiming “constitutional immunity.” And that witness — former deputy national security adviser Charles Kupperman — has asked a judge to rule whether his testimony can proceed as planned.
Kupperman made the request in a lawsuit filed Friday; he was set to testify before lawmakers on Monday, after being subpoenaed.
The administration had not previously invoked constitutional immunity, and the decision in Kupperman’s lawsuit could be precedent-setting at a moment in which officials are increasingly caught between directives from the executive and legislative branches that at are, as Kupperman’s lawyer said in a statement, “competing and irreconcilable.”
“Plaintiff obviously cannot satisfy the competing demands of both the legislative and executive branches, and he is aware of no controlling judicial authority definitively establishing which branch’s command should prevail,” the suit reads.
Kupperman’s suit could bring new clarity to the question of what government officials should do when given competing instructions from Congress and the White House.

At this point, it probably goes without saying that the themes Trump ran and won on in 2016, and the themes he governs on, are short on philosophical coherence. But they have a deeper psychological coherence. Trump's appeals to ethnic and racial resentment, his portrayals of a country and culture under siege, and his populist demonization of multiple enemies offered Republicans something more appealing than any particular list of policies: They offered solidarity against a threat of Hillary, of Bernie, of Obama, of Mexicans, etc. On this reading, Trump may have secured his initial foothold by catering to the George Wallace portion of the party, but the remainder did not rally to Trump because they embraced his message; they embraced his message in order to rally to Trump. He offered a vivid us-versus-them story that energized one portion of the party, and then, once his followers redefined what "we" (the in-group) believe, the rest of the party preserved its identity by scrambling aboard. Although the result was to reverse Republican orthodoxy on everything from entitlement spending and trade protectionism to global alliances and the FBI, partisans felt no psychological inconsistency or lurch, because, as a result of their ideological somersaults, they continued to be aligned with the same in-group and opposed to the same out-group: those horrible, awful, evil Democrats like Hillary and Obama.

Democrats are fond of declaring that those who vote Republican are on the shorter end of the bus. One line of argument goes that Grand Old Partiers are just not bright enough to figure out what's best for the nation, or even themselves. Another insinuates that they lack the faculties to deal with nuanced issues and therefore hold fast to absolutes: ALL fetuses are full people; ALL taxes go to gay crack-addicted single moms on welfare. Indeed, some studies have supported such a simple correlation between political views and intelligence, but new research soon to be published in the journal Personality and Individual Differences paints a more muddied—and interesting—red and blue picture of IQ.

"I expected to find in some ways more of the same-old, that primarily more liberal views are linked to higher ability levels," Kemmelmeier says.
