The Supreme Court’s agreement to hear Moore v. Harper is poised to let state lawmakers overturn voters’ choice in presidential elections.

To understand the stakes, and the motives of Republicans who brought the case, you need only one strategic fact of political arithmetic. Six swing states — Pennsylvania, Michigan, Wisconsin, Arizona, Georgia, and North Carolina — are trending blue in presidential elections but ruled by gerrymandered Republican state legislatures.

Joe Biden won five of those six swing states in 2020. Donald Trump then tried and failed to muscle the GOP state legislators of those five states into discarding Biden’s victory and appointing Trump electors instead. The Moore v. Harper case could give Republican controlled legislatures the legal cover in 2024 to do as Trump demanded in 2020, something they did not have in 2020.

Three Supreme Court judges have said in speeches that they would allow state legislatures to pick the electors sent to the Electoral College. The old way was for the voters to decide, not the legislature. The old way, old-fashion Democracy, may become the obsolete way.

That is exactly what Trump wanted in 2020, but he needed five, not three, Supreme Court judges to do that. By 2023, there probably will be five judges to give Trump what he wanted. Better late than never if you are a judge planning on overthrowing Democracy.

Five Supreme Court judges gave George Bush what he wanted in 2000 for the vote count in Florida. This time it will be a different set of five Republican judges, not the voters, picking the next President. How well did President George Bush work out? Pretty good?

An election was overthrown by the Supreme Court in 2000. "Al Gore, not George Bush, should be sitting in the White House today as the newly elected president of the United States, two new independent probes of the disputed Florida election contest have confirmed."

The Supreme Court in 2022 has decided that stealing one election in 2000 isn't enough. Three Republican justices have said they want to make every election a stolen election. Someday, if there are five justices that think it's fair, then every election can be stolen by a state legislature declaring the winner instead of the voters picking the winner.

Trump called a witness due to testify in the Jan. 6 Congressional committee's investigation. It wasn't, 'You can't testify or we'll kill you,' but implying that he's paying attention and he's going to read the transcripts. Trump previously kept himself off such things, allowing his minions to do his dirty work. For him to reach out directly to the witness means he's desperate and he's overestimating his power to manipulate people.

Trump's former lawyer Michael Cohen said the "witness tampering" is a sign he is "melting down," Business Insider reported. During his tenure with Trump, Trump never called anybody. Why It's Important: Trump doesn’t want testimony that he gleefully watched for hours the Jan. 6 riot on TV.
